LOT SPLIT - BOOTH - LOTS 3 &; 4, ELKHORN ESTATES: George Booth submitted a petition to divide lots 3 and 4.of Elkhorn Estates into two parts each (making a total of four lots) or, as an alternative, dividing portions of lots 3 and 4 to make one additional lot. Lettersregarding the land division were received from the fol­ lowing: Light & Power Director 10/05/77 Water Superintendent 9/27/77 Town Engineer/ Planner 10/18/77 Member Graves moved the lot split be favorably recommended to the Board of Trustees subject to (1) the proposed lots 4b and 3b being combined into only one lot, and (2) the balance of the subdivision (excluding the Lodge property) being held in one ownership and no sales taking place until such time the present Elkhorn Estates is resubdivided and the platted road is relocated or until the required improvements are completed; also that the Planning Commission finds the following facts with respect to the request: (1) That there are special circumstances or conditions affecting the property; (2) That the exception is necessary for the preservation and the enjoyment of a substantial property right of the petitioner; (3) That the granting of the exception will not be materially detrimental to the public welfare or injurious to other property in the neighborhood in which the property of the petitioner is situated or in conflict with the purposes and objectives of Title 16 of the Municipal Code. Member Blair seconded the motion, carried. Upon roll call the motion unanimously REZONING - PORTION OF BLOCK 10, TOWN OF ESTES PARK - PUBLIC HEARING: Vice Chairman Wagner proceeded to conduct a public hearing on the pro­ posed rezoning of a portion of Block 10, Town of Estes Park from R-2 Multiple Family Residential to C-1 Commercial. Greig Steiner spoke in favor of the rezoning. There were no persons present speaking in opposi­ tion and no correspondence was received regarding the request. Vice Chairman Wagner declared the hearing closed. Member Rollen Sutter moved the rezoning be favorably recommended to the Board of Trustees. Member Sager seconded the motion. Upon roll call the motion unani­ mously carried. LOT SPLIT - SLATER - LOTS 1, 2 & 3, BLOCK 4, COUNTRY CLUB MANOR: Benjamin Slater submitted a petition requesting a division of Lot 2, Block 4, Country Club Manor into two portions which would be added to the adjoining lots 1 and 3. Existing lots 1, 2, and 3 would then become only two lots as a result of this division. A letter dated BRADFORD PUBLISHING CO., DENVER RECORD OF PROCEEDINGS Planning Commission October 18, 1977 Page Two (2) October 18, 1977 recommending the division was received from the Town Engineer/Planner. Member Sutter moved the land division be favorably recommended to the Board of Trustees and that the Planning Commission finds the following facts with respect to the request: (1) That there are special circumstances or conditions affecting the property; (2) That the exception is necessary for the preservation and the enjoyment of a substantial property right of the petitioner; (3) That the granting of the exception will not be materially detrimental to the public welfare or injurious to other property in the.neighborhood in which the property of the petitioner is situated or in conflict with the purposes and objective of Title 16 of the Municipal Code. Member Blair seconded the motion and upon roll call the motion unani­ mously carried. REZONING - STEINMEYER - LOTS 22 fc 23, FALL RIVER ADDITION: Member Sager moved a public hearing on the rezoning request submitted by Cleone Steinmeyer for Lots 22 and 23 of Fall River Addition be set for November 15, 1977. Member Sutter seconded the motion and upon roll call the motion unanimously carried. LOT SPLIT - SCHROEDER - LOTS 9, 10, 11, GRAND ESTATES: Attorney George Hass appeared representing Harry Schroeder in his request to rearrange the existing boundaries of lots 9, 10, and 11 o Grand Estates to create one lot each for the restaurant and motel, and one vacant lot. As brought out in the Water Superintendent’s tetter of August 8, 1977 and in past discussion of the lot split Ha2^tmCJ^«i-iWatHr+?1StriJUtion main sizing would be necessary.
