FIR RESUBDIVISION - BOUNDARY ADJUSTMENT: Mr. Todd Plummer of Van Horn Engineering, representing the contract purchaser, presented the plat of Fir Resubdivision boundary adjustment, ^Lots 1 and 2 Block 6, Country Club Manor Addition). Mr. Plummer state that the boundary adjustment would create no new parcels and would provide for more efficient land use that would be compatible surrounding neighborhood. Member George Hix moved that the Planning Commission find the following facts with respect to the petition: 1. That there are special circumstances or conditions affecting the property; 2 That the exception is necessary for the ppservation and the enjoyment of a substantial property right of the petitioners; o +-he aranting of the exception will be not be _ ^llrlTlly Telrllental to the public welfare or injuri­ ous to other property in the neighborhood^in which the orooertv of the petitioners is situated or in conriicr with the purposes and objectives of Title 16 of the Municipal Code; and that the boundary adjustment of Fir Resubdivision be favorably recommended to the Town Board subgeot to the following 1. The plat be titled "Fir Resubdivision" instead of "434 Fir Resubdivision". 2. Additional curve information is needed on the plat both curves. o The additional street right-of-way dedicated by the 3- cu?vS shoSld be identified on the plat as dedicated street right-of-way. The Fir Avenue right-of-way should be shown as 17.5 feet per the Country Club Manor Addition plat. 5. All property pins be set prior to Town Board approval. All existing monumentation should be identified. 6. An aerial utility easement should be provided across the northwest corner of the proposed resubdivision to accom­ modate existing power lines at that location. Trustee Richard A. Wood seconded the motion and it passed unanimously. TRACTS 83-87 AND TRACT 89 FALL RIVER ADDITION - BOUNDARY ADJUSTMENT; Mr. Todd Plummer, representing the owners of the property, appeared to request that the boundary adjustment for Tracts 83-87 and Tract 89 Fall River Addition be tabled. Mr. Plummer stated that some concerns expressed by the Town staff needed to be addressed with the property owners and the boundary adjustment would be resubmitted at a later date. Member Richard Wood moved that this boundary adjustment be^ tabled. Member George Hix seconded the motion and it passed unanimously. MOUNTAIN MAN SUBDIVISION - LOT SPLIT: Mr. Todd Plummer, representing the owners, presented the Mountain Man Subdivision lot split which proposes dividing a portion of the NE4 of the NE^ of Section 25, T5N, R73W lying between East Elkhorn Avenue and the Big Thompson River into two lots of .54 and 1.17 acres. Planning Commission recommended approval of this lot split (wi conditions) on May 19, 1981, but the plat never went to the Board of Trustees for final approval. The entire Mountain Man Complex be connected to this existing 2" service line. 2. The following language should be added to the plat as a note with regard to the public access easement. The language is as follows: "The public access easement as indicated on this plat is for the purpose of allowing access by the public to the north bank of the Big Thompson_River and, also, to allow pedestrian, horseback, and bicycle traffic along and across said designated public access easement. 3. The southern boundary of the public access easement shall be the edge of the river. 4 The lot split is in keeping with the Urban Renewal 4- Authority^Plan with regard to the public the mature landscaping shall be retained along the river edge within the public access easement area. Member George Hix seconded the motion and it passed unanimously. BRADFORD PUBLISHING CO.» DENVER RECORD OF PROCEEDINGS Planning Commission - August 16, 1983 - Page 4 REZONING - MOUNT VIEW PARK ADDITION - SET PUBLIC HEARING DATES: Member Duane Blair moved the public hearings on the proposed rezoning of Mount View Park Addition from R-2 Multiple Family Residential to R-Residential be scheduled as follows: Planning Commission - September 20, 1983 - 1:30 p.m. Board of Trustees - September 27, 1983 - 7:30 p.m. Member Margaret Houston seconded the motion and it passed unanimously. REZONING - MOCASSIN, CYTEWORTH AND RIVERSIDE - SET PUBLIC HEARING DATES: Member Richard A. Wood moved the public hearings on the proposed rezoning of Lots 1-11 and a portion of Lot 13 Mocassin Addition, Lots 1 and 2 Cyteworth Resubdivision, and Lots 21-25 Riverside Subdivision from R-2 Multiple Family Residential to R-1 Residential be scheduled as follows: Planning Commission - September 20, 1983 - 1:30 p.m. Board of Trustees - September 27, 1983 - 7:30 p.m. Member Margaret Houston seconded the motion and it passed unanimously. ESTES PARK COMPREHENSIVE PLAN AMENDMENTS AS ADOPTED BY LARIMER CTY.: In a letter dated August 4, 1983, Ms. Jill O'Gara, Larimer County Comprehensive Planner, reported that the Larimer County Planning Commission had amended the Estes Park Comprehensive Plan Amendment by omitting the paragraph titled "Affordable Housing" and had added several "clarifying phrases". A lengthy discussion followed on whether or not the Estes Park Planning Commission would be willing to accept the amendments. Member Margaret Houston moved the Planning Commission seek a legal opinion from Attorney Greg White on what the Town's legal position is if the Planning Commission chooses not to accept the amendments as submitted by the Larimer County Planning Commission. Member Steve Komito seconded the motion and it passed unanimously. DEVELOPER'S MANUAL FOR ESTES PARK: Ms. Connie Murphy, a Planning Intern working with Barbara Cole, stated that she will be preparing a manual to help developers, property owners, builders, and designers coming into Estes Park understand the development review process. The manual will consist of four parts: (1) Land Use Regulations; (2) Boards and Commissions in the Town; (3) Devices such as Certificate of Occupancy, Stop Orders, Etc.; and (4) the Development Review System. Ms. Murphy stated that this manual should be a valuable tool for Town staff and it will give an overview of the entire develop­ ment process. PLANNING COMMISSION BUDGET REQUESTS: The Planning Commission discussed the 1984 budget as submitted at last month's meeting. A discussion followed on the need to review and update the Zoning Chapter (Title 17) of the Municipal Code. Planner Cole asked the Commission to review Title 17 and let her know those areas they feel need to be revised. Chairman Sager stated that after the Planning Commission has reviewed Title 17, a work session would be scheduled. There being no further business, the meeting adjourned. Town ClerkAnn E. Jense
