Member Robert E. Wagner moved the lot division into two parcels ("A" and "B +C" as shown on the plat) be recommended to the Board of Trustees subject to the provision of a 10' utility easement adjacent to and parallel to the north boundary lines, and that the Planning Commission finds the fol­ lowing facts with respect to the request: 1) That there are special circiimstances or conditions affecting the property; 2) That the exception is necessary for the preservation and the enjoyment of a substantial property right of the petitioner; 3) That the granting of the exception will not be materially detrimental to the public welfare or injurious to other property in the neighborhood in which the property of the petitioner is situated or in conflict with the purposes and objectives of Title 16 of the Municipal Code. Member Sutter seconded the motion. Upon roll call the motion passed by the following votes: Those voting "Yes" Members Byron L. Graves, Rollen Sutter, Robert E. Wagner, A1 Sager, N. T. Petrocine. Those voting "No" Member Duane Blair. & REZONING - FERGUSON SUBDIVISION: The Larimer County Planning Commission referred to the Estes Park Plan- BlSIk?!1111?31?11 R0rvit« c°nsideration a rezoning request to change T Touri1' 10’ 11 & 12 of Ferguson Subdivision fromi-Tourist and A-Accommodations to E-1 Estate. Mr. Lewis Wallace ueti- Jpp®ared supporting the request. MASSAGE PARLOR ORDINANCE: Member Duane Blair moved a public hearing be set for the Planning Com- myfS10n mee?:in^ of May 17th to consider a proposed ordinance regarding massage parlors.
