The minutes of the August 21, 1979 Planning Commission meeting were sub
mitted and approved.
Chairman Sager officially welcomed George Hix as a new member of the
Planning Commission.
ROMER ADDITION - SET PUBLIC HEARINGS REGARDING ZONING:
Member James H. Swickard moved the following scheduled

Bill Van Horn explained that the topography limits the alternatives and
that the proposed plan sought to maximize compatibility with the adja
cent residential area.
Member James H. Swickard moved the preliminary plat of East Park Sub
division be denied. Member Blair seconded the motion and upon roll
call the motion passed by the following votes: Those Hi
Members Swickard, Blair, Rumley, Sager. Those voting No Members Hix,
Graves, Houston.
LOT SPLIT - DEER CREST SUBDIVISION (PORTION TRACT 58, FALL RIVER ADDITION),
Bill Van Horn, representing the Rohrbaughs presented the Deer Crest
Subdivision which proposes to divide a Portion of Tract
Addition into two parcels of 1.40 acres and 14 79 acres. Letters r

acceptance of the division by the Board of Trustees, and that the Planning
Commission finds the following facts with respect to the request:
1. That there are special circumstances or conditions affecting
the property;
2. That the exception is necessary for the preservation and the
enjoyment of a substantial property right of the petitioners;
3. That the granting of the exception will not be materially
detrimental to the public welfare or injurious to other property in
the neighborhood in which the property of the petitioners is situated
or in conflict with the purposes and objectives of Title 16 of the
Municipal Code.
Member Graves seconded the motion and upon roll call the motion unani
mously carried.
