IBoardofTrustees—November10,2009—Page31.2009CONCRETEREHABILITATION.DirectorZurnstatedthePublicWorksdepartmentconductsannualconcreterehabilitationandthe2009budgetcontains$50,000forimprovementstorepairmiscellaneousconcrete,curb,trailsandsidewalk.Therepairswouldbeconductedwithinthe300-500blocksofEastElkhornAvenueandtheRiverwalk.Requestsforpricesweresenttofourinsured,localconcreteconstructioncompanieswiththelowbidfromCornerstoneConstructionConceptsfor$43,478.Staffwouldrequestapprovalfortheentire$50,000tocompleteadditionalimprovements.Itwasmovedandseconded(Ericson/Blackhurst)toapproveCornerstoneConstructionConceptsfortheannualconcreterehabilitationforthebudgeted$50,000fromaccount101-3100-431-35-51,anditpassedunanimously.2.PUBLICHEARING—2010BUDGET.DeputyTownAdministratorRichardsonreviewedacoupleofmajorchanges,includingthepassageoftheFireDistrictandthecreationoftheCommunityServicesdepartment(combiningVisitorServices,Museum,SeniorCenter,SpecialEventsandConferenceServices).Thechangeshavereducedstaffinglevelsfor2010.FinanceOfficerMcFarlandreviewedthebudgetprocessforthe2010budget,whichincludedpre-budgetmeetingsinJuneandJulyand4studysessionsinOctober.HeprovidedanoverviewofthecurrenteconomicenvironmentthathasleadtoadownturninsalestaxforamajorityofColoradocommunities.Aninformalpollofcommunitiesthatderivemostoftheirrevenuefromsalestaxaredownonaverage8%andarebudgetingflatfor2010.Incomparison,theTownisforecastinga5%decreasein2009andazeroincreasein2010.2009revenueswerereviseddownduetoadecreaseinsalestax,interestincomeandCommunityDevelopmentfeescollected.Additionalsavingswerealsorealizedin2009throughspacesavingsorcuttingcostsinPersonnel,O&M/CapitalandTransferswithtotalcutsof$259,809.TheTownbudgetcontains16fundswithexpendituresofover$32millionwithamajorityoftheexpensesintheEnterprisefunds’ofWaterandLightandPowerthatarefundedbyratepayers.TheGeneralFundcontinuestomaintaina30%fundbalanceandsubsidizeSpecialRevenuefundslessin2010.TheCommunityReinvestmentFundcontinuestoescrowfundsforprojectssuchasthegrandstands,MPECorotherprojectsyetidentified.ThetransfertotheCVBfundswerereducedwiththeLMDprovidingthemarketingandadvertisingforEstesParkstartingin2010.TheEnterprisefundsaremetabolizingcapitalprojectsanddebtservicewhilemaintaininghealthydebtratios.Boarddiscussionfollowed:futureimprovementstotheGlacierBasinwatertreatmentplantmayrequirefuturerateincreases;theTownhasdiscussedpoolingfundswiththeParkandRecreationalDistricttocompleteadditionaltrails;transitionalIGAfortheFireDistrictwouldrequirefundingoftheDistrictin2010;andtheTownshouldlookattheoptionofself-insurancetoreducecosts.TownAdministratorRichardsonstatedtheFireDistrictInitiativeCommitteefiledthenecessarypaperworktoallowtheDistricttocollectpropertytaxin2010.TheTownwouldprovidehalfoftheprojected7%ofsalestaxwithinthefirst10daysof2010toprovidetheDistrictwithoperatingfundspriortoreceivingthefirstinstallmentofpropertytax.TheTown’sinsurancebrokerhasbeenexploringoptionsincludingself-insuranceoraprescriptiondrugprogramtoreducehealthinsurancecosts.StaffwouldreviewoptionsandprovideareporttotheBoard.PublicComments: IRECORDOFPROCEEDINGSEstesValleyPlanningCommission2November12,2009TheTownpurchaseswindenergythroughthePlatteRiverPowerAuthority,andanyEstesParkLightandPowercustomercanpurchaserenewableenergythroughtheLightandPowerDepartment.Fundsreceivedthroughthisprogramareallocatedtotheoperationofcurrentrenewableenergysitesandconstructionofnewsites.UtilitiesEngineerBergstenstatedifacitizeninstallsawindturbine,itmustpassinspectionbythestateelectricalinspector,andtheTownisrequiredbylawtoprovidenet-metering.Excessenergyproducedisreleasedintothepowergridandthecreditisrolledoveronamonth-by-monthbasis.Anyexcessenergyattheendofthe12-monthperiodispaidtothecustomerasacreditontheirutilitybill.Therearecurrentlythreeprivately-ownedwindturbineswithintheEstesValleyarea,twoarehorizontalaxisunitsandoneisadouble-helixtype.Withassistancefromtheowners,theseturbineswillbemonitoredformaintenance,energyoutput,etc.todeterminetheireffectiveness.UtilitiesDirectorBergsten’snotescanbeviewedontheWindTurbinepageoftheTownwebsite.ChairKlinkclarifiedthatalthoughmanypeoplemaywanttheTowntoplaceabanonwindturbines,therecouldverywellbelegislationinthenearfuturepre-emptinglocalregulationsandprohibitingbansonanykindofrenewableenergy.Sincethatisapossibility,hestateditwouldbebettertodraftregulationspermittingwindturbineswhileaddressingthecommunity’sconcerns.CommissionerNorrisstatedthatPlanningCommissionhasdraftedaproblemstatement,withfeedbackfromstaffandsomeTownTrustees,todefinetheCommission’stask.HestatedthatoneofCommission’stasksistoworkwiththeTownBoardandstafftodevelopcodelanguagepriortotheDecember9,2009expirationofthewindturbinemoratorium.IftheCommissionisnotreadytorecommendspecificcodelanguage,theyhavebeenaskedtoconsiderrecommendingextendingthemoratorium.DirectorJosephstatedthatbasedonfeedbackfromthelastPlanningCommissionmeeting,staffpreparedalistoftalkingpointsabouthowSmallWindEnergyConversionSystems(SWECS)mightberegulated.Hestatedthegoalistohaveregulationsthatwillapplytoallstylesofwindturbinesavailabletodayandinthefuture.ChairKlinksuggestedaddingasectiontodealwithsafetystandards.Basedonpreviousdiscussionshebelievesitems“B”dealingwithmaximumheightallowancesand“C”concerningsetbacksareofparticularinterest.DirectorJosephreviewedthreemapsoftheEstesValleyillustratingwhichparcelswouldbeabletositeawindturbineifa90-foot,120-foot,ora150-footpropertylinesetbackwasrequired.Witha90-footsetback,approximately2,100outofroughly8,000parcelswouldbeabletositeaturbine.With120-footsetbacks,thenumberofparcelsdecreasestoapproximately1100,andwitha150-footsetback,thenumberdecreasestoapproximately735parcels.DirectorJosephnotedthesenumbersmightbefurtherreducedforavarietyofreasons.Forexample,theareawhereaturbinecouldbesitedmayalreadybeoccupiedbyastructuresuchasasingle-familyhomeorgarage.Hestatedstaff’sgoalwastobegintoprovideanillustrationofwherewindturbinescouldbesitedintheEstesValleygivencertainminimumsetbacks.Astheminimumrequiredsetbackincreases,theabilitytositeturbinesinthemoreurbanizedareasoftheEstesValleydecreases.PublicComment:GilbertThomasGresslin/TownResidentbelievestheallowanceofwindturbineswouldactuallyincreaseaperson’scarbonfootprint.HesuggestsmakingthepurchaseofrenewablewindenergyfromthePlatteRiverPowerAuthoritymandatoryforallresidents.MaryannKarinch/CountyResidentreadalettersubmittedtothePlanningCommissionbycountyresidentJimMcCormick.Hebelievesthesurveywasunder-assessedanddesignedwithfaults,andthepercentageofrespondentswhofeelthatpersonalwindturbinesshouldberegulatedbasedonheight,setbacks,noise,lotsize,andcolorarehigherthanindicated,hadtheybeenallowedtoexpresstheiropinion.Duetothecurrent30-footheightrestriction,heconsidersaproposalofa50-footheightlimitindefensible.Hefeelsverystronglyaboutacquiringtheconsentofimpactedpropertyownerswhosevieworquietenjoymentoftheirpropertymaybeaffectedbywindturbines.Heencouraged