Wood and John Carmack Chairman Sager, Members Blair, Hix, Wood, and Carmack Town Administrator Hill, Attorney White, Public Works Director Widmer, Planner Cole, Secretary Jensen, Russell Legg, Larimer County Planning Department The Planning Commission conducted two consultant interviews to consider who might be best qualified to give guidance in the preparation of a revised Zoning Ordinance. The consultants interviewed were Mr. Eric Kelly, Kelly, Potter & Barshov, P.C., and Mr. Philip Herr, Philip B. Herr & Associates. ERIC KELLY - KELLY, POTTER & BARSHOV, P.C.: Mr. Kelly stated that he is a planner, and an attorney licensed to practice law in Colorado. The Colorado office of his firm provides consulting services to local and state governments and private organizations in the land use control, land development and growth management fields. After a brief discussion of his qualifications and recent work history, Mr. Kelly outlined the proposed work program for Estes Park and stressed the importance of Town and community participation. Phase I: The issue and problem identification stage whereby the Town Board, Planning Commission, consultant and staff would examine the present ordinance and decide what technical and legal issues needed to be addressed, what they want to happen to the community, and how that affects the zoning ordinance. Phase II: The policy development stage would identify the issues which would be addressed in the revision. This would include two to three work sessions with the above mentioned people, as well as citizen participation. Mr. Kelly would take notes at the meetings and prepare policy statements, which would be handed out to the participants to be certain everyone was in agreement. They come out of this stage with information, legal concerns, etc. and they sit down and integrate the information into a final copy of the policy statements, which would be used in preparing the zoning revisions. Phase III: The ordinance revisions stage is the assembly of the policies adopted in the previous stage. From the information collected, they would draft an outline of the proposed ordinance revisions and submit it to the Town for review. They would then make revisions in the outline based on that review and draft a zoning ordinance around the outline. The new ordinance would be organized in such a way that future additions and deletions can be made without creating confusion. After the Town Board and others have had the draft for a reasonable length of time, Eric Kelly, as project manager, would meet with the Town to go over comments and questions. They would then prepare a final version of the ordinance and submit it to the Town in final form. Mr. Kelly would attend the public hearing. Total price for the proposal is $15,250.00. PHIL HERR, PHILIP B. HERR & ASSOCIATES; Mr. Phil Herr stated that he was the principal in a consulting firm which specializes in Town planning around growth and land use. He also teaches at the Massachusetts Institute of Technology in Boston. Mr. Herr gave a brief background of his qualifications and experience and then introduced Mr. Chuck Perry, an associate who lives in Denver who would be working with Mr. Herr. Mr. Herr stressed that they have worked hard over many years at learning how to take a technical document and bring it to a level where it belongs to the community rather than the person who wrote it. He stated that when the project belongs to the community, it will better fit the community needs. The following is a brief outline of Mr. Herr's process for revising the zoning ordinance; Initial Studies. Would include a diagnostic review of the existing zoning and related documents. During this period they would design an initial set of community workshops. First Workshops. Both residents and appropriate Town officials would be recruited for exercises exploring what the Zoning ordinance should provide but doesn't, and proce­ dures on how the system might perform. Through these workshops, a decision would be reached about the general approach to be taken with the zoning system, whether margin­ al modifications or a revoluntionary strategy aiming at a very different system. Research and Drafting. Following the first workshops, an initial draft would be prepared. Second Workshops and Revisions. A second workshop series would then be held to react to the draft proposals and to generate new proposals. Revisions would then be drafted, submitted, and revised again. Public Hearings. Public hearings would be held on the proposals, following which there would be a final series of revisions prior to action by the Board of Trustees. The price for this proposal is $15,400.00. PLANNING COMMISSION COMMENTS: Following the interviews and a lengthy discussion, the Planning Commission unanimously agreed the firm of Philip B. Herr & Associates would be the better choice for consultant to revise the Zoning Ordinance. There being no further business, the meeting adjourned. Ann E. Jensen, Secretary
