EstesParkTownBoardMeeting06-23-09Goodevening,WatchingtheeventsinIranoveranelectiondictatedbytherulingclergymakesonemarvelatthewisdomofourfoundingfatherswhoinsistedonaseparationofchurchandstate.Uncheckedpowercorrupts,uncheckedpowerclaimedtohavecomefromGodisdoublycorruptiveanddoublyhardtounseat.Aren’tweluckyinthiscountrytobefreefromthecorruptiveinfluencesofthoseclaimingamoralmajority?Aren’tweluckynottohaveourgovernmentcontrolledbythelikesofAlSharpton,PatRobertson,theDobsonboysoranyofahostofothercharlatansclaimingtohavetheearofgod?AlsoexposedinIranistheexistenceofanorganizedmilitiaormoralspolicewhowandertheircommunitiesinsearchofthosewhowouldviolateIslamiclaw.WomenwhosedresstheydeemimmodestriskphysicalpunishmentfromthisbandofthugsblessedbytheAyatollahs.Menwhodon’tattendprayersareshunnedandanatheistcouldbebeatenandcertainlybarredfromholdingpublicoffice.Again,aren’tweluckythatinthiscountrythosekindsofthingswouldneverhappen?Weinthiscountryaretolerantofdifferingreligiousopinionsandwouldneveruseaperson’sreligioussensitivitytoarousethemobandremovehimfrompublicoffice.WeinthiscountrywouldneverbringagodintoourseculargovernmentalftmctionsoraskthoseinattendancetoreciteapatrioticoathwhichacknowledgesthemajorityGod.I’msurewe’rebetterthanthat,ormaybeweonlythinkweare.AgainIaskthatyoustoprecitingthe‘underGod’Pledgeuntilcongresshasthewisdomtochangeit.Thankyou,DavidHabecker

RECORDOFPROCEEDINGSTownBoardStudySession—June9,2009—Page2TrusteeEisenlauervoicedconcernoftheLMDassumingcontroloftheVisitorsCenterandtheeffectontheAmbassadors.TrusteesEisenlauerandLevinecommentedtheLMDshouldconsidertakingonasmallerroleandassumeotherfunctionsofCVBovertime.TheLMDBoardstatedthefunctionoftheAmbassadorswouldnotchangeundertheLMD.TrusteeMillerquestionedhowthecallcenterfitsintothedaytodayoperationsofmarketingthecommunity.HestatedthecallcentershouldremainwiththeCVB.TheCVBhasprovenmarketingmethods,justifiedbytheincreaseinsalestax.HetooexpressedconcerntheLMDmaybetakingonmorethanitshouldatthistime.TheTownBoardhasstatedsupportoftheCVBstaffforthefirstfiveyeartermoftheIGA,andmarketingfundspreviouslyspentbytheTownwouldbeusedforfutureinfrastructureprojects.TheLMDBoardstatedtheCVBteamcurrentlyinplaceworkswelltogetherandseparatingoutaportionoftheteamcouldimpedetheoperationsasawhole.TheLMDneedsthesupportoftheTown,includingstaffingandcontinuedfunding,tomaintainthemethodsusedbytheCVBandenhancemarketingefforts.4.TrusteeHomeierexpressedconcernwiththeLMD’srequesttoassumeaTowndepartment.HestatetheLMDBoardwasappointedtomanagethe2%taxanddevelopanadvertisingandmarketingplan.Anon-electedbodyshouldnotbegiventheoperationsandassetsofanelectedbody,andsuggestedtheLMDhireTownpersonneltoperformtheneededadvertisingandmarketingtasks.MayorProTernLevinestatedadditionalfundingabovethestaffingcommitmentcouldnotbeguaranteed.AdministratorHalburntvoicedconcernwiththeTownpayingforandmanagingstaffthatreportstotheLMD.ShestatedanointingoneofthecurrentCVBstafftoLMDDirectorinadditiontotheirdailytaskswouldnotworkandwouldrequiretheTowntohireadditionalstaff.ShesuggestedtheLMDconsiderhiringaseparateLMDDirector.DirectorPickeringcommentedtheCVBstaffworkswelltogetherandappointingastaffmemberasLMDDirectorwouldallowtheteamtooperatecohesively.HestatedgroupsalesistheonlypositionthatmaybedividedamongsttheTownandLMD,thereforerequiringtheneedforanadditionalstaffmember.TheTownBoardwouldholdaspecialmeetingtodiscussquestionsraisedandprovidefurtherdirectionfortheLMDBoardastheydevelopthe2010OperatingPlan.-WhatpersonnelcostswillbesupportedbytheTown,i.e.staffingclarification?-WhatfunctionoftheCVBwouldremainwiththeTown,i.e.VisitorsCenter?-WouldtheTownconsideracostsharingofthestakeholderfeesforadditionalmarketing?Therebeingnofurtherbusiness,MayorPinkhamadjournedthemeetingat6:27p.m.JackieWilliamson,TownClerk

