Amended Plat, Lot 2, Deer Crest Subdivision, and Tracts 56 & 57, Fall River Addition Members Wood and Hix advised they had a conflict of interest and would abstain from discussion and voting on this request. Planner Stamey noted that he had a Contract to Purchase proposed Tract 57, and, therefore, had not participated in review of this subdivision. He also requested to be excused during discussion and advised that Public Works Director Widmer processed the request and would provide staff comments. Mr. Bill Van Horn, representing applicants, advised that the site consists of 26.59 acres with 3 existing lots. The amended plat proposes to rearrange ^he existing tracts in order to create one additional tract, the smallest of which would be 1.82 acres. Mr. Van Horn state that he would add a note to the plat to provide for easements for the sanitary sewer service lines. BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Planning Commission - August 15, 1989 - Page 3 Planner Stamey summarized the staff report noting that the amended plat adjusts the common boundary line between two existing parcels (Tracts 1 and 2) and eliminates several offsets along the lot line. He also noted that all staff recommendations had been addressed. Member Barker stated that the granting of the exception will not be materially detrimental to the public welfare or injurious to other property in the neighborhood in which the property of the petitioner is situated, or in conflict with the purposes and objectives of Title 16, and roove^ than thjS amended plat be favorably recommended to the Town Board. Planner Stamey advised the Commission that a letter had been received from Estes Park Surveyors dated August 14, 1989 regarding the above referenced property. In this letter Mr. Paul Kochevar, President, stated that the preliminary plat need only include the 9.6 acre and 8.5 acre tracts that are North and Northeast of the Stanley Hotel. In conjunction with other modifications to be presented with their development plan, this reduces their submittal f ^ lot division. Therefore, Mr. Kochevar requested this preliminary pS Sr withdrawn. He complimented Mr. Wadman on the slide presentation but felt it did not bring to light all information needed. Mr. Gray concurred and at this time requested_the review be tabled until the next Planning Commission meeting. Public comment was heard from the following: Mr Brooks Findley. Stated that he is a lender on a portion of thisproperty and that applicant did not have clear title to the land, that a deed is now being litigated, which is set for trial on Sept. l. Dr. Robert Smith. Suggested there were serious legal problems with the property in question. BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Planning Cominission - August 15, 1989 - Page 6 6.REPORTS Planner Stamey advised the Commission that the 1990 budget year was approaching and one item that warranted consideration was updating the Comprehensive Plan and looking at preparing a new document in 1990. He recommended a 2 year process be implemented to accomplish this in order to allow for public participation, and also have adequate funding for the Comprehensive Plan.
