SUBDIVISIONS held September 2.a. Sunny Acres Addition. Amended Plat of Lot 18, 17B and the East 17 feet of Lot 17A. Planner Stamey presented the staff report and stated that the Planning Commission reviewed this boundary adjustment request on April 21, 1987 at which time the proposal was tabled until applicant resolved the encroachment of the freestanding sign into the public right-of-way. The Board of Adjustment granted a variance on June 24, 1987 for the freestanding sign, provided^it be rotated to the north 180 degrees out of the public right-of-way. Mr. Bill Van Horn represented the applicant and stated that the sign is in compliance with the Board of Adjustment's stipulation. Also, as recommended by the Water Department, separate water service will be provided for Lot 17B. Following discussion. Commissioner Wood stated that the granting of the exception will not be materially detrimental to the public welfare or injurious to other property in the neighborhood_ in which the property of the petitioner is situated or in conflict with the purposes and objectives of x.^nd moved that this request be favorably recom­ mended to the Town Board with the following conditions: 1. 2.That separate water service for Lot 17B be provided. All property pins be set prior to Town Board approval. Commissioner Hix animously.seconded the motion and it passed un- 2.b. P.U.D. Planner Stamey presented the staff report. It was noted that when the concept plan was approved, a number of conditions were to be incorporated into the final plat and development plan. Items not addressed include: o o 25' setback from Peak View R-O-W line (15' proposed). Other items identified that needed clarification or addition included: o o o o o o Land Use. General note regarding one single family dwelling unit per lot. Open Space. Confirmation that ownership of the open space Outlet C has been transferred to the Prospect Mountain Homeowner's Association, and that all owners within the P.U.D have access rights across the U.S. Government strip and Outlet B to Outlet C. Parking. Adequate on-site parking is especially critical for lots 31 through 35. If one-car garages are used, setbacks should be increased to 20 feet. Cul-de-sac. Center island of Marcus Lane is required to be landscaped. Development Plan. Additions and modifications. Final Plat. Technical corrections and modifications. Construction Drawings. After discussion, four main items were identified that needed resolution; o o o Building setback from Peak View Drive. Landscaping along Peak View Drive. Configuration of emergency access from Darcy Drive. o Document confirming transfer of ownership of Outlot c to the Homeowner's Association, and guaranteeing access to Outlot C. Commissioner Hix moved that this final plat and development plan be favorably recommended to the Town Board with the following conditions: 1. Building setback from Peak View Drive and landscaping along Peak View Drive be negotiated with the Town Planner. 4. 5. At that time, covenants were _ recorded which permitted only one single-family dwelling per lot. These covenants expired in 1977. He further stated^ that the proposed zoning is compatible with the Comprehensive Plan and neighborhood land uses. Commissioner Hix moved that public hearing dates be set to consider rezoning of the aforementioned lot in Buenna Vista Terrace Subdivision as follows: Planning Commission - November 17, 1987 - 1:30 P.M.
