ORDINANCE DEFINING "STRUCTURE", "BUILDING":, "SETBACKS", WALL TYPES: A revised ordinance proposing definitions of "Structure", "Building", "Setbacks", "Nonbearing Walls", and "Retaining Walls" was reviewed by the Planning Commission. Member Duane Blair moved public hearings be scheduled on the proposed ordinance as follows: Planning Commission .... October 31, 1978 Board of Trustees..................November 14, 1978 Member Houston seconded the motion and upon roll call the motion unanimously carried. VENNER ADDITION: Member Duane Blair moved a public hearing be held October 31, 1978^ on the proposed Venner Addition. Member Swickard seconded the motion. Upon roll call the motion unanimously carried. VENNER SUBDIVISION - FINAL PLAT AND VACATE OF PORTION OF FIR STREET: Tom Brown, representing Mr. and Mrs. Robert Venner, presented the final plat of the Venner Subdivision. Letters were received from the Town Engineer/Planner dated September 15, 1978 and the Town Attorney dated September 18, 1978. Member James H. Swickard moved the final plat of the Venner Subdivision be favorably recommended to the Board of Trustees with the following conditions: 1. That the Attorney's Certificate be removed from the plat and filed with the Town by separate document. 2. That the portion of Fir Street along Venner Subdivision be vacated. Member Rumley seconded the motion. Upon roll call the motion unani­ mously carried. Member Jack T. Rumley moved that the Planning Commission recommend to the Board of Trustees that the vacation of a portion of Fir Street along the east boundary of the Venner Addition be pursued. Member Graves seconded the motion and upon roll call the motion unanimously carried. REZONING - RENNER - LOT 4, SOUTH SAINT VRAIN ADD. FROM R-2 TO C-2: Chairman Sager conducted a public hearing on the proposed rezoning of Lot 4, South Saint Vrain Addition from theiexisting R-2 Multiple Family Residential to C-2 Restricted Commercial. !Petitioner Ed Renner spoke in favor of the rezoning and submitted a petition of signatures sup­ porting the rezoning. Maurice Abel and Fran Fieg, representing the Fairway Club Association Board of Directors, spoke in opposition. Correspondence in opposition was received from Fairway Club Homeowner's RECORD OF PROCEEDINGS Planning Commission - September 19, 1978 - Page Two (2) Association dated August 21, 1978 and September 16, 1978 and from Maurice Abel dated September 17, 1978. A letter from the Town Engineer Planner dated September 15, 1978 was also read. Chairman Sager declared the hearing closed. Member James H. Member Duane denial to the Larimer Stewart for a 9' setback variance for an addition to his residence located on High Drive. Member Duane Blair moved the variance request be favorably recommended to the Larimer County Board of Adjustment. Member Houston seconded the motion and upon roll call the motion unanimously carried. JO ANN JONES - SPECIAL EXCEPTION & SETBACK VARIANCE: Jo Ann Jones submitted a request to allow a single family residence on her pro­ perty which is located in the Fish Hatchery area west of Estes Park and which is zoned T-Tourist. If granted, she also requested that the residence be allowed a 15' setback from the adjacent private road rather than the required 50'. Member Duane Balir moved the request to allow a single family dwelling in the T-Tourist zone be favorably recommended to the Larimer County Board of Adjustment._ Member Rumley seconded the motion and upon roll call the motion unanimously carried. Member Blair then moved the setback variance request also be favorably recommended to the Larimer County Board of Adjustment. Member Rumley seconed the motion and it unanimously carried. MELVIN LUND - SETBACK VARIANCE: Melvin G. Lund, Jr. requested an 84' setback from Highway 36 for a new car wash to be located at Mel s Pixie Garage rather than the required 100' Blair moved the request be recommended for ---------- County Board of Adjustment. DAVIS - SETBACK VARIANCE: Edwin Davis appeared explaining_the cir­ cumstances concerning his request for a 50' setback from High Drive for an addition to an existing building Which he proposes to_convert to a liquor store. Member James H. Swickard moved the variance request be favorably recommended to the Larimer County Board of Adjustment. Member Hix seconded the motion and upon roll call the motion unanimously carried. YOUNGLUND - SETBACK VARIANCE: Quentin Younglund_submitted a request for a 15' rear yard setback rather than the required 25| for a new residence to be located on Lot 44, Block 12, Carriage Hills 4th Filing. The house is being located towards the back of the lot in order to avoid a 15' sewer easement and a swampy area adjacent to Fish Creek. Member Duane Blair moved the setback variance request be favorably re­ commended to the Larimer County Board of Adjustment. Member Houston seconded the motion and upon roll call the motion unanimously carried. WEHR & WRIGHT - SETBACK VARIANCE: Attorney Joseph P. Jenkins appeared on behalf of petitioners Emma Wehr and Shirley Wright for a setback^ variance of 21.2 feet from the center of Longview Drive rather thane, the required 75' for a residence located on Lot 40, Black 8, Carriage Hills 4th Filing. Member Swickard moved the variance request be favorably recommended to the Larimer County Board of Adjustment. ^ Member Blair seconded the motion. Upon roll call the motion unanimously carried. REZONING - ELKHORN CLUB ESTATES - R-1 to R - SET PUBLIC HEARINGS: Member Duane Blair moved the following public hearings be scheduled for a rezoning request for Elkhorn Club Estates: Planning Commission Board of Trustees . . October 31, 1978 . November 14, 1978 BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS Planning Coiranission - September 19, 1978 - Page Four (4) Member Hix seconded the motion and upon roll call the motion unanimously carried.
