Minutes of the Planning Commission meeting held May 17, 1988 were submitted and approved. 2. ZONING OF ANNEXED LAND 2.a. Lot 1, Elm Road Addition - Applicant: Town of Estes Park Chairman Sager opened the public hearing to consider the zoning of Elm Road Addition which was annexed into the town on June 14, 1988. The site is located at the northwest corner of Highway 36 and Elm Road and consists of 3.6 acres. Planner Stamey sximmarized the staff report stating that the site is currently vacant and the proposed zoning is C-0 Outlying Commercial. The Light and Power Dept, is proposing to construct a new service building on the site, which is a permitted municipal use in a C-0 zoning district. He further stated that the requested zoning is consistent with the Estes Park Comprehensive Plan and is compatible with the existing zoning in the surrounding neighborhood. The following testimony was zoning request: heard in "opposition" to the Giles Gere - Representing the Beaver Point Association, Mr. Gere stated they had seen nothing showing how the rest of the area was going to be utilized. He felt the Light & Power building would be an unsightly addition adjacent and across from tourist accommodations and saw no reason why the area near the transfer station couldn't be used instead. Rod Hallberg - Representing Mr. & Mrs. Robert Mitchell, Mr. Hallberg said on March 18, 1988 his clients sent a petition to Mayor Dannels objecting to the proposed zoning and development plan. He said the residents and property owners in the Beaver Point area are concerned about the planning process taking place. They feel the C-0 zoning designation does not take into consideration a greenbelt or open area and feel they have not been listened to. They feel now is the time to start some type of planning in this area and they do not feel the proposed use will enhance the area. Gene G^niar - Lives at 1760 Hummingbird Lane and is President of the High Drive Homeowners Association, which has ap­ proximately 150 members. He said the homeowners felt they should have been more informed about something that was going to affect their property. He further stated that this area accommodates entry into RMNP for several million visitors each year and is concerned about the visual impact visitors will receive. BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Planning Commission - June 20, 1988 - Page 2 Town Administrator Klaphake reported that Mayor Dannels had responded to the Beaver Point petition by sending a letter to all parties listed on the petition and holding a public meeting to explain the development and respond to their questions and concerns. Light and Power Director Dekker summarized the site selec­ tion process stating that a study of possible sites had been going on for four years. Last year the committee again looked at other sites such as the Frank Williams' property and the area near the transfer station, but because of either financial, locational or geographic constraints, opted to build on property already owned by the town. There being no further comments from the audience. Chairman Sager declared the public hearing closed. Commissioner Brown stated that the majority of the comments heard in opposition related to use of the site rather than the zoning. He stated the requested zoning is consistent with the Comprehensive Plan and moved the proposed C-0 zoning be favorably recommended to the Town Board. Commis­ sioner Hix seconded the motion and it passed unanimous y. 2. BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Planning Commission - June 20, 1988 - Page 3 Attorney Rod Hallberg, representing Mr. & Mrs. Robert Mitchell, expressed concern about drainage and water runoff in the area. He also addressed the issue of noise from the backup alarms on town vehicles. Public Works Director Widmer reported that this area currently had a drainage problem. He also advised that the engineer has been asked to design the drainage system so the difference between the 2-year historic and 100-year develo­ ped will be retained, which exceeds state requirements. Mr. Widmer also advised that backup alarms on large vehicles are required by OSHA for safety reasons and are exempt from noise standards. Commissioner Brown commented that because of the noise impact on the area, he felt the decibel level of the backup alarms was of paramount importance in making a valia assessment and also felt there should be additional public input, whereupon he moved to table approval of this deyelcpp- ment plan until the next scheduled Planning Commission meeting. The intent was not to increase the allowable number of units, but to allow some flexibility in the type of structures placed on a site. In addition, the draft amendment would limit the amount of allowable impervious coverage on a site, in relation to the average slope of a site. Planner Stamey acknowledged receipt of a letter from EVIA dated June 18, 1988 and ARD dated June 20, 1988 and read them into the record. Both Tom Brown and David Habecker commented from the audience in favor of this amendment. Hearing no further comments either in "favor' or in "opposition". Chairman Sager closed the public hearing. Commissioner Barker moved that this amendment to the zoning ordinance be favorably recommended to the Town Board. Commissioner Hix seconded the motion and it passed un­ animously. Following completion of all agenda items. Commissioner Hix complimented Town Planner Stamey for the fine job put forth on this amendment and in conducting the workshops. Chairman Sager moved that Planner Stamey's efforts be recognized. Commissioner Hix seconded the motion and the vote was unanimous.
