HomeMy WebLinkAboutORDINANCE 05-02ORDINANCE NO.5-02 AN ORDINANCE VACATING A UTILITY EASEMENT ON LOT 1,MARY’S LAKE SUBDIVISION WHEREAS,the owner of property subject to a utility easement has requested that the Town vacate a utility easement across Lot 1,Mary’s Lake Subdivision;and WHEREAS,there is no longer any necessity to have this utility easement proposed to be vacated;and WHEREAS,the Board of Trustees of the Town of Estes Park has determined that it is in the best interests of the Town to permanently abandon and vacate this utility easement. NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF ESTES PARK,COLORADO: Section 1.The Board of Trustees of the Town of Estes Park hereby vacates a utility easement as more specifically described on Exhibit A attached hereto and incorporated herein by reference thereto. Section 2.The Town surrenders any and all right,title and interest to the vacated utility easement. Section 3.This Ordinance shall take effect and be enforced thirty (30)days after its adoption and publication.
