September11,2007WorkSessionTRANSIENTVENDORLICENSINGOFCOMMUNITYSPECIALEVENTVENDORSINCOMMERCIALDOWNTOWN“CD”DISTRICTANDBONDPARKUSAGE.StaffbeganresearchingthelicensingofcommunityspecialeventvendorsinresponsetopastcomplaintsabouttheimpactofcraftfairsinBondPark.AttheJuneCommunityDevelopmentCommitteemeeting,staffwasdirectedtoresearchanddraftaproposalforlicensingcommunityspecialeventvendors.TheproposalwaspresentedtoCommitteeattheAugustmeeting.AtthatmeetingadiscussionensuedregardingthelicensingrequirementsforeventsandvendorsrentingthefairgroundsandconcernwasexpressedthattheproposedpolicycouldhaveanegativeimpactfortheFairgrounds.Staffwasdirectedtoinvestigatetheissuefurther.DirectorPicketingstatedmosteventsinBondParkarefundraisersforServiceClubsandtheFireDepartment.HecommentedtheeventsareapartoftheatmospheredowntownandmovingtheeventsfromBondParktotheFairgroundscouldtakeawaybusinessfromthedowntownarea.Questionsandcommentswereheardandaresummarized:Howvalidistheproblemandcanitbequantified;the2017Committeesuggestedtherebemoreeventsinthedowntownareatoincreasefoottraffic;whatusesshouldbeconsideredandencouragedforBondPark;vendorsoperatingwithintheCommercialDowntown“CD”zoningdistrictshouldberequiredtoobtainabusinesslicensewhichaddressestheconcernofequitywithinthedowntowncorridor;developmentofaMasterPlanforBondParktoidentifythetypesofusesforthepark;theeventcoordinatorwouldberesponsibleforcollectingfees,remittingfeesandsalestaxinformationtotheClerk’sofficeandensuringlicensesareposted.AdministratorRepolastatedDir.Zurnwilldeveloparoughdraftoftheprocess,includingpublicinput,foraBondParkMasterPlantobepresenttotheCommunityDevelopmentCommitteeinOctoberfordiscussionwithpossibleimplementationin2009/2010.StaffwillprepareanewproposalandcodelanguageforthelicensingofcommunityspecialeventvendorsintheCommercialDowntown“CD”zoningdistrictwiththefeestructuretobeginwitha1-3dayrangeat$20.00andpresentitatanupcomingTownBoardmeeting.AdministratorRepolarequestedtheSpecialEventsstaffnotifyallaffecteventsoftheproposedlicensingrequirements.TrusteeHomeierstatedthefairgroundvendorsshouldberequiredtopayafeeandregisterthatsameinformation,i.e.salestax,asallothervendors.Discussionfollowedregardingtheinclusionoffeeswithintherentalagreement.SpecialEventsstaffwillcollectthesameinformationthroughtherentalagreementwithoutcollectingadditionalfees.0 August2,2007CDCMeetingCommunitySpecialEventVendorLicensing—RequestApprovalofOrdinanceAttheJune7thmeeting,theCommitteereviewedtheproposedfeescheduleandproceduresforcommunityspecialeventvendorlicensing.TheClerk’sofficewasinstructedtoproducecodelanguagetoimplementthenewlicensingrequirement.ClerkWilliamsonreviewedtheproposedcodelanguagethatwasaddedtoSection5.20BusinesslicensingoftheMunicipalCode.AttorneyWhitereviewedtheproposedcodelanguageandstronglyrecommendedproceduresonissuingthelicensesbeaddressedadministrativelyandnotincludedwithinthecodelanguage.Dir.Pickeringquestionedwhetherthevendorsassociatedwithanorganizationrentingthefairgroundsandsellinggoodsonlytotheparticipantsoftheeventwouldbeexemptfrompurchasingindividualvendorlicenses.ClerkWilliamsonstatedtheproposedcodelanguagewouldrequirethevendorstopurchaseabusinesslicense.Mgr.Winslowstatedthepublicdoesnotroutinelypurchasegoodsattheseevents;however,thepubliccanattendeventsatthefairgroundsandpurchasegoods.Dir.Pickeringrequestedthecodelanguagedifferentiatebetweenaspecialeventboothandaconventionorsalesmeetingorpublicversusaprivateevent.Afterfurtherdiscussion,theCommitteerequestedstaffreviewthedefinitionofacommunityspecialeventandconsideradistinctionbetweenpublicversusprivateevents. June7,2007CDCMeetingSPECIALEVENTVENDORLICENSINGDISCUSSION.AttherequestoftheCommunityDevelopmentCommittee,BoWinslow,LaurieButton,JacquieHalburntandJackieWilliamsonmetonApril1gthtodiscussspecialeventvendorlicensing.Asaresultofthismeetingandresearchonthesubject,thefollowingisbeingproposed:+Definition:SpecialEventVendormeansanybusiness,whetherlocalornot,thatsellsorofferstoselltoconsumersanygoods,waresormerchandise,inconjunctionwithaspecialevent.•SpecialeventorganizerwouldobtainaGeneralbusinesslicensefortheevent($200.00).•FeeStructureforVendorsOnly:1day$10.002days$15.003days$20.004-7days$25.008-30days$50.00+30days$200.00+FeewouldbecollectedbythespecialeventorganizerandsubmittedtotheTownClerk’sofficewiththefeedepositedintotheGeneralFund.Salestaxinformationforeachvendorwouldbecollectedbytheeventorganizerandsubmittedwiththepayment.•AlicensewouldbeissuedbytheClerk’sofficetobedisplayedatthebooth/tent.Theorganizerwouldberesponsiblefordeliveringthelicensestotheindividualvendorsandensuringthelicenseisdisplayed.Thereareapproximately16specialeventsheldattheFairgrounds,BondParkandtheBreweryparkinglotwith536vendors.Revenueisestimatedatapproximately$9,825.00,withaminimalcostassociatedwithcollectingandissuingthelicensesoncetheassociateddatabaseisinplace,of$100.00inmaterialsperyear.TheTownClerk’sofficerequestsconsiderationoftheproposedspecialeventvendorlicensingproposalandfeeschedulewithspecificcodelanguagetobeadoptedandinforcepriortothe2008season.TrusteeLevinethankedthoseinvolvedincreatingthespecialeventvendorfeeschedule,callingitanequitablewaytoleveltheplayingfieldbetweenpermanentbusinessownersandtransientvendors.TheCommitteeapprovesofthefeestructureandrecommendsstaffdevelopthespecificlanguagetobereviewedattheAugustCommitteemeeting.PaulFishman,ownerofl4ersCafé,116E.ElkhornAvenue,thankedtheCommitteeforpursuingthelicensingofspecialeventvendors.0
