Chairman Sager called the meeting to order at 1:30 p.m.

Planner Stamey advised that, in view of the riverwalk
development that is anticipated on the rear of this property
in coordination with Urban Renewal, the riverwalk easement
should be defined on the plat.
Commissioner Garrett stated that the granting of the
exception will not be materially detrimental to the public
welfare or injurious to other property in the neighborhood
in which the property of the petitioner is situated or in
conflict with the purposes and objectives of Title 16, and
moved for fayorable recommendation of this final plat to the
Town Board with the following conditions to be incorporated:

Planner Stamey advised that a portion of the site is within
the 100 year floodplain and acknowledged correspondence from
Art Anderson, EPURA Executive Director, dated October 12,
1989 addressing this issue. In the letter Mr. Anderson
states that the first phase of the project involves the
lowering of the river bottom for a distance of 900 feet from
the East Riverside bridge to increase the 100 year flood
capacity. It was recommended that assurance be obtained
from Wright Water Engineers indicating that this property
will be removed from the 100 year flood plain after the
channel work is completed.
Mr. Galen Parrack, adjacent property owner, spoke in favor
of this proposed development, stating he felt it would be a
tremendous benefit to East Elkhorn Avenue.
Hearing no further comment from the audience. Chairman Sager
declared the public hearing closed.

right-of-way. Director Widmer stated that the site is 2.62
acres in size with a single family residence, and is
adjacent to town boundaries. Town Planner Stamey noted the
Annexation Service Plan, which indicates this property is
capable of being provided with public services and
utilities.
Hearing no comments from the audience. Commissioner Garrett
moved that the annexation of the Seifert Addition be
favorably recommended to the Town Board. Commissioner
Burgess seconded the motion and the vote was unanimous.
Zoning
Town Planner Stamey advised that the applicant had requested
R-M Multiple Family zoning. However, based on
recommendations of the town's Comprehensive Plan and site
characteristics, he had recommended R-S Residential (one and two family) zoning.
DUf the fact that the property owners live out of state and have not had an opportunity to comment on staff
recommendations,^ Planner Stamey recommended the Commission
continue the zoning portion of this application. After
discussion. Commissioner Hix moved that the zoning portion
of this request be continued to the November 21 Planning
,5"eetiri? in. order to allow applicant time to
respond on the zoning issue. Commissioner Wood seconded
tne motion and the vote was unanimous.
