Minutes of the May 18, 1982, Planning Commission meeting were
submitted and approved.
FALL RIVER ESTATES SECOND ADDITION, ANNEXATION - PUBLIC HEARING:
Chairman Al Sager conducted a public hearing on the Fall River
Second Addition which proposes annexing 95.6 acres between Fish
Hatchery Road, U. S. 34, the National Park, and the existing city
limits. Paul Kochevar, representing Estes Park Surveyors, appeared
before the Commission and spoke on behalf of the owners of the
proposed annexation. Those speaking in favor of the annexation,
none. Those speaking in opposition to the annexation, non®-

Chairman Sager declared the hearing closed. Member Richard A.
Wood moved that the annexation be favorably recommended to the
Board of Trustees with the following provisions;

Member George J. Hix moved that the Commission favorably recommend
to the Town Board of Trustees the following zoning:
Lots .1-4, Block 3 C-2 Commercial
Lots 1-4, Block 4 C-2 Commercial
Lots 1-3, Block 1 R-2 Residential
Lot 26, Block 1 R-2 Residential
Lot 35, Block 1 R-2 Residential
All remaining lots R- Residential
Member Margaret Houston seconded the motion and it passed unanimously.
BEAVER POINT SECOND ADDITION, ANNEXATION - PUBLIC HEARING:
Chairman A1 Sager conducted a public hearing regarding the annexation
of Beaver Point Second Addition. Richard Widmer, representing
the Town, spoke in favor of the annexation stating that of the^
20 parcels to be annexed, the Town had received all but five signed
petitions in favor of the annexation. Those speaking in favor
of the annexation, none. Those speaking in opposition, none.

Duane Blair seconded the motion and it passed unanimously.
E ESTATE ZONING DISTRICT - PUBLIC HEARINGS:
Member George J. Hix moved that the Planning Commission schedule
a public hearing on the proposed E Estate Zoning Ordinance for
July 20, 1982 and that the Town Board of Trustees schedule a public
hearing on the same proposal for July 27, 1982. Member Houston
seconded the motion and it passed unanimously.
ORDINANCE AMENDING IMPROVEMENT GUARANTEES IN SUBDIVISION REGULATIONS:
Member Margaret Houston moved that the ordinance amending Chapter
16 of the Municipal Code pertaining to improvement guarantees
in the subdivision regulations be favorably recommended to the
Board of Trustees. Member Wood seconded the motion and it passed
unanimously.
ORDINANCE AMENDING THE SUBDIVISION CODE:
Rich Widmer, Town Engineer/Planner, read and explained the proposed
ordinance amending chapter 16 of the Municipal Code pertaining
to subdivision regulations. A lengthy discussion followed. Member
George J. Hix recommended that the ordinance be favorably recommended,
as amended by the Planning Commission, to the Town Board of Trustees.
Member Wood seconded the motion and it passed unanimously.
LARIMER COUNTY REFERRALS:
Mr. David Habecker, representing the owners, presented a petition
for a variance to permit a front yard setback of 55 feet from the
centerline of the road, north side yard setback of 35 feet and
south side yard setback of 45 feet on Lot 22 Sanborn Acres Sub
division.
Member Duane Blair moved that the Commission favorably recommend
the variance request to the Larimer County Board of Adjustment.
There being no further business, the meeting adjourned.
