REZONING - LOTS 1 AND 2, LITTLE PROSPECT MOUNTAIN ADDITION: Member George J. Hix moved the public hearings for the request submitted by Franklin L. Burns to rezone portions of Lots 1 and 2, Little Prospect Mountain Addition from C-2 & R-1 to C-2 be scheduled as follows: Estes Park Planning Commission . . . March 16, 1982 Board of Trustees........................................March 23, 1982 Member Burgess seconded the motion and it passed unanimously. REZONING - PORTION GRAND ESTATES FROM R-1 TO R - SET PUBLIC HEARING: Member George J. Hix moved the public hearings for the request to rezone Lots 3, 4, 5, 6, 7, 8, 12, 13, 14, 19, 20, 21, 23, 24, 25, 26, 27, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49 and 50, Grand Estates Addition from R-1 to R be scheduled as follows: Estes Park Planning Commission . . .March 16, 1982 Board of Trustees........................................March 23, 1982 Member Wood seconded the motion and it passed unanimously. REZONING - PORTION BLOCK 10, TOWN OF ESTES PARK FROM R-2 TO C-1: Member Margaret Houston moved the public hearings for the request sub­ mitted by Aldon and Elizabeth Olson to rezone a portion of Block 10, Town of Estes Park from R-2 Multiple Family Residential to C-1 Commercial be scheduled as follows: Estes Park Planning Commission . . . March 16, 1982 Board of Trustees........................................March 23, 1982 Member Wood seconded the motion and it passed unanimously. ANNEXATION - FALL RIVER ESTATES FIRST ADDITION: Paul Kochevar presented the first of two filings of the Fall River Estates Addition which proposes annexing four lots and the right-of- way of U.S. 34. Letters regarding the proposed annexation were received from the following: Light & Power Director..........................January 29, 1982 Rocky Mountain National Park Supt. . February 1, 1982 Town Attorney................................................February 3, 1982 State Highway Department ...................... February 8, 1982 Town Engineer/Planner...............................February 8, 1982 Mr. Kochevar commented that the river and floodway would be shown across Outlot A and Lot 44 as requested in the Town Engineer/Planner's BRADFORD PUBLISHING CO.» DENVER RECORD OF PROCEEDINGS Planning Commission - February 16, 1982 - Page 2 letter and that the lots proposed in the second filing that are less than the minimum lot size will have the lot lines rearranged where possible. Member Robert E. Burgess moved that a public hearing to consider the annexation and zoning of Fall River Estates First Addition be scheduled for March 16, 1982. Member Wood seconded the motion and it passed unanimously. SPECIAL REVIEW REQUEST #32 - MASSAGE PARLOR @ 405 W. ELKHORN AVE.; Chairman Sager conducted a public hearing on Special Review Request #32 submitted by Patricia De Fries and Adel Parker to operate a holistic health center (massage parlor) at 405 West Elkhorn Avenue. Adel Parker spoke in favor of the request and sxabmitted the following letters also in favor of the health center: Gene Hanson & Nan Smith dba West Park Pharmacy Joan Cook dba Thoughts 'N Things .......................... Mark and Connie Sheagley dba Montgomery Wards. Margaret Hope dba Bob Hope's TV............................... Audrey Knutson dba Audrey's Nutrition Center . No date . 2/16/82 . 2/16/82 No one appeared speaking in opposition. A letter dated January 4, 1982 from the Town Engineer/Planner was read. Chairman Sager declared the hearing closed. Member Margaret Houston moved that Special Review Request #32 be favorably recommended to the Board of Trustees. Member Wood seconded the motion and it passed unanimously. SPECIAL REVIEW REQUEST #34 - CONDOMINIUMS - TRACT 59, FALL RIVER ADD.: Chairman Sager conducted a public hearing on Special Review Request #34 submitted by Nicky Kane to construct eight condominium units on "Parcel A" of Tract 59, Fall River Addition. David Habecker, designer of the condominiums, and Paul Kochevar spoke in favor of the request and described the project in greater detail. No persons appeared speaking in opposition. A letter dated February 11, 1982 from Town Engineer/Planner Widmer was read. Chairman Sager declared the hearing closed. Member George J. Hix moved that Special Review Request #34 be favorably recommended to the Board of Trustees subject to the following conditions: 1. The completion dates for the improvements be shown on the site plan. 2. The owner's agreement on the site plan be signed prior to Town Board approval. 