RECORDOFPROCEEDINGSEstesValleyPlanningCommission2May19,2009limitationsthanB&Bsastowhatactivitiescanoccurontheproperty.ThisproposalmovessomeoftheregulationsfromtheMunicipalCodeintotheEstesValleyDevelopmentCode.Afterlastmonth’smeetingandattherequestofthePlanningCommission,PlannerChilcottmadeonechangeonpage4oftheproposedcode,exemptingtheCD—CommercialDowntownzoningdistrictfromthe“residentialcharacter”clauseinSection5.1.B.1.d1.Vacationhomesareproposedtobeaprincipaluseinallresidentialdistrictsratherthanthecurrentaccessoryuse.PlannerChilcottcommentedshedidnotthinkitwasTownBoardsintentiontorequirecompliancewithadequatepublicfacilitiesregulations(rights-of-way,firehydrants,etc)inordertohaveavacationhome.Therefore,languageneedstobewrittentoexemptvacationhomesfromthisrequirement.DirectorJosephexplainedtheconceptofthevacationhomeuseallowance,alongwithlimitationsonthenumberofpeopleallowedtostayinonehomeisgearedtobeinlinewithsingle-familyuse,whichwouldnotchangethedemandonwater,sewer,etc.TownAttorneyWhiterespondedtoquestionsaboutpropertytaxesonthesedwellings,statingTownBoardacceptsthefactthattherewillbesomeinequitiesduetotheGallagherAmendment.AttorneyWhitealsonotedthattheTowndoestrytoleveltheplayingfieldbetweenvacationhomesandcommercialaccommodationspropertiesbychargingcommercialutility(waterandelectricity)ratesforvacationhomes.PublicComment:CindyOliverITownResidentownsaseven-bedroomhomeandwouldliketobeabletorentittomorethanthemaximumlimitofeightindividuals.DirectorJosephnotedthisportionofthecodeistoprovidefortheusewhileprotectingthecompatibilitywiththeneighborhood.Ifthisregulationistoopermissive,theintegrityoftheentireprogramisatrisk.Thisnumberhasbeeninplaceforquitesometime.AccordingtotheU.S.census,theaverageoccupancyintheEstesParkareais2.25peopleperdwelling.FrankTheis/CountyResident/B&BOwnerwouldliketoseetheoccupancylimitationsbethesameasthesingle-familyhouseholddefinitionofeightunrelatedindividualsorunlimitednumberofrelatedindividuals.BillEllzeylrownResident/B&BOwnerisconcernedthisproposalwouldlimithisabilitytorenttomorethanonefamilyatthesametime,andaskedforclarificationaboutgrandfathering.PlannerChilcoffnotedhisbusinesswouldbegrandfatheredin,andaslongasitcontinuestobeaBed&Breakfast,thecurrentusecouldcontinue.Ifhestoppedtheusefor12monthsormore,thegrandfatheringwouldbenullandvoid.Closedpubliccomment.CommissionerTuckernotedthereisademandforvacationhomesandB&Bs,andfeelswearedoingharmtotheoverallcommunityofEstesParkifwedonotallowthiscodechange.Hestatedtheseregulationsarebeingimplementedtominimizetheimpactinsingle-familyneighborhoods.Itwasmovedandseconded(Norris!Hull)toAPPROVEtheproposedBlock12AmendmentstotheEstesValleyDevelopmentCoderegardingShort-TermRentals,withstaffauthorizedtorevisethedraftcodelanguagetoaddanexemptionstatingavacationhomeclassificationdoesnottriggerthepropertyownertomakeimprovementstoexistingadequatepublicfacilities.Themotionpassedunanimouslywithtwoabsent.4.DEVELOPMENTPLAN6-OlE—THEMEADOWREPLATANDPRELIMINARYCONDOMINIUMMAP&MARY’SMEADOWAMENDEDDEVELOPMENTPLAN—Lot4A,Mary’sLakeReplatofMary’sLakeSubdivision—341KiowaDriveStaffReport:PlannerShirkstatedthisisarequesttoamendtheexistingapproveddevelopmentplan,amendanexistingsubdivisionplat,tosubdividetwoexistinglotsintofourlots(threebuildableandonenon-buildableoutlot),andsubmissionofapreliminarycondominiummap.Theexisting35-unitplanwasapprovedbythePlanningCommissioninApril2006,withaminormodificationapprovedatthestafflevelinFebruary,2009.The