JoRECORDOFPROCEEDINGSEstesValleyPlanningCommission3November12,2009residentstotakeadvantageofimmediateaccesstowind-generatedpowerthroughtheRenewableEnergyPurchasePlan.GaryColeman/CountyResidentsuggestsbuildingalocalwindfarmwhereresidentscouldpurchaseenergyfortheirpersonalconsumption.BobMcCreery/CountyResidentisconcernedabouttheviewimpactofa50-footturbinewithnodependableoreconomicaltrackrecord.Hethinkstheindustryismovingtowardadifferenttypeofwindturbinetechnology,andifweallowthecurrenttypesofturbines,theywillsoonbeobsolete.HerecommendsaskingtheTownBoardtocontinuethemoratoriumuntiltheTownhastheopportunitytoperformatestprojectforpracticalityandviability.HarryHutchersoniTownResidentcannotsupportwindturbineswithintheTownlimits,butmaysupportacommunitywindfarm.Hedoesnotbelieveasmall-scalewindturbineiscosteffective,andwillhavenegativeimpactsonresidentsandvisitors.WayneNewsom/TownResidentisagainsthavingmorepolesintownthanwealreadyhave.HeownsandencouragesotherresidentstopurchasewindenergyfromtheRenewableEnergyPurchasePlan.HeopposeswindturbinesinEstesPark.RichardVolkstorf/TownResidentstatedburiedutilitylinesinTheUplandswasoneofthereasonshepurchasedpropertyinthatarea,andisconcernedaboutthevisualimpactsofwindturbines.Hequestionedthecredibilityofthesurvey.Hesupportspersonalpropertyrightsthatdonotadverselyaffectneighborsorcommunity.Heopposeswindturbinesingeneral,butsupportspersonalpropertyrights.Ifaheightlimitofmorethan30feetisallowed,hesuggestscodelanguagerequiringapprovalfrom700%oftheadjacentpropertyowners.MikeHeadleyirownResidentisaretiredengineerthatagreeswiththedatapresentedbyUtilitiesEngineerBergsten.Hethinksacommunitywindfarmcouldbeagoodidea.Hequestionsa50-tootheightlimitproposalwhen30-feet(Town)and40-feet(County)arethecurrentheightlimits.Hewouldsupportconsensusofalladjacentpropertyowners.PaulBrown/TownResidentwouldlikethePlanningCommissiontoconsidersystemsthatgeneratelessthan400waifsbeexemptfromanytypeofreviewprocess.Thesesystemswouldprovideanemergencysystemtopowerappliances,andarenotdependentonanyotheroutsidesourceofpower.JayHeinemann/CountyResidentbelieveswindturbinesshouldbebannedinthisarea.Heisconcernedaboutvisualimpacts,andsupportspurchasingwindpower.Hewouldnotsupportthe100%adjacentpropertyownerconsentduetotheprobabilityofthechangeofpropertyownership.JimDoctor/TownResidentisastrongproponentofindividualpropertyrights,andbelieveswindturbinesarevisuallyobtrusiveandunattractive.Hewouldsupportabanonwindturbines.Inlieuofthat,hewouldsupport100%adjacentpropertyownerconsent.FrankTheiss/CountyResidentbelievesbladedwindturbinesareunsightly.Itregulated,hesupportsa30-footheightlimit,setbacks,andapplyingthesigncodewhichdisallowsmovingparts.JimTawney/TownResidentbelieveswindturbinesshouldberegulatedaslittleaspossibletoallowopportunityforexperimentation,personalpropertyrightsshouldremainontheforefront,and“C”-setbacksshouldbedowngraded.Also,theallowanceofonlyoneperlotcouldpresentproblemsitawindfarmwasproposed.JudyHeaston/CountyResidentbelievesthesetbacksshouldbedecreasedtoallowforturbinesonsmallerlots.ShesupportsK”,requiringbothmanualandautomaticcontrolslimitingtherotationalspeedoftheunit.SheremindedtheCommissiontobeawareofwritingregulationsthatcouldlimitnewtechnologicaldesigns. RECORDOFPROCEEDINGSEstesValleyPlanningCommission4November12,2009PhilEdwards/CountyResidentisopposedtowindturbinesandthenegativevisualimpacts.BobAyers/TownResidentopposeswindturbinesinthearea,andsupportstherenewableenergyprogram.HeencouragedtheCommissiontodisallowwindturbinesbuiltwithcurrenttechnology.UtilitiesEngineerBergstenstatedundercurrentnet-meteringpolicy,alternativeenergysourcesconnectedtothegridarenotallowedtooperateifthegridgoesdownduetosafetyissuesforthelinemanwhenthatenergyisfedbackthroughthesystem.Equipmenttocompletelydisconnectfromthegridisavailabletohomeownersbutisveryexpensive.ChairKlinkclosedthepubliccomment.ChairKlinkstatedacommunitywindfarmisoutofthescopeofthisregulation.ThePlanningCommission’sdirectiveistoregulatesmall-scaleresidentialwindturbines.Basedonpublicinput,StaffandtheCommissionwilldraftregulationstoberecommendedtoTownBoardandBoardofCountyCommissioners,whowillbethedecision-makingbodies.CommissionerNorrisstatedtheNationalRenewableEnergyLaboratoryinGoldenhasdiscontinuedresearchonsmall-scalewindturbinesduetolowefficiency.CommissionerHullagreesthesurveyisnotscientific,butoverhalfofthecommentssupportedheightregulations,46.3%ofrespondentsbelievetheyhavenegativevisualimpact,and18commentsweredirectedtowardspropertyrights.ChairKlinkstatedalthoughunscientific,thesurveyprovidedcommentsfrominterestedresidentsandvisitorsthatwerewillingtostatetheiropinions.CommissionerFraundorfconcludesfrompubliccommentthatresidentsdonotwantwidespreadwindturbines,especiallyonsmalllots.Hehearsthatwindturbinesshouldbestrictlyregulated,andpossiblyevenbanned.CommissionerPoggenpohlthinkstheCommissionshouldbelookingatwaystoprotecttheviewqualitywhencreatingregulations.CommissionerLanestatedtheCommissionshouldnotbereactionary,andthinkstheyshouldbeabletodraftareasonablesetofrestrictionsthatmakesenseandaddressneeds.ChairKlinkpolledtheboardonitems“B”—heightlimitand“C”—setbacks.TheCommissionersagreedthemaximumheightlimitshouldbe30feettothetopoftheblade,andthesetbackfromthepropertylineshouldbefivetimestheheightofthestructure.CommissionerPoggenpohlwouldalsoliketoseeflexibilitytotsmallpersonalsystemsthatareshorterthan30-feetandwouldnotrequirea10-tootgroundclearance.DirectorJosephexplainedthesesmallsystemsareasubsetofthistechnologyandwouldrequireadifferentregulatoryapproach.TherewasgeneralconsensusamongtheCommissionnottorestrictcolorandsurfacetreatment.Theprohibitionoflighting,graphics,signs,andotherdecorationshouldbewrittenintothecode.ChairKlinkcalledarecessat3:37.Themeetingreconvenedat3:50.Onproposeditem“M”—safetystandards,CommissionerPoggenpohlhasresearchedtheproductsafetystandardsforwindturbinesandfoundinternationalsafetystandards,butnoneoriginatingintheUnitedStates.HesuggestsapplyingtheInternationalElectroTechnicalCommitteestandards,coordinatedwiththeInternationalStandardsOrganization(ISO)andtheInternationalEnergyAgencyuntiltheUnitedStatesadoptsnationalsafetystandardsforwindturbines.UtilitiesEngineerBergstenstatedHouseBill1160requirestownstoallow10KWsystemswithnoregulationsotherthanwhatisalreadyinplace.TheTowncouldrequireregularinspectionsonlargersystems,whichwouldberegulatedbythePublicWorksDepartment.DirectorJosephstatedthisislargelyanissuewiththestateelectricalinspector.TheBuildingDepartmenthandlesthestructuralcomponentaswellasthesetbackrequirements.CommissionerPoggenpohl TheFireChiefnotedthatthefiredetectionandalarmsystemshouldcomplywithNFPA72.Theteamalsorecommendsinter-connectingthefirealarmsystemwiththesecuritysystemsothatanyalarmsarepickedupbythetowndispatchermonitoringthesecuritysystem.Theteamrecommendsawetpipesprinklersystem,sincesuchsystemsarereliable,easytomaintain,economical,andunlikelytofailorleakifproperlyinstalled.Thefirechiefnotedthatwaterpressureinthispartoftownisveryhighandthatthedesignteamshouldevenconsiderapressurereducingvalveforthesprinklersystem.Thefacilitymustbedesignedandsitedsuchthatfiretruckscandrivetowithin150feetofthebuildingandthefiredepartmentconnectionpoint.ItwasagreedthatthiswouldmostreadilybeachievedbyprovidingvehicularaccessnotfromfourthStreetorHwy.36butfromtheperimeterorcross-axialdrivesofthefairgrounds,eitherofwhichwillinturnbeaccessiblefromfourthStreet.Ms.KilsdonkconfirmedwiththeTownAdministrationthatthenewbuildingcouldbe“addressed”accordingly(sincethefiredepartmentrespondsaccordingtotheaddressonfilewiththedepartment).Afirehydrantmustalsobelocatedwithin150feetofthedriveway;thismayrequireanadditionalhydrantdependingonhowtherestofthefairgroundsprojectisultimatelydeveloped.Asaresultoftheserequirementsandthesiterequirementsnotedabove,itwasdecidedthatpedestrianaccesswillbeachievedviaanextensionofthewalkwaycurrentlyrunningfromthemuseumtotheRMNPHQbuilding(tothenorthwestsideofthenewfacility),whilevehicularaccesswillbefromthefairgroundsroadtothesoutheastsideofthefacility.Metalroofing(standingseam,greencoLor)complieswithboththedesigncriteriaandfire-resistancegoals.