3. The existing culvert and any new culverts be shown on the site plan as well as the routing of water through the development. Member Meusel seconded the motion and it passed unanimously. DISCUSSION - SPECIAL REVIEW PROCEDURE FOR MULTIPLE FAMILY DEVELOPMENT: Correspondence regarding placing multiple family development under the special review process was received and read from the following: Estes Park Board of Realtors . . . 2/01/82 & 2/15/82 Estes Park Accommodations Assoc. . 2/08/82 Estes Park Political Action Comm.. 2/02/82 Forward Estes Park Foundation, Inc.2/12/82 Ira Brawer, President of Estes Park Board of Realtors, requested that minimiim standards be adopted under R-2 zoning for multiple family development with regard to parking, access, fire protection and drainage rather than subjecting such development to the special review process. Lee Hartland, owner of Miles Cottages, commented that additional regulations for building in Estes Park are not necessary and expressed concern about public input which may be based entirely BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS Planning Commission - February 16, 1982 - Page 3 on emotions. Ed Peterson, owner of Trout Haven, discussed the need to establish guidelines so that developers have something to follow rather subjecting condominium development to public input which may not be objective. Town Engineer/ Planner Widmer explained that it is difficult to adopt standards which cover all aspects yet allow flexibility. He also felt that review of multiple family projects should be by appointed and elected officials rather than just by staff. Louise Korman of Rocky Mountain Realty asked several questions regarding the special review procedure and the effects of public input. Tom Brown expressed an opinion that he would rather have the Planning Commission and Town Board review a proposal than just the staff and requested property which recently went through the subdivision procedure not be subject to the special review requirements. Jo Schroeder commented that she thought that members of the Planning Commission and Town Board would want guidelines on which to base their decisions. David Habecker expressed his desire to work with guidelines and the staff in order to save time. Member Margaret Houston moved the matter be tabled for further consideration. Member Burgess seconded the motion and it passed unanimously. Town Engineer/ Planner Widmer said he would work on an outline for a proposed special review procedure and Mr. Brawer said he would be happy to work with Rich on it. AMERICAN PLANNING ASSOCIATION: Member Richard Wood moved the Planning Commission continue its member­ ship with the American Planning Association. Member Hix seconded the motion and it passed unanimously. Member George J. Hix then moved that the Town Engineer/Planner attend the annual APA conference in Dallas May 8th - 12th. Member Wood seconded the motion and it passed unanimously. LARIMER COUNTY REFERRALS: MEADOWDALE RANCH - RELIGIOUS RETREAT - Arthur Goodrich presented the special review request submitted by Rocky Mountain Baptist Conference to operate a religious retreat on a portion of the Meadowdale Ranch property. Existing buildings will be refurbished and expanded to accommodate 207 people attending youth and family retreats and camps. Mr. Tom Brown appeared speaking in favor of the special review request. Member Margaret Houston moved the special review request be favorably recommended to the Larimer County Planning Commission. Member Hix seconded the motion and it passed unanimously. LICKFETT SETBACK VARIANCE - A request was submitted by Donald H. Lickfett for a 20' setback rather than the required 50' setback for a residence to be located on Lot 13, 2nd Filing, Little Valley Subdivision. Due to the topography, the adjacent lot would not be adversely affected by the reduced setback. Member Richard Wood moved the setback variance be favorably recommended to the Larimer County Board of Adjustment. Member Meusel seconded the motion and it passed unanimously.
