LOT SPLIT - SCHROEDER - LOTS 9, 10, 11, GRAND ESTATES: At the request of the petitioner, consideration of the Schroeder lot split of lots 9, 10, 11, Grand Estates was tabled until the next Planning Commission meeting. REZONING - STEINMEYER - TRACTS 22 & 23, FALL RIVER ADDITION - PUBLIC HEARING: Chairman Petrocine proceeded to conduct a public hearing on the pro­ posed rezoning of Tracts 22 and 23 of Fall River Addition from the existing R-Residential to R-1 Residential. Joan Banker, representing property owner Cleone Steinmeyer, spoke in favor of the request and stated that the land is proposed for a church. Ben Trout, representing Seventh Day Adventist Church, also spoke in favor of the rezoning. There were no persons present speaking in opposition. Town Administra­ tor Hill read aloud a letter dated October 31, 1977 from M. M. Kidder stating "no objections to rezoning for a church". Chairman Petrocine declared the hearing closed. Member Sager moved the rezoning be favora­ bly recommended to the Board of Trustees. Member Graves seconded the motion and upon roll call the motion unanimously carried. STATHAM - SPECIAL REVIEW REQUEST #14 - PUBLIC HEARING: The Chairman conducted a public hearing on Richard N. Statham's special review request to construct and operate a self storage warehouse on Lot 3, Block 4, Lone Pines First Addition which is zoned C-1 Commercial. Dick Statham appeared speaking in favor of the request. There were no persons present speaking in opposition to the request. Mr. Statham submitted a favorable letter dated November 7, 1977 from adjacent pro­ perty owners Don and Rutheda Rogers. Chairman Petrocine declared the hearing closed. Member Graves moved that Special Review Request #1.4. be favorably recommended to the Board of Trustees. Member Sutter seconded the motion. Upon roll call the motion unanimously carried. DEER RIDGE ESTATES - PRELIMINARY PLAT: Tom Brown and Glenn Larson, representing Everitt Enterprises, submitted the preliminary plat of Deer Ridge Estates Addition and "Tract B" Elkhorn Club Estates Addition. The preliminary plat proposes 41 lots for eventual annexation to the Town of Estes Park with R—1 Residential zoning. Correspondence regarding the proposed subdivision was sub­ mitted by the following: Town Attorney Light & Power Director Water Superintendent State Department of Highways Estes Park Sanitation District Mountain Bell Town Engineer/Planner 10/31/77 10/28/77 11/08/77 & 11/15/77 11/07/77 11/09/77 10/31/77 11/15/77 BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS Planning Commission November 15, 1977 Page Two (2) A petition for exceptions dated November 14, 1977 was also submitted requesting the following: 1. 200 feet of Longview Court be allowed a grade of 12% and that the three street intersections be allowed grades up to but not to exceed 7% for a distance of 50 feet from the inter­ section. (Exception to Section 16.16.080 of the Municipal Code). 2. 50 foot radius cul-de-sacs with an outside paving radius of 40 foot be allowed. (Exception to Section 16.16.060 of the Municipal Code). 3. A minimum radius of 60 feet be allowed for two curves. (Exception to Section 16.16.090 of the Municipal Code). Giles Gere commented on the proposed density of the subdivison and stated that the subdivision was within the Upper Thompson Sanitation District. Neil Rosener commented on the merits of the subdivision. Member Graves moved the preliminary plat be approved subject to the following conditions: 1. An R-1 Residential zoning be proposed upon annexation. 2. That adequate fire prbteciton be provided the area served by the pumped water system, i.e. providing sufficient storage to meet the minimum Underwriter's Standards of 500 gallon/ minute at the hydrant. Also, all fire hydrant locations be shown on the plat. 3. Adequate sewer service be provided and assured by one of the sanitation districts. 4. Storm drainage easements be provided in those ravines that carry run-off. 5. A provision lor drainage be shown at the south end of Long View Court. 6. Street names be reviewed by the addressing committee to check for conflicts. 7. Provision for the trail easement of record be shown. 8. Verification of road dedication through Tracts "A" and "B of Elkhorn Club Estates be provided. 9. A reservation for future road dedication through the westerly portion of Lot 10 be made so that an interconne^tloJ, the land to the east can be made if necessary when that land develops. Member Sutter seconded the motion. Upon roll call the motio5 by the following votes: Those voting "Yes" Members Graves, Sutter, Wagner, Sager. Those voting "No" Member Petrocine. BRADFORD PUBLISHING CO.» DENVER RECORD OF PROCEEDINGS Planning Commission November 15, 1977 Page Three (3) Town Attorney Water Superintendent Town Engineer/Planner Light & Power Director 10/31/77 11/08/77 10/25/77 10/24/77 The petitioner agreed to provide a 10' utility easement along the dividing line between Tracts "4" and "5" according to the Light & Power Director's letter. Member Sutter moved the land division be favorably recommended to the Board of Trustees and that the Planning Commission finds the following facts with respect to the request; 1) That there are special circumstances or conditions affecting the property; 2) That the exception is necessary for the preservation and the enjoyment of a substantial property right of the petitioner; 3) That the granting of the exception will not be materially detrimental to the public welfare or injurious to other property in the neighborhood in which the property of the petitioner is situated or in conflict with the purposes and objectives of Title 16 of the Municipal Code. Member Wagner seconded the motion and upon roll call the motion unani­ mously carried. LARIMER COUNTY - EXEMPTION REQUESTS - LITTLE VALLEY & DOLLAR LAKE AREAS : The Planning Commission reviewed four exemption requests referred by the Larimer County Planning Department as follows; 1. Exemption submitted by M. V. May located south of Fish Creek and NW of Dollar Lake. Proposes dividing 36 acres into five tracts ranging in size from 4 acres to 9.5 acres. 2. Exemption submitted by John Montgomery located in the Dollar Lake area. Proposes dividing 40 acres into 4 tracts ranging in size from 7 acres to 14 acres. 3. Exemption submitted by T. P. Kiely’located just north of Little Valley Subdivision along the Little Valley Road. Proposes dividing 40 acres into 4 tracts ranging in size from 7.6 acres to 12.6 acres. 4. Exemption submitted by L. L. Rowe located on the Little Valley Road between Little Valley Subdivision and Fish Creek Road. Proposes dividing 40 acres into 4 tracts ranging in size from 5.5 acres to 19.5 acres. Member Sager moved the Larimer County Commissioners be advised that (1) the Estes Park Planning Commission finds no ady®^s® ° the Town as a result of these exemption requests, (2) any further divisions of the above tracts be required to follow subdivision Py° cedures, and (3) the County Commissioners study their exemption p cedures and formulate appropriate guidelines. SUBDIVISION VIOLATION - FAIRWAY CONDOMINIUMS: Town Engineer / Planner Van Horn reported on a subdivision violation of the Fairway Club Condominiums in which ^®Is a1Iib-d and deeded to various condominium owners. Thl® y°5st:Lliie®natives division but does not meet subdivision requirements. . at this point appear to be either do away with the subdividing that has occurred or make it conform with subdivision requirements.