(Thesiteisoutsideofthewildfirezonebutembersmightstillbecarriedfromthezonetotheproposedsite.)Theexteriorwallswillprobablybefinishedinwoodandstone(asattheexistingmuseum).Theexteriorwallassemblyshouldincludetwolayersofgypsumwallboard,however,toachieveaonehourfireresistancerating.Themechanicalroomwallsshouldbecomposedtoachieveafourhourfireresistancerating,andthecollectionsstoragespaceshouldbeseparatedfromadjacentspacesbydrywallpartitionsachievingatleastatwohourfireresistancerating.SeeAppendixBforaseriesofbasicmuseumfire-protectionguidelinescommonlyrecommendedformuseumsandcuratorialfacilities.Program-securitysystemandproceduresThevisitingteamrecommendsthattheprojectbedesignedwithperimeterdetectionandaccesscontrol,interiordetectionandmonitoring,andnewstaffprocedures.Thebuiltinsystemshouldincludekey-cardlpush-padstationsatthetwoexteriordoorsandatthetwosetsofdoorstothecollectionsstorageroom.Closedcircuittelevisioncamerasshouldmonitorallfourofthesedoors(frominside).Theinteriorshouldbefittedwithglassbreakdetectors(atroomswithfenestration),motiondetectors,and vibrationsensingdevices.Selecteddoorsshouldbefittedwithmagneticcontactsensors.Keycardsshouldbeissuedandretrieveddaily.Eachstaffmembershouldhaveher/hisparticularaccesscodematchedtoher/hiscard,withaccesslimitedtothehoursandlocationsthateachstaffpersonisauthorizedforaccess.Museumadministrationshouldexecuterigorousbackgroundchecksofallpotentialstaff,volunteers,and“contractworkers.”Nounsupervisedvisitorsshouldbeallowedanywhereinthebuilding.Cameraimagesshouldbemonitoredsteadilyduringopenandclosedhours.Recordingsofallcameraimagesshouldbestoredsecurelyforsuitablelengthsoftime.SeeAppendixCforaseriesofbasicmuseumsecurityguidelinescommonlyrecommendedformuseumsandcuratorialfacilities.Program-lightingThevisitingteamrecommendsthatthelightingsysteminthecollectionstorageroomshouldbecontrolledwithmotiondetectorsorviaatimeclock,tolimitthedurationofillumination.Allfixturesshouldbeinstalledwithfiltrationagainstultravioletlight.FluorescentlightsaresuitableforcollectionsstorageaslongasthetubesarefittedwithUVfiltrationsleeves.(Atcompactstorage,thefixturesshouldrunperpendiculartothestoragecabinets.)Lightinginnon-collectionspacesshouldbeenergyefficientandreadilymaintainable.Program-emergencysystemsandredundancyGiventhelimitedbudgetforthenewfacilityandtherelativelybriefperiodsofpowerlossexperiencedhistorically,itisnotrecommendedtohaveanon-siteback-uppowersupplyfortheentirefacility.Abatterysystemorsmallemergencygeneratorshouldbeprovidedforthefirealarm,securityandotherlife-safetysystems.Forthesamereasons,itisnotreasonableforthemechanicalsystemtobedesignedwithmajorredundancy.However,thebuildingenvelopeshouldbedesignedtoallowthespaceto“coast”aslongaspossibleifthereisaninterruptiontopower,andtheclimatecontrolsystemshouldbeconfiguredsothatanyinterruptioninpowerprovidesasignalwithadequatetimeandabilitytoclosetheoutsideairintake.Theelectricalpanelforthenewfacilityshouldbeequippedwithaswitchwherebyaportablegeneratorcanbepluggedinasneeded.Program-indoorairqualityThedesignteamshoulddesignthebuildingandthesystemstominimizetheintroductionandspreadoftroublesomechemicals.Thespecificationsforbuildingmaterialsshouldexplicitlylimitconstructiontomaterialsthatdonotincludeureaformaldehyde,sulfurammonia,volatileorganiccompounds,acids,orotherchemicalsthataredangeroustothecollections.Priortothedesignoftheairhandler,samplesof0 