RECORDOFPROCEEDINGS—TownBoardStudySession—November11,2008—Page3aconsiderablenumberoflotswithinthevalleywouldnotbeeligibleforanADUasthelotsarenonconformingastolotsize.StaffhasrecommendedhigherstandardsfordetachedADUsTrusteeMillerstatedtheADUsencourageaffordablehousingandanylegallotshouldhavetheopportunitytohaveanADU.HestatedtheapprovalofanADUshouldberelatedtodesignandlotlayoutratherthanlotsize.DrectorJosephreviewedpastTownBoarddiscussionsin2007relatedtovacationrentals.TheTownBoardrecommendedstaffpresentmodificationstotheregulationstoallowvacationhomesinallsingle-familyzoningdistrictsasause-by-right.ThecurrentdraftclarifiesthedistinctionbetweenvacationhomesandB&Bs.Avacationhomeallowstherentaltoonepartyatatimewithnoservicesprovidedtotheguests.Theproposedcodeamendmentsclarifythestandardsandtheterminology.ThepreviousBoardrejectedtherecommendationtosetaminimumnightstayforvacationhomesandwasnotincludedinthedraft.TrusteeMillerquestionedtheformatoftheproposedamendments.HesuggestedthecodesrelatedtovacationhomesbeseparatedfromtheB&Bregulations.MayorProTemLevineagreed.TrusteeBlackhurstquestionedwhyvacationhomesarenotallowedinthecommercialzoningdistrictandrestrictedtotheupperlevel.DirectorJosephstatedpreviousdirectionwastolimitcommerciallandtocommercialuses.TheBoardrequestedstaffreviewthepotentialforadditionalhousingunitsinthecommercialzoningdistrict.ThepermittingofallB&Bsandvacationhomeswithinthevalleywouldallowstafftheabilitytotracktheuseandaddressgrandfatheringconcernsinthefuture.TrusteeBlackhurstraisedconcernsoverthecurrentlicensingrequirementsforvacationhomesandtheabilityoflargegroupsofvacationhomestooperateunderonelicense.Healsoraisedconcernswithregulationsinthedraftthatarenotenforceableandstatedthesetypesofregulationsshouldnotbeincluded.DiscussionfollowedrelatedtoB&Bs:Thecurrentregulationsrelegatetheusetocommercialpropertiesandmulti-familyzoningdistrict;andtherefore,thetruedefinitionofaB&BdoesnotreallyexistinEstesPark;thelimitofeightguestsinaB&Bisassociatedwiththedefinitionsetbythestate;thedefinitionofaccessorydwellingunitsforaB&Bisneededifyoudonotallowtheminresidentialzoningdistrict;B&Bsandvacationrentalsareallowedonewallmountedsign;asigninaresidentialneighborhoodchangesthecharacterof.thesingle-familyneighborhood.AnewdraftoftheproposedamendmentswouldbepresentedtothePlanningCommissionattheirnextmeeting.Therebeingnofurtherbusiness,MayorPinkhamadjournedthemeetingat6:05p.m.JackieWilliamson,TownClerk RECORDOFPROCEEDINGSTownBoardStudySession—May23,2007—Page2AneedtoaddresstheoperationofBed&BreakfastInnsandestablishconsistencybetweentheMunicipalCodeandtheEstesValleyDevelopmentCodeastotheoperationofsuch,promptedtheTrusteestodiscusspointsthatcharacterizeaB&Bestablishment.ThefollowingpointswereidentifiedascharacteristicstoincludeinadefinitionofaBed&Breakfast:•Owner/Manageroccupied,single-family,detacheddwellingunit.•Lodgingfornomorethaneightpersons(whomaybeunrelated)includingtheresidentmanagers/owners,furtherlimitedtotwopersonsperbedroomplustwo.•Mealsmaybeofferedtoovernightguestsonly.•Nomorethanthreecarsparkedoutsideofthegaragearea,andnoon-streetparking.•Accessorybuildingsshallnotbeusedforguestquartersoramenitiesbeyondagazeboorsimilaroutdoorroom.DiscussiontookplaceregardingzoningdistrictsinwhichaB&Bwouldbeconsideredanallowableuse.InadditiontopropertieszonedCommercialandAccommodationwhereaB&Biscurrentlyanalloweduse,theTrusteesidentifiedresidentialdistrictsR2andRMaspermitteduseareas,withoutspecialreview.AnordinancewillbewrittenreflectingtheproposedchangestotheMunicipalCode.ThesamechangestotheEstesValleyDevelopmentCodewillbeproposedtocreateconsistency,andwillbereviewedbytheEstesValleyPlanningCommission.BONDPARKUSAGE.CertaineventsheldlastyearcauseddamagetoimprovementstoBondPark.Inparticular,displayingcarsintheParkduringtheCoolestCarShowheldonJuly4thcausedconsiderabledamagetoturfandsprinklerheadswithinthePark.Thedamagewasattributedtonewlyplantedsodandwet,rainyweatherthatoccurredduringtheevent.Foottrafficduringartsandcraftsshows,aswellastheneedtoturnofftheirrigationsystemduringtheseevents,createsadditionalstressontheturf.TheTrusteesdiscusseddifferenttypesofeventsthatmightbesuitableforBondParkandothersthatcouldmovetoPerformancePark,ortothefairgroundswhenimprovementsarecompleted.TheTrusteesstatedthatBondParkshouldbeamulti-purposeeventvenueandcomplementdowntownbusinesses.TheperceptionthateventsinBondParkcompetewithdowntownbusinesseswasalsodiscussed,aswellastransientvendorlicensing,andsalestaxcollection.Currently,capitalimprovementsarebeingmadetotheStanleyParkFairgroundsarea.DiscussionensuedaboutresearchingconstructioncostsrelatedtoimprovementsthatcanbemadetoBondParktocreateabalancebetweenapark-likesettinganditsfunctionalityasavenueforperformancesandevents.StaffsuggestedevaluatingBondParkconstructionin2009or2010.COMMERCIALDEVELOPMENTANDINCENTIVES.Agrowingtrendamongmunicipalitiesistoofferincentivestocompaniestoattractbusinessand/ordevelopmentstotheirtowns.Incentivesareoftenintheformoftaxrebates,accesstotaxincrementfinancing,andrebatesoninfrastructurecosts.Theincentivesareofferedwiththeideathatthedevelopmentwillbringinnewtaxrevenues.TheTwsteesdiscussedwhethertheTownofEstesParkwouldbeinterestedinofferingthesetypesofincentivestoattractdevelopmenttothearea.DiscussionincludedhowEPURAcouldplayaroleinprovidingincentives,howincentiveswouldnotbeofferedtonewbusinessesthatwouldbeincompetitionwithexistingEstesParkbusinesses,andthepossibilityofbusinessesleavingtheareawhenincentivesrunout. BoardofTrustees—April10,2007—Page2A.RooftopRodeoParade—July10,2007.B.ScottishFestivalParade—September8,2007.C.CatchtheGlowChristmasParade—November23,2007.Museum/SeniorCenter:1.SeniorCenterBasementPhaseI-$7,247-Budgeted.Itwasmovedandseconded(Homeier/Eisenlauer)theConsentAgendabeapproved,anditpassedunanimously.AdiiiinistratorRepolástatedfCöThmunityDevelopmentCommitteeaddressedvacationhomesattheirApril5thmeeting;however,theCommitteemembershaddifferingopinionsonhowtoaddressBedandBreakfasts(B&Bs).HereviewedtheproposedmodificationstothevacationhomeordinancethatincorporatedchangesdiscussedatthestudysessiononMarch28thStaffwouldrecommendchangestothevacationhomeordinancebeeffectiveafterthesummerseasonorJanuary2008.TrusteeBlackhurstwouldliketodiscussB&Bsasaseparateissueandonlyaddressthevacationhomesatpresent.TrusteeHomeierandMayorBaudekstatedvacationhomerentalsandB&BsshouldbeaddressedatthesametimetoavoidcreatingagapinthecodeandtoaddresstheDevelopmentCodeinconsistencieswiththeMunicipalCode.TrusteeNewsomacknowledgedtheonlydistinctionbetweenthevacationhomerentalandtheB&Bisthenumberofrentalagreements.TrusteeEisenlauerstatedstaff’sdefinitionofaB&Bisacceptable.TrusteeLevinewouldliketohaveadditionaldiscussionsregardingB&Bspriortomovingforward.StaffwilltakeamorestrictinterpretationofthecurrentcodewiththePoliceDepartmentenforcingthecurrentordinanceandnonewB&BlicenseswillbeissuedunlesstheyareintheRMorR-2zoningdistricts.AstudysessionwillbescheduledinMaytoaddressB&Bs.StaffwillnotifylicensedvacationhomesandB&BsofthenextBoardmeetingtodiscusstheissuealongwithadraftoftheproposedcodechanges.PublicCommentwasheardfromGeorgeHockman/1625ProspectEstateDrive,TomEwing!1082FallRiverCourt,DonGooldy/1071FallRiverCourt,andGinnyHutchinson/180LawnLane.CommentsincludedcleardistinctionsbetweenB&Bsandvacationhomerentalsisneeded;B&Bsshouldbeowneroperated;minimumrentalperiodforvacationhomerentals;noaccessoryuseoradditionalbusinessatavacationhomerental;violationsneedtobeaddressedinatimelymanner.JimBarrie/2250BlueSpruceCourtexpressedconcernwiththeproposedlegislationthatdoesnotclearlyaddressthecurrentissues.HestatedrequiringanownerofavacationhomerentalorB&Btoliveonthepropertywouldcreatemoreimpactontheneighborhood.Thecurrentcodeaspreviouslyinterruptedprovidedsupervisionatavacationhomerentalwithmultiplepartieswithlessimpacttotheneighbors.2.ACTIONITEMS:1.ADOPTIONOFFLOODINSURANCESTUDYANDFLOODINSURANCERATEMAPFROMFEMA-ORDINANCE6-07.Dir.Josephreviewedthe1990adoptionoftheFloodInsuranceStudy(FIS)andaccompanyingFloodInsuranceRateMap(FIRM)datedMay4,1987.ThisStudyandMapidentifiesfloodhazardareaswithintheTownofEstesPark.TheOrdinanceamendsChapter17.28oftheMunicipalCodetoincorporatethenewFloodInsuranceStudy(FIS)andFloodInsuranceRateMap(FIRM)effectiveDecember19,2006whichidentifiesexistingfloodhazardswithinthe RECORDOFPROCEEDINGSCommunityDevelopment—April5,2007—Page3217-5304453-25-02asbudgeted.Reports.Reportsprovidedforinformationalpurposesandmadeapartoftheproceedings.•MuseumMonthly•SeniorCenterMonthlyCOMMUNITYDEVELOPMENT.11kedDirJosephprovieabriefhistoryoftheI,inEstesParkRecentdiscussionwithneighborsandbusinessownershascalledformorerestrictiveuseofavacationhomeinaresidentialneighborhoodandbetterenforcement.Therevisionsallowvacationhomestooperateinallresidentialzoningdistrictsasaprincipalfull-timeusewiththefollowingproposedregulations:(1)Prohibitanyrelatedorunrelatedservicesorhomeoccupationbusinesses;(2)Overnightoccupancyofavacationhomeshallnotexceedeightpeoplenorberentedtomultipleparties(separaterentalagreement):(3)Noonsitecustomerserviceswhiletheresidenceisoccupiedorrentedasavacationhome:(4)Nocommercialactivitiesotherthanaccommodationsshallbeallowed:(5)Nohomeoccupationbusinesseswouldbepermittedatanytimeonpropertieslicensedasavacationhome,ornon-concurrenthomeoccupationbusinesseswouldbeallowedwhenthevacationhomeisnotinuse;(6)B&Bprovisionwouldallowanowneroccupiedvacationhometorenttomultiplepartiesandprovidedailycleaning,laundryandfoodservices.Discussionwasheardandissummarizedasfollows:theoccupancyofeightshouldneverexceedeightincludingtheoccupancyofthehomeowners(example:2homeownersplus6guests);leasingofapropertytorunaB&Bwouldnotbepermitted;kitchenfacilitiesshallbeconsistentwithsingle-familyresidentialuse(noefficiencykitchenspermitted);difficultyinregulating/enforcinganon-concurrenthomeoccupationlicense;impactofvacationhomesonresidentialneighborhoods;requiringthepostingofregulationsateachvacationrental;settingaminimumnightrequirement.JimBarrie/ACelticLady’sMountainRetreatexpressedconcernthattheproposedrevisionsdonotaddresstheimpactofavacationhomeontheresidentialneighborhoods.HestatedthecurrentlanguagethatallowsanonsitemanagertobepresentduringtherentaltomultiplepartiesaidsinmaintainingcompliancewiththeTown’sregulations.Requiringapropertyownertoliveonsitefulltimewouldcreatealargerimpactontheneighborhoodwithanincreaseintrafficandnoise.ThenewregulationswoulddecreasethenumberofvacationrentalsandB&BsinEstesPark.Mr.BarrierequestedtheTownconsideradoptingasettimewhenthenewregulationswouldbeenforcedasbusinessesareacceptingreservationsforfuturedates.AdministratorRepolastatedtheregulationsareanefforttoprotecttheresidentialcharacteroftheneighborhood.HeinformedtheCommitteenonewB&BswillbepermittedunlessthepropertyiswithintheRMorR-2(specialreview)zoningdistrictsasrequiredbytheEstesValleyDevelopmentCode;however,currentbusinesseswillbepermittedtocontinuetheiroperations.TomEwing/1082FallRiverCourtstronglysuggestedtheTowndevelopacleardefinitionofavacationhomewithlanguagethatiseasilyinterruptedandenforced,theproposedbusinessshouldbeinvestigatedpriortoissuanceofabusinesslicensetoensurethatitconformstotheregulationsoftheTownandprivatecovenants,businessownersshouldbemadeawareoftheTown’sregulations,andfavorsavacationrentaloveraB&BOperationwithaminimumstayof3nightsinaresidentialneighborhood.MargeGooldy/1071FallRiverCourtwouldencouragetheCommitteetoadoptlanguagethatwouldnotpermitanyothercommercialactivityatavacationhome. RECORDOFPROCEEDINGSEstesValleyPlanningCommission5November27,2006disallowedbytheEVDCinsingle-familyresidentialzoningdistrictseventhoughvacationhomesareallowed.AsdefinedintheEVOC,abed-and-breakfastrequiresthepropertyownertobeonsite,whichprovidesagreaterself-policingelementthanvacationhomeuseandthusshouldnotbediscriminatedagainstinthecodelanguage.ProposedchangeswouldalloweitheruseinresidentialareasprovidedthatotherregulationsintheEVDCaremet.PublicComment:JohnPhipps,585Wonderview,statedheisalocalattorney,andspokeonbehalfofhimselfasahomeownerandonbehalfofhiswife,whohasbeenarealtorinEstesParkfor25years.Hestatedhiswifebelievesthatallowingvacationhomesinresidentialareasdecreasespropertyvalues.Herequestedthatonlyonetermbeusedtodefinevacationhomesratherthanthecurrentpracticeofusingthetermsshort-termrentals,nightlyrentals,andvacationhomesinterchangeably.Hearguedthatshort-termrentalsaredefinedasanaccessoryuseintheEVDCandquestionedwhetherusingapropertyforshort-termrentalsyearroundshouldbeallowed.Herequestedtheterm“on-sitemanager”bestrickenfromthecodelanguage,statingitimpliesaccommodationsuse.Heaskedthatreferencestorentingto“oneparty”bebetterdefined,notingthatonepersoncouldmakethereservationforarentalbutbringsevenunrelatedpeoplealong.Hestatedthatgrandfatheredpropertiesshouldberequiredtoconformtothenewguidelineswhentheirbusinesslicenseisrenewed.TomEwing,1082FallRiverCourt,expressedhisconcernaboutthemeaning,use,anddefinitionofterms,particularlytheterm“nightlyrentals.”Herequestedthat“nightlyrentals”beremovedfromthelistofalloweduses,notingthetermmoreappropriatelydescribesaccommodationsuses.Herequestedthat“vacationhome”beusedinsteadandthatone-nightrentalsbedisallowedinresidentialareas.JayHarroff,1089FallRiverCourt,statedhehasbeenalocalrealtorforeightyearsandsharestheconcernsexpressedbyMr.Phipps.Hestatedthathomeownersinresidentialareasdonotwantnightlyrentalsintheirneighborhoods,nordotheywantoff-sitemanagementofnightlyrentals.RuthGoetzel,1141FallRiverDrive,expressedtheopinionthathomeownersassociationsshouldnothavetocommittheirresourcestopolicingvacationrentalsviarestrictivecovenants.DonGooldy,1071FallRiverCourt,statedtheEVDCdefinesvacationhomeasaresidentialdwellingunitandfurtherdefinesresidentialdwellingunitasabuildingorportionofthebuildingthatincludessleepingandkitchenfacilities.Hearguedthatifabedroomisrentedonanindividualbasis,itmustincludeakitchen.Healsostatedthattheallowedsizeforsignsforvacationhomesistoolargetobeappropriateinresidentialareasandrequestedthatthesizebelimitedto8”x18”.GinnyPage,1861RavenAvenue,statedthatrentalsdonotbelonginresidentialareas.Allcitizensprovidingpubliccommentstressedthatthesingle-familyresidentialcharacterofresidentiallyzonedneighborhoodsshouldbeprotected.TownAttorneyWhiteclarifiedthatlong-termrentalsaredefinedasthirtydaysorlonger,whileshort-termrentalsaredefinedaslessthanthirtydays.CommissionerHullandChairPohiexpressedtheirappreciationofthecommentsreceivedfromthepublic.CommissionerKlinkrequestedthatstaffexaminethepossibleresultsofchangestotheEVDCthatwouldrequireshort-termrentalstobeaminimumstayoffourtofivedays.Itwasmovedandseconded(Hull/Hix)tocontinuethediscussionoftheproposedamendmentstonextmeeting,andthemotionpassedunanimouslyviavoicevotewithtwoabsent.0
