Copies of the proposed ordinance and a summary of the proposed changes were distributed. Planner Stamey read a summary of the proposed revisions. Following is a listing of topics: PRINCIPLES Three residential districts are proposed: o E - Estate (single-family) o R-S - Residential (single and two-family) o R-M - Residential (multi-family) GENERAL DEVELOPMENT RULES MOBILE HOME PARKS AND RV PARKS (17.32) OTHER MODIFICATIONS DEVELOPMENT EXAMPLE Planner Stamey noted correspondence received from the Estes Valley Improvement Association, League of Women Voters, Association for Responsible Development, Estes Park Board of Realtors and Rob Mitchell, Tiny Town Cottages. Stamey also referred to his memo of August 18, 1986 to Mayor Dannels, Trustees, Planning Commission and Dale Hill, wherein Stamey indicates that, since the zoning revision process began in April 1984, the Town has conducted ten public workshops/hearings. In addition, Stamey has met with the Estes Park Board of Realtors, EVIA, ARD, League of Women Voters and several interested individuals. Public testimony was heard from the following: Heinz Adam - Mr. Adam, residing at 1000 Pines, stated that landowners in this area are concerned about development of three acres, west of the senior apartments and, that the adjacent landowner(s) should have the right of appeal as well as the developer. Ray Lindsey - Mr. Lindsey referred to ARD's letter of August 14, 1986 addressing their concerns with regard to the proposed zoning ordinance. Harriet Kaye - Mrs. Kaye referred to the League of Women Voter's letter dated August 18, 1986, commending the Planning Commission and Town Staff for their diligence and effort in drafting this proposed zoning ordinance. Frank Williams - Mr. Williams voiced his concern regarding proposed setbacks and how this may relate to potential development of his properties. John Murphy - Mr. Murphy referred to the Estes Park Board of Realtors' letter dated August 18, 1986. There is concern with respect to private property rights and usage. Frank Normali - Mr, appeal procedures. Normali commented on notification and right of BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Planning Commission - August 18, 1986 - page two Lou Canaiy - Mr. Canaiy commented on appeal procedures. Frank Gray - Mr. Gray commended the Commission and Staff on a very excellent and consistent zoning ordinance. Mr. Gray noted several points for consideration: add and/or better define "bed and breakfast", "natural environment", "home occupations", and specific locations of trails/systems, views/view corridors. The word "consistent" should be defined. Mr. Gray also made the following suggestions: municipal use be permitted by Special Review in the E, R-S and R-M Districts; permit clubs and fraternal organizations in R-S and R-M by Special Review; Special Review for multi-family dwellings should not be required when surrounded by multi-family development; look at 12%-15% as breakpoint for slope penalty. Mr. Gray suggested that, after ordinance adoption, a Board of Technical Review be established to monitor the ordinance and report back to the Planning Commission regarding any needed modifications. Bill VanHorn - Mr. VanHorn suggested that stables be a permitted use. He discussed the proposals for slope adjustments; suggested that 18,000 sq. ft. was not a small enough lot; suggested the bonus for reducing off-site visibility be more than 10%; need to reduce 40,000 sq. ft. multi-family basic lot area requirement for areas that will probably redevelop. Rowland Retrum - Mr. Retrum addressed several areas of the ordinance and his concern regarding various Board reviews and methods of notification to adjacent landowners. He also expressed concern regarding right of appeal of adjacent landowners. Todd Plummer - Commented on permitted uses and slope formula. Seymour Graham - Commented on subdivision improvement guarantee also noted that the proposed zoning ordinance is difficult to follow. He Lew Wallace - Commented on RV setbacks from property lines. These setbacks should be a minimum of 75 feet. He agrees with the county rule of 250 feet from single-family residences. Tom Brown - Commented that with some changes and revisions, things should move ahead. Dave Habecker - Mr. Habecker discussed permitted uses and slope formula. Hearing no further comment from the public or the Commission, Chairman Sager declared public comment closed. Member Brown moved the public hearing reconvene at the August 19, 1986 regularly scheduled Planning Commission meeting. Member Hix seconded the motion and it passed unanimously. The Town Board will also conduct a public hearing on the proposed residential zoning ordinance on August 26, 1986. There being no further business, the meeting adjourned.