localairshouldbetakenandanalyzedtodetermineifpollutionlevelsaresuchthatgaseousphasefiltrationiswarranted.Outbuildings:commentsregardingenvironmentalcontrolsMs.Kilsdonkaskedthevisitingteamtoconsiderthepossibilityofintroducingenvironmentalcontrolstothetwoexistingoutbuildings:thesmalllogcabinandtheformerHeadquartersoftheRockyMountainNationalPark.Thelogcabinisawoodstructurewithfurniturethatservesasanexhibititself.Itiscurrentlyunheated,althoughthereisanunusedstoveaspartoftheexhibit.Thevisitingteamdoesnotbelieveitisadvisabletointroduceeitheraheatingsystemoracoolingsystemintothisstructure.Theconditionofthestructureandcontentsdonotseemtobedeterioratingparticularlyquicklyunderthecurrentsetofcircumstances,andanynewsystemwouldnecessarilycompromisetheintegrityofthecabinasanartifact.Itcouldalsocreateproblems(forexample,byheatingthecabinonemightattractinsectsandothervermin).Theheadquartersbuildingiscurrentlyfittedwithaforcedairheatingsystemandnoairconditioning.Themuseumstaffprovidedthevisitingteamwithhygrothermographsheetsshowingremarkablyconsistenttemperatureandrelativehumidityreadingsfortheheadquartersbuildinginvariousseasons-evenwithoutairconditioning,theinteriorspacetypicallyfluctuateslessthan15°Fand15%RHwithinanygiven24hourperiod.Basedonthisperformancetodate,andgiventhecostandcomplexityofadaptingthebuildingenvelopetomoresophisticatedclimatecontrolsystems,thevisitingteamdoesnotrecommendmodifyingorexpandingtheheadquartersbuildingsystems.However,theteamstronglyrecommendstheintroductionofdataloggingequipmentthatwillmeasureandrecordthetemperatureandrelativehumidityautomatically(forfuturereferenceandevaluation),andalsothatthereturngrilleatthefurnace/blowershouldbeclearedofallobstructions.Furthermore,thefurnaceshouldbeevaluatedtomakesurethatitisingoodworkingorderandthefilterisclean.Existingoff-sitecollectionstoragefacility:commentsregardingfirealarmsTheexistingoff-sitefacilitywherethecollectionsarestoreddoesnothaveeitherafirealarmsystemorafiresuppressionsystem.ThevisitingteamstronglyurgestheMuseumtointroduceafiredetectionsystemconnectedtothetownmonitoringsystem,allowingapromptresponseintheeventofafire.AppendixDincorporatestheconceptualbuildingfunctionalityandasuggestedfloorpLandevelopedduringtheon-sitework.Thefollowingtableillustratestheestimatedcostsfortheprojectifitwereundertakenasanon-phasedorlumpsumproject.Table1 0MemoDate:November19,2009To:TownBoardofTrusteesFrom:GregoryA.WhiteRE:EmergencyOrdinance—MedicalMarijuanaDispensariesBACKGROUND:Thisisanordinancetoenactaseven-monthmoratoriumontheestablishmentandoperationofmedicalmarijuanadispensariesintheTown.In2000,Colorado’svoterspassedaconstitutionalamendmentthatlegalizedthemedicaluseofmarijuanabypatientswithcertaindebilitatingconditionsandauthorizedthepatient’sorthepatient’sdesignatedprimarycaregivertopossessandgrowcertainamountsofmaruana.Untilrecently,thislegalizeduseofmarijuanawasnotasignificantissueinColoradobecauseallusesofmarijuanaremainedacrimeunderfederallaw.However,inFebruaryofthisyear,thefederalgovernment,underthenewadministration,announcedthatitwouldnolongerenforcethefederalmarijuanalawssolongasmarijuanawasbeingusedinaccordancewithstatelaw.Asaresult,therehasbeenanexplosioninthenumberofpatientsandprimarycaregiversinColorado,includingtheopeningofbusinessesknownas“medicalmarijuanadispensaries”.TheTownhashadnumerousinquiriesconcerningtheopeningofmedicalmarijuanadispensaries(“MMDs”)intheTown.TherecentproliferationofMMDsinColoradohasraisedanumberofpolicyandlegalissuesformunicipalitiesaroundColorado,manyofwhichdonothaveprovisionsintheircodestodealwiththeeffectsofMMDsopeningintheircommunities.TheTownisinasimilarpositionasitalsodoesnothaveprovisionsinitsMunicipalCodeorintheEstesValleyDevelopmentCodetoaddressthesepolicyandlegalissues.Loveland,FortCollins,Greeley,andTimnathhaverecentlyadoptedmoratoriums.Also,LarimerCountyisconsideringamoratorium.TownStaffbelievesthattheTownneedstimetoconsiderhowtodealwiththeseproposedMMDsandtheircollateraleffects.Therefore,forthisreason,andbecausetheeffectsofMMDsandthelawrelatedtothemisrapidlyevolving,TownStaffisrecommendingthattheBoardofTrusteesadoptanemergencyordinancetoimposeaseven-monthmoratoriumon