TownBoard,October13,2009(#34)GoodEvening,Atourlastmeetingmycommentswerebasedontheword‘beliefandtheabilityofpeopletomaintainabeliefwhenthefactswouldtellthemotherwise;andhowmaintainingafalsebeliefisnovirtueandwillonlyleadtopoordecisionsSuchisthecasewiththeschoolboardandtheirdecisiontosupporttheanti-EPURAvotecomingupinJanuary.Itisobviousfromfirsthandreportsanddirectcorrespondencethattheschoolboardsdecisionwasbasedonfalsebeliefs;whichmakenosensewhenconfrontedwiththefactsandwhatisreadilyobserved.Theanti-EPURApreacherswilltellusthatmostifnotalloftheimprovementsinEstesoverthelast27yearsareminimal,orwouldprobablyhavehappenedwithoutEPURA.SomewilladmitthatEPURAhasdonegoodthingsinthepastbutthatfutureimprovementsareeitherunnecessaryorwilljusthappeninthenaturalcourseofevents.Thisthinkingfliesinthefaceofrealitybutjustaswithreligion;peoplebelievewhattheywanttobelieve,regardlessofthefacts.Lastweek,intheOct.9issueoftheTrail,JonNicholasaccusedmeof”stffling”discussionwithmy“harshcomments”concerningtheschoolboardsdecisiononEPURA;whichisatypicaltacticinadebatewhenyouhavenocountertoyouropponent’sarguments.ButtoJon’sdefense,thetruthcanbeharsh,andstifling.forEPURAtosurvive,weneedtoconvincethevoterstobelieveinthetruthandnotthefalsedogmathey’vecometobelieve.Howdoweaccomplishthisdauntingtask?Well,basedonmysuccessoverthelastfouryears,Idon’thaveaclue.Peoplebelievewhattheywanttobelieveandweneedthemtowanttobelievewhatistrueandfactual.AllIcansayis;givethepeoplethetruthandmeethead-onanyfalsenegatives.WhentheSchoolboardsaysEPURAhasandwillcostthemrevenue,wesay;ohreally,showmehowthathappenswiththestatefillinginthevoid,andbytheway,howmuchtaxmoneynowcomesfromtheurbanrenewaldistrictandarethekidsenjoyingthenewschool?WhenthehospitalsaystheylostmoneybecauseofEPURA,wesay;ohreally,showushow.andbytheway,howdoyoulikeyournewbuildingsandgreatlyincreasedtaxbaseandrevenue?WhenthelibrarysaystheywereshortedbyEPURA,wesay:ohreally,showushowandbytheway,howdoyoulikeyournewbuildingwithallofitslandscapingandparking? BoardofTrustees—September22,2009—Page2B.Utilities,September10,2009:1.WoodChipper—AltecIndustries,$30,259—Budgeted.2.BucketTruck—AltecIndustries,$118,489—Budgeted.3.MeterDept.Jeep-PlymouthJeep,$18,578—Budgeted.4.EstesValleyPlanningCommissionMinutesAugust18,2009(acknowledgementonly).5.EstesValleyBoardofAdjustmentMinutesAugust4,2009(acknowledgementonly).Itwasmovedandseconded(Levine/Miller)toapprovetheconsentagenda,anditpassedunanimously.2.REPORTSANDDISCUSSIONITEMS:1.COFFEEROASTINGINCOZONINGDISTRICTDirectorJosephprovidedareviewofthecurtingoperationsofKindCoffeeat552WElkhornStafffindsnoevidencetosuggestthattherehavebeenanysignificantchangestothegeneralcharacteroftheoperationoverthepastthreeyearsTheAugust2009fieldinspectionbytheColoradoDepartmentofPublicHealthandEnvironmentdemonstratedtheroastingoperationcontinuestoadheretotheapplicableemissionstandardssetbytheStateandtheemissionspermitremainscurrentandactiveAllegationsofcurrentcodeviolationsatthelocationarewithoutsubstantiatedevidence.Severalconcernsoftheneighborhoodhavebeenaddressedbythebusinessowner,includingrunningtheafterburnerlonger,replacedexhaustfanwithswampcooler,raisedchimneystacktwice,increasedretailsquarefootageandaddedoutdoorseatingincreasedhoursopenscreeneddumpsterinstalledinteriorwindowstoblockodorandlimitroastingtimetoweekdays.AmyHamrick/OwnerofKindCoffeeLLCquestionedtheneedforthereport/reviewofherbusinessbecausetheaccessoryuseofcoffeeroastingatthelocationwasappealedtoandupheldstaff’sdecisionbytheBoardofTrusteesinFebruary2008.Shestatedherbusinesshasbeencooperativewithlocal,countyandstatedepartmentstoensurecompliancewithallzoningandstateregulations.Thepercentageofroastingoperationshasnotchangedsincetheappealhearinin2008.KindCoffeehasgonetogreatexpensetoattempttoalleviatetheneighborhood’sconcernsandhasnoguaranteethatadditionalequipmentwouldaddresstheirissues.KindCoffeeholdsafiveyearairqualitypermitforupto45,000poundsofcoffeeperyear,andlessthan30,000poundswasroastedin2008.Inordertoroasttheadditional15,000pounds,thirtyminuteswouldbeaddedtothedailyroastingoperations.CommentsopposedtotheroastingofcoffeewereheardfromBobandJudyAyresrrownCitizen,LindaFarrell/TownCitizen,MargaretScott/TownCitizen,andVerdBailey/TownCitizen.Thegaseousomissionsfromtheroastingareahealthconcernandthenoxiousgascanlingerforuptofourhoursafterroasting.Theroastingofcoffeeatthislocationhasbeenconductedasaprincipleuseandnotanaccessoryuse.Thebuildinghasbeenusedasanindustrialmanufacturingfacility.Noise,odorcontrolandfumesfromabusinessshouldbeconsideredduringthesightingofbusinessesandwasnotconsideredduringthestafflevelreviewforKindCoffee’sroastingfacility.RonNorris/TownCitizenspoketothechemistryofcoffeeroastingandthetoxiccompoundsreleased,andstatedtheventingofthematerialcancausehealthissues.Thecurrentstackconfigurationwouldnotalleviatetheissue.Hestatedsomeoftheconcernscouldbeaddressedthroughengineeringpractices. RECORDOFPROCEEDINGSTownBoardBudgetStudySession—October2,2009—Page2downthefundbalance;however,thefundcannotwithstandfurtherdecreasewithoutdroppingbelowthe30%fundbalance.TrusteeLevinequestionedtheneedtohaveafundbalancetwicetheexpendituresintheMedicalInsuranceFund.Thefundisrequiredbytheactuarialstudytomaintainabalancetosupportclaims.AsoflastyeartheTownhadapartiallyself-insuredmedicalplanandthefundwasbeingbuiltupwiththeintentionofhavingafully-insuredplaninthefuture.LastyeartheTownmovedtoafullyinsuredplan,andtherefore,thefundbalancewouldbedecreasingoverthenextfewyears.TheBoardrequestedstaffprovideanindustrystandardformedicalinsurancefundbalances.TrusteeMillerexpressedconcernwithcuttingemployeebenefitssuchastheTownChristmasparty.Hestatedasrevenuesbecomeavailableemployeebenefitsshouldbeaddedtothebudget.VEHICLEREPLACEMENTFUND.Theinternalservicesfundmaintainsafundbalanceforfuturevehiclepurchasesof$1.77millionattheendof2009.The2010budgetcontainsrevenuesof$505000andexpensesof$370,500topurchaseapolicecar,smallerstreetsweeper,Cushmantruck,twoL&Pvehicles,oneWaterdepartmenttruck,andatractor.Projectedpurchasesofreplacementvehiclesthrough2015demonstratethefundisfullyfundedandmaintainsahealthyfundbalance.TrusteeBlackhurstquestionedifthefundisoverfunded.Thefundincludesthedepreciationofthecurrentfleetwitha4%inflationrate.Currentlyvehiclesaremoreaffordable,andtherefore,thefundbalanceishealthy.Staffcontinuestoevaluatethefundandmakeadjustmentsasnecessarytomaintaintheappropriatefundbalance.AuxiliaryequipmentforvehiclesispaidforbythedepartmentusingtheequipmentandnottheVRF.Staffalsocontinuestoevaluatetheuseofalternativefuelvehicles.TrusteeBlackhurstquestionedwhatwouldbecomeofthebudgetedrevenuefromtheFireDepartmentifthedistrictpassesinNovember.Staffstatedthebudgetedrevenuewouldnotberealizedandthevehicleswouldbetransferredtothedistrict.INFORMATIONSYSTEMSTECHNOLOGYFUND.Theinternalservicefundwasformedin2007tomanageTownwideinformationsystemsincludingtechnicalsupport,maintenance,security,phonesupport,audio-visualsupportandGISservicesTown-wide.Eachdepartmentpaysafeebasedontheequipmentthedepartmentutilizes(167laptopsandcomputers,24servers,221audioandvideocomponents,4,000+instancesofsoftwareand1,321telephonecomponents).Thephonemaintenancefeepaysforthemaintenancecontract($68822)ofthecurrentphonesystemandthefuturepurchaseofareplacementsystem($30,000).Nofundshavebeenbudgetedin2010forimprovementstotheBoardRoom’sAVsystems;however,$40,000wouldbespentin2009tocapturemeetingsdigitally.MayorPinkhamcalledabreakat10:05am.andreconvenedthemeetingat10:20am.LIGHTANDPOWERFUND.A$6millionbondwasissuedtopayforanewsubstationanddistributionupgradestoincreasereliabilityandcreateredundancy.Thebond,andfutureupgrades,willbepaidforwithrateincreaseoversixyearsbeginningin2008.Afinancialplanwouldbecompletedfor2011—2013todeterminethenewrates.Otherprojectsfor2010includearatestudytodeterminethetruecostofservicespercustomerclass;completionofdistributionimprovementsforBeaverPoint,PeakViewandFishCreek;increasedtreetrimmingduetobarkbeetleinfestationandfiremitigationintheForestalongpowerlines.Thefundbalancedecreasesin2010to$4.37millionwithongoingimprovementstothesubstationdistribution.Thesourceofsupplyexpenseincreasesin2010by6.2%withanincreaseinwholesaleratesfromPRPA.TheTown’swholesaleratefromPlatteRiver
