Chairman Pauley called the meeting to order at 8:30 A.M.
MINUTES;
Minutes of the February 21, 1991 meeting were approved as
submitted.
LIAISON: The Town/EPURA regular monthly meeting is scheduled for
the second Thursday of each month at 8:00 A.M.
AUTHORITY BUSINESS:
iResolution No. 158 - Intent to Accmire Property - Director Anderson
informed the Board that EPURA's counsel will review the proposed
purchase contract from United Bank. Financial arrangements are in
process, although EPURA's property purchase is contingent upon the
developer's purchase of Lot 2, Stanley Knoll Subdivision.
Commissioner Godbolt introduced, and Director Anderson read.
Resolution No. 158 (EPURA Declaring an Intent to Acquire Real
Property Consisting of Lots 1 and 3, Stanley Knoll Subdivision in
the Downtown Redevelopment Area and Authorizing Staff of the
Authority to Initiate Negotiations and Proceedings for such
‘ F°llowing a recommendation by Commissioner Klaphake
that the Resolution be amended to include Item 4. "This Resolution
IS contingent upon the developer's purchase of Lot 2, Stanley Knoll
Subdivision", Commissioner Ericson seconded the motion and it
passed unanimously.
L?iver Corridor RiP RaP Repair - Director Anderson referred
to staff s memo of March 7, 1991, wherein staff analysis of the rip
rap failure indicates the Authority did not receive the
o2ipf2Veinents to the B;^g Thompson River that were to be constructed. Staff recommends the following:
^ 4-v. 1)-o. Notify Aetna Insurance and U.S.A. Construction that the Authority is seeking bids to repair the rip rap.
2) Request a one (1) year extension of warranty from Aetna
Insurance on rip rap construction along the Big Thompson River
because ice conditions do not permit the Authority to evaluate the
rest of the river.
. 3) Solicit request for proposals to repair the rip rap with
information copies to Aetna and U.S.A. Construction (U.S A
Construction will not be allowed to bid).
4) Award contract for repair with information copies of bid
documents to Aetna Insurance and U.S.A. Construction.
5) Proceed with rip rap and river pool reconstruction.
6) Request payment from U.S.A. Construction and Aetna
Insurance for all costs. This request will coincide with award of
the construction contract.

then file suit against U.S.A. and Aetna for costs, damages, and

legal fees.
It was moved and seconded (Pohl-Klaphake) staff be authorized to
proceed with the Big Thompson River rip rap repair as outlined
above. Motion carried.
It was moved and seconded (Godbolt-Pohl) staff be authorized to
hire a surveyor to perform cross-section profiles of potentially
effected areas of the project at a not-to-exceed cost of $1,000.00.
Motion carried.
Time Commitment - Special Proiects Manager - Bob Joseph, Town
Special Projects Manager will require 40 hours to complete the West
Elkhorn Parking Lot specifications and drawings. Site observation
will be approximately 100 hours during construction. Billing to
EPURA will be on actual hours worked. Depending upon prevailing
local weather conditions, construction is expected to begin the
first of April with an anticipated early-mid June completion. It
was moved and seconded (Pohl—Ericson) EPURA hire Bob Joseph/Town
Special Projects Manager for the West Elkhorn Parking Lot project
at a not-to-exceed cost of $3,329.00. Those voting Yes:
Commissioners Ericson, Godbolt, Pohl. Those voting No: None.
Those Abstaining: Commissioner Klaphake. Motion carried.
Financial Report - January 1991 Recap - The January 1991
Treasurer's Report was submitted to the Board. Commissioner Pohl
recommended the report not be accepted into the record until the
Treasurer has had an opportunity to review said report. The
January 1991 and February 1991 Treasurer's Reports will be reviewed
by the Board at the March 21, 1991 meeting.
STAFF:
Director Anderson met with the Larimer County assessor regarding
the approximate $60,000 decline in EPURA's 1990 property tax
increment. This reduction will effect the Town/EPURA
Intergovernmental Agreement, as well as available EPURA project
funds.
The Phares memorial sculpture, a bronze eagle entitled Winged
Rapture is completed and will be installed at the earliest possible
date. Mrs. Phares has requested a May 1991 dedication, at which
time the Phares family is expected to be present in Estes Park.
Sculptor Ostermiller plans to donate a miniature Winged Rapture
sculpture to the Town of Estes Park.
An Executive Session regarding property acquisition was requested.
Hearing no objection. Chairman Pauley adjourned the meeting to
Executive Session.
