BRADFORD PUBLISHING CO.t DENVER RECORD OF PROCEEDINGS Planning Commission - October 16, 1979 - Page Two (2) BOUNDARY ADJUSTMENT - SALLEE SUBTRACT A& LOT 31, ELKHORNCLUB ESTATES : Bill Karr of Estes Park Surveyors presented the Sallee Subdivision which is a boundary line adjustment of Tract A and Lot 31 of Elkhorn Club Estates. The proposed boundary adjustment seeks to resolve an encroach­ ment problem of the house on Tract A onto Lot 31 and still maintain the lot area and nonconforming status of Lot 31, Letters regarding Sallee Subdivision were received from the following: Light & Power Director Town Engineer/Planner i October 1, 1979 October 5, 1979 Member Byron L. Graves moved the boundary adjustment be favorably recommended to the Board of Trustees and that the Planning Commission finds that the granting of the exception will not be materially detri­ mental to the public welfare or injurious to other property in the neighborhood in which the property of the petitioners is situated or in conflict with the purposes and objectives of Title 16 of the Muni­ cipal Code. Member Rumley seconded the motion and upon roll call the motion unanimously carried. BOUNDARY ADJUSTMENT - LOT 8 & PORTION OF LOT 5, WHITE MEADOW VIEW PLACE: Bill Van Horn, representing the owners, requested the proposed boundary adjustment of Lot 8 and a portion of Lot 5, White Meadow View Place be withdrawn. He then requested the Planning Commission consider amending the Municipal Code to allow boundary line adjustments to occur without the lots losing their nonconformity status. Bill Van Horn explained that there are several lot line and road right-of-way inconsistencies which could be straightened out through boundary adjustments but the loss of the nonconforming status of the lots will be a disincentive to property owners to resolve these situations. The Planning Commission accepted withdrawal of the proposed boundary adjustment of Lot 8 and a Portion of Lot 5, White Meadow View Place. LARIMER COUNTY REFERRALS: AMENDED PLAT OF UPLANDS AT FISH CREEK P.U.D. - The Planning Commission reviewed the amended plat of Uplands at Fish Creek P.U.D. which proposes converting 22* acres of greenbelt into a single lot. A letter dated October 16, 1979 from the Town Engineer/Planner was read which states that the newly created lot will need a private pumping station if it is to be served from city water. Member Byron L. Graves moved the amended plat be favorably recommended to the Larimer County Planning Commission subject to an easement being provided for the existing power line. Member Blair seconded the motion and upon roll call the motion unanimously carried. 1 HATTAN VARIANCE REQUEST - Ellis Hattan submitted a request to allow expansion of a single family dwelling located on the Nj of Lot 23, Greeley-Boulder Colony Subdivision which is zoned T-Tourist. Member Duane Blair moved a favorable recommendation be forwarded to the Larimer County Board of Adjustment to allow an expansion of this non- conforming use as proposed. Member Houston seconded the motion and upon roll call the motion unanimously carried. There being no further business, the meeting adjourned,. Van Horn, Secretary