C..theestablishmentofnewMMDsintheTown.Duringthismoratorium,TownStaffwillworkonproposedCodeamendmentsrelatingtotheregulationofMMDs.BUDGETIMPLICATIONS:OnNovember16,2009,theColoradoAttorneyGeneralissuedanopinionthatthesaleofmedicalmarijuanaissubjecttosalestax.ThemoratoriumwillpotentiallypreventtheTownfromcollectingsalestaxonthesaleofmedicalmarijuana.AstherearecurrentlynomedicalmarijuanadispensariesintheTown,theamountofanysalestaxisindeterminable.STAFFRECOMMNDATION:TownStaffrecommendsadoptionofthisOrdinance.ThemoratoriumimposedbythisOrdinancewillgiveTownStaffanopportunitytodevelopproposedMunicipalCodeand/orEstesValleyDevelopmentCodeamendmentstodealwiththeseissuesandtoharmonizeanysuchamendmentswithanyadoptedStatestatutes,ColoradoDepartmentofHealthandEnvironmentRegulations,andcourtrulingsthatareexpectedtooccurinthenearfuturewithrespecttoMMDs.02 ORDINANCENO.ANORDINANCEOFTHETOWNOFESTESPARKIMPOSINGAMORATORIUMONTHEISSUANCEOFBUSINESSLICENSES,BUILDINGPERMITSANDOTHERAPPROVALSRELATEDTOPERSONSANDLEGALENTITIESESTABLISHINGMEDICALMARIJUANADISPENSARIESINTHETOWNWHEREAS,atthegeneralelectionofNovember2000,thevotersoftheStateofColoradoadoptedAmendment20totheColoradoConstitution(the“Amendment”)addingArticleXVIII,Section14totheConstitution;andWHEREAS,theAmendmentcreatesanaffirmativedefenseto,andexceptionfrom,statecriminallawsandtheTown’sMunicipalCodepertainingtothepossessionanduseofmarijuanawhensuchpossessionoruseisforthetreatmentofdebilitatingmedicalconditionsprovidedcertainconditionsspecifiedintheAmendmentaremet;andWHEREAS,inthepastseveralmonths,theTownClerk’sofficeandtheEstesParkPoliceDepartmenthavereceivednumerousinquiriesfrompersonsinterestedinestablishingmedicalmarijuanadispensariestosellordispensemedicalmarijuanawithintheTown;andWHEREAS,undertheapplicableprovisionsoftheEstesValleyDevelopmentCode(“EVDC”),thesebusinesses,referredtohereinas“medicalmarijuanadispensaries”or“MMDs”,likelyconstituteretailsalesoperationsorclinicswhichareusespermittedinawidevarietyoftheEVDC’szonedistricts,andinsomecircumstancesmaybeallowedinzoningdistrictsasanaccessoryuseforthecultivation,storageandsaleofcrops,plantsandflowers;andWHEREAS,withrespecttoMMDsintheTown,theTowncurrentlyhasnolanduseorbusinessregulationsconcerningtheiroperations;andWHEREAS,ambiguitiesinthewordingoftheAmendmenthavecreateduncertaintyastowhichMMDsmayproperlybeconsidered“primary-caregivers”undertheAmendmentforthepurposeofprovidingmedicalmarijuanatopatientssufferingdebilitatingmedicalconditions;andWHEREAS,theColoradoDepartmentofPublicHealthandEnvironment(the“CDPHE”),whichisresponsiblefortheadministrationofthemedicalmarijuanaprogramestablishedbytheAmendment,iscontinuingtoconsiderchangesinitsadministrativeregulationsthatgovernMMDsasprimarycaregivers;and PWHEREAS,thesamequestionaboutMMDsasprimarycaregiversiscurrentlyunderreviewbytheColoradoappellatecourtsandmayalsobethesubjectofproposedlegislationintheupcomingsessionoftheColoradoGeneralAssembly;andWHEREAS,municipalitiesthroughoutColoradoarestrugglingtogaincontrolovertherecentproliferationofMMDsandhaveenactedvariouskindsoflocalregulations,includingmoratoriums,inanattempttoaddressissuesregardingthemedicalmarijuanaexceptioncreatedbytheAmendment;andWHEREAS,asignificantperiodoftimewillberequiredfortheTownStafftoclarifytheevolvingstateofthelawwithregardtoMMDsandtoformulaterecommendedamendmentstotheMunicipalCodeand/ortheEVDCtodealwiththesubject;andWHEREAS,withthepossibleinfluxofMMDs,theBoardofTrusteesisconcernedaboutitsabilitytoprotectthepublic’shealth,safetyandwelfareandpreservethecharacteroftheTown’sneighborhoodsandcommercialareaswhereMMDsmightbelocated;andWHEREAS,theimpositionofaseven-monthmoratoriumontheconsiderationandissuanceofTownbusinesslicenses,buildingpermitsandotherapprovalsrelatedtotheestablishmentandoperationofMMDswillallowTownStaffandtheBoardofTrusteesthetimeneededtoinvestigatetheTown’sabilitytoregulatesuchbusinessesanddevelopandimplementappropriateregulations;andWHEREAS,seven(7)monthsisareasonableperiodoftimeandnolongerthannecessaryfortheTowntodeterminetheextenttowhichMMDswillberegulatedonastatewidebasisandtoproperlyinvestigate,develop,and,ifappropriate,adoptandimplementanylocalregulationsrelatedtoMMDs.NOW,THEREFORE,BEITORDAINEDBYTHEBOARDOFTRUSTEESOFTHETOWNOFESTESPARK,COLORADOasfollows:Section1.ThattherecitalscontainedinthisOrdinanceareherebyadoptedandincorporatedbythisreference.Section2.That,forpurposesofthisOrdinance,“medicalmarijuanadispensary”or“MMD”shallmeanaproperty,premisesorstructureusedtosell,distribute,transmit,give,dispenseorotherwiseprovidemarijuanainanyformandinanymannertoapatientorprimarycaregiver.AsusedinthisOrdinance,“patient”and“primarycaregiver”shallhavethemeaninggiventothemintheAmendmentasclarifiedbycontrollingcaselaw,StatestatutesorCDPHEregulationsinterpretingtheprovisionsoftheAmendment.2Q Section3.Thatitisnecessaryfortheimmediatepreservationofthepublic’shealth,safetyandwelfaretodelaytheissuanceofallTownbusinesslicenses,buildingpermitsandanyotherapprovalsrelatedtotheestablishmentandoperationofmedicalmarijuanadispensariesintheTownuntiltheTownhashadareasonableopportunitytodeterminetheextentoftheTown’sregulatoryauthorityoversuchdispensariesandtofurtherdeterminewhatregulations,ifany,shouldbeimposedbytheTownuponthesedispensaries.Section4.Thatanseven-monthmoratoriumisherebyimposedupontheissuancebytheTownofanyTownbusinesslicense,buildingpermitandanyotherapprovalsrelatedtotheestablishmentoroperationofmedicalmarijuanadispensariesintheTown.Inaddition,nomedicalmarijuanadispensaryshallbeestablishednorshallitbeoperatedbyanypersonorentitywithintheTownduringthismoratorium.Further,nopersonorlegalentityshallestablishandoperateamedicalmarijuanadispensaryintheTownandengageinthesaleofmedicalmarijuanawithoutfirsthavingobtainedfromtheTownavalidlyissuedbusinesslicenseundertheprovisionsofChapter5.20oftheMunicipalCode.Notwithstandingtheforegoing,thismoratoriumandtheprovisionsofthisSection4shallnotapplytoanyprimarycaregiverwhoisthedesignatedprimarycaregiverinthemedicaluseofmarijuana,providedsuchprimarycaregiverisdoingsoinfullcompliancewithalltherequirementsoftheAmendment,anyapplicablecaselaw,Statestatutes,andCDPHEregulations.Section5.That,duringthetermofthismoratorium,theTownStaffandTownAttorneyareherebydirectedtoanalyzeanddevelopfortheBoardofTrusteesconsideration,regulationsastheymaydeemnecessaryandappropriatetoaddresstheestablishmentandoperationofMMDsintheTown,withsuchissuestoinclude,withoutlimitation,thefollowing:a.theextenttowhichMMDsarelegallyprotectedundertheAmendment;andb.theimpactofMMDsonthecharacterofresidentialneighborhoodsandcommercialareaswheretheymaybelocated.Section6.Thatthismoratoriumshallcontinueineffectuntilthe24thdayofJune,2010,orsuchearlierdateasmaybedeterminedbytheBoardofTrusteesbyordinance.Section7.ThatnothinghereinshallbeconstruedasdecriminalizingormakinglawfulintheTownanyMMDorotherbusinessinvolvedintheacquisition,possession,manufacture,production,use,sale,distribution,dispensing,ortransportationofmarijuanaorrelatedparaphernaliathatisnotlawfulunderthestatecriminallawsand/ortheMunicipalCode.3