RECORDOFPROCEEDINGSEstesValleyPlanningCommission3May19,2009currentrequestistoamendthisdevelopmentplanbyseparatingintotwolots,addelevenmoreunits,andadjusttheboundarylinewiththeundevelopedlottothenorth.Thedrainagefacilitieswouldbeputinanon-buildableoutlot,withajointmaintenanceagreement.Becausetheissuesofthisproposalareallinter-related,thereportwilloutlineallthreerequests,concludingwiththreeseparaterecommendations.PlannerShirkcontinuedbystatingLot2A,thenorthernmostlot,hasnodevelopmentcurrentlyproposedalthoughthepropertyiszonedA—Accommodations.Lot4A,themiddlelot,isproposedforshort-termaccommodationsuse(lessthan30days),withpropertymanagementoperatedthroughPonderosaLodge.Lot4B,thesouthernlot,isproposedformulti-familyresidential.Thisdoesnotprecludeshort-termornightlyrentals.DirectorJosephcommentedthisproposalisreallocatingthesameallowabledensityastheapprovedplan.Thedensityhasnotbeenexpanded,onlyreconfigured.TheDevelopmentCodeencouragesopenspaceoutlotstoprotectthenaturalcharacterofthearea.Oneofthetrade-offsinprotectingthelowerpartofthemeadowistoaddsomedensitytotheotherportionsofthelots.PlannerShirkclarifiedthiscurrenttransferindensitytakessomeofthedensityawayfromtheexistingsingle-familydwellingsandmovesitclosertothechurchwheretheneighborswillnotbeasstronglyaffected.Thisparticularoutlotisproposedtobethestormwaterdrainagearea.PlannerShirkisrecommendingthefollowingstatementbeaddedontheplat:‘OutlotAlandareashallbeappliedtoLot2Afordensitycalculationpurposes.Maximumdensityisnotguaranteed.”PlannerShirkbrieflydiscussedthestaff-levelminormodificationwheretheformerquadunitswerechangedtoduplexes.Thecurrentproposalrequestsremovingthecommunitybuildingonthesouthwestcornerandaddinganotherduplexinitsplace.Also,removethesingle-familydwellingsandtheduplexesfromthelowerpartofthemeadowandconstructbuildfour9-unitbuildingsonthewestsideofthelot.Architecturalplansindicatealimitedkitchen,whichisanalloweduse.PlannerShirknoted36accommodationsunitsareproposedforLot4A,whichislessthanthe39allowedforthenetlandareainvolved.Itisanincreasefromtheoriginaldevelopmentplan.ConcerningLot4B,10duplexunitsareproposedonanareawhereamaximumof12unitswouldbeallowed.AccordingtoPlannerShirk,thisproposalcomplieswithimperviouscoveragelimits,aswellastheprovisionforpedestrianlinkages.Thisnewplanislessfragmented,whichhasbenefits.Theparkingstallshaveproposedcurbsinsteadofwheelstops,whichwilltakeupsomeofthesidewalkspace.Aminormodificationtothecoderequirementisbeingrequestedbytheapplicantwhichwillresultinan6.5foot-widesidewalk.Straightinparkingisplannedinordertoallowtrafficfrombothdirections.PlannerShirkreviewedthefloorplans,whichincludeddiscussionaboutbuildingheight.Alsodiscussedwassitedisturbance,particularlyinwhatsomepeoplebelievetobeawetlandsarea.PlannerShirkpointedouttherearethreeconditionsforwetlands—soiltype,water,andvegetation.Themeadowontheeastsidedidnothavewetlandssoil.Itwasdeclassifiedafteraninvestigationbyawetlandsconsultant.Concerningthepreliminarycondominiummap,PlannerShirknoteditisStaff’sopinionthesubdivisionreviewanddevelopmentplanreviewcombinetoprovideadequatereviewofthepreliminarycondominiummap.Afinalcondominiummapwouldbesubmittedwhenatleastoneunitissubstantiallycomplete.PlannerShirkindicatedtheproposedLimitsofDisturbancemeetthecriteriarequired.PlannerShirkstatedtherehasbeensomeinterestandconcernfromadjacentpropertyownersinthearea,whichhasbeenincludedinthereadingmaterials.Theconcernsvaryfromincreaseindensitytoexteriormaterialsbeingused.Othersareconcernedaboutwindturbinesandsolarpanelsbeingproposedandinstalled.Otherconcernsmentionedheight,blockedviews,andachangeincharacteroftheneighborhoodbyallowingshort-termresidents.
