REZONING - PORTION GRAND ESTATES FROM R-1 TO R - PUBLIC HEARING: Chairman Sager conducted a public hearing on the proposed rezoning of Lots 3, 4, 5, 6, 7, 8, 12, 13, 14, 19, 20, 21, 23, 24, 25, 26, 27, 37, 38, 39, 40, 41,; 42, 43, 44, 45, 46, 47, 48, 49 and 50, Grand Estates Addn. from the existing R-1 Residential to R-Residentiai. Bill Van Horn, repre­ senting the petitioners, spoke in favor of the rezoning. Lou Canaiy and Giles Gere also spoke in favor of the rezoning. No persons appeared speaking in opposition. Johnson................................................March 12, 1982 A letter dated March 3, 1982 was read from Town Engineer/Planner Widmer. Chairman Sager declared the hearing closed. Member Margaret Houston moved the rezoning be favorably recommended to the Board of Trustees. Member Wood seconded the motion and it passed unanimously. REZONING - LOTS 1 & 2, LITTLE PROSPECT MOUNTAIN ADDITION - C-2 & R-1 to C-2: Chairman Sager conducted a public hearing on the proposed rezoning of Lots 1 and 2, Little Prospect Mountain Addition from C-2 Restricted com“ mercial and R-1 Residential to C-2 Restricted Commercial. Attorney Richard Ball and Bill Van Horn, representing the petitioners, spoke in favor ot the rezoning and explained that the present splitting of_the lots by two different zones has caused several legal and administrative problems. Mr. Ball also submitted a letter dated March 16, 1982 outlining some of the legal problems and stated that granting the rezoning with a 3U set back as recommended in the Town Engineer's letter would be agreeable to the petitioner. Franklin Burns, petitioner, and adjacent property owner Ira Brawer, also spoke in favor of the rezoning. Ron Brodie, John Ramey, and Bertha West who submitted a letter and petition and Margaret Noyes spoke in opposition to the rezoning request. March lo, lyoz A letter dated March 10, 1982 from Town Engineer/Planner Widmer was read along with a letter dated March 2, 1982 from Town Attorney White. Bertha West and John Ramey also spoke in rebuttal. Chairman Sager declared the hearing closed. Member Robert E. Burgess moved the rezoning request be denied. Member Blair seconded the motion and it passed by the following votes: Those voting "Yes" Members Blair, Burgess, Wood. Those voting "No" Members Houston and Sager. REZONING - PORTION BLOCK 10, TOWN OF ESTES PARK FROM R-2 TO C-1: Chairman Sager proceeded to conduct a public hearing on the proposed re­ zoning of a portion of Block 10, Town of Estes Park from R-2 Multiple Family Residential to C-1 Commercial. Elizabeth Olson, petitioner, spoke in favor of the rezoning and commented that she and her husband hoped to establish a restaurant with a liquor license which requires a commercial zone. Adjacent property owners Barry Myers and Phil Ramsey spoke in op­ position to the rezoning. Correspondence was received from Town Engineer/ Planner Widmer dated March 3, 1982 and from W. B. Hite dated March 5, 1982 who opposed the rezoning. Chairman Sager declared the hearing closed. Member Duane Blair moved the rezoning request be favorably recommended to the Board of Trustees. Member Houston seconded the motion and it passed unanimously. ANNEXATION & ZONING - FALL RIVER ESTATES FIRST ADDITION: Chairman Sager conducted a public hearing on the proposed annexation of Fall River Estates, First Addition and the proposed R-Residential zoning of Lots 41 through 43 and C-2 Restricted Commercial zoning of Lot 44. Paul Kochevar, representing the petioners, spoke in favor of the annexa­ tion. Giles Gere also appeared speaking in favor. February 8, 1982 Town Engineer/Planner. ................................... February 8, 1982 Member Margaret Houston moved the annexation be favorably recommended to the Board of Trustees. Member Blair seconded the motion and it passed unanimously. Chairman Sager continued the public hearing regarding the zoning of Fall River Estates, First Addition. Paul Kochevar and Ross Brown appeared^ speaking in favor of the requested zoning. No persons appeared speaking in opposition. A letter dated March 15, 1982 was received from Paul Kochevar. Chairman Sager declared the hearing closed. Member Duane Blair moved that the Planning Commission recommend to the Board of Trustees that Lots 41 through 43 be zoned R-Residential and that Lot 44 be_zoned C-2 Restricted Commercial. Member Wood seconded the motion and it passed unanimously. REGAL PINES - LOT SPLIT/BOUNDARY ADJUSTMENT - LOTS 1 & 8, MAJESTIC PINES: Bill Van Horn, representing the owners, presented the plat of Regal Pines which proposes dividing Lot 8 of Majestic Pines into two parcels and ad­ justing the boundary between Lots 1 & 8 of Majestic Pines.
