TownBoardMeeting,May26,2009(#26)Goodevening,Therehasbeenanongoingargumentovertheinfluenceofreligioninourmilitary,andinparticulartheproselytizingdonebyChristianfundamentalistsatourmilitaryacademiesandinMuslimwarzones.Recently,PentagonintelligencebriefingsfromDonaldRumsfeldtoPresidentBushwererevealedshowingBiblicalpassagesprintedonthefrontcovertogivereligiousexhortationstoouractionsinIraq.TheuseofreligioninthismannerpromptedJamesCarrolloftheBostonGlobetoraisethequestion;“Whatinheaven(or,whatthehell)isgoingoninsidetheUSmilitary?”TowhichIask;isn’tthisjustalogicalextensionoftheideaofbeinganationunderGodtoanationsentbyGodtowageholywar?Mr.CarrolllistssevenreasonswhyweshouldbeappalledandalarmedattheinfluenceofanextremekindofChristianevangelicalisminourmilitary.ForbrevityandbecauseIthinkthisinfluenceextendsintoallareasofoursociety,IhavemodifiedandparaphrasedhiswordstoincludeallAmericans.1.Single-mindedreligiousZealotrybedevilscriticalthinking,andnotjustaboutreligion.Militaryandpoliticalthinkingsufferswhentherighteousnessofborn-againfaithleadstoself-righteousness.2.MilitaryandpoliticalproselytizersuseJesustobuildupcohesionbyeradicatingdoubtaboutthemission,thecommand,andtheself.Withoutdoubtyoulosethecapacityforsecondthoughtsandskepticismwhichinhindsightwassorelyneeded.3.Religiondefmingtheafterlifeasultimatecanundervaluethepresentlife.Religionthatlooksforwardtoapocalypse,God’skingdomestablishedbycosmicviolence,canhelpignitesuchviolence.Armageddon,nomeremetaphornow,isthenucleararsenal.4.Religiousfundamentalismaffirmsideasapartfromthecontextthatproducedthem,readingtheBibleliterallyordogmaahistorically.Theseideasnegatethebeliefsofothersthusdenyingthecontextfromwhichthreatsarise—refusingtoask,forexample,whatpromptssomanyinsurgentstobecomewillingsuicides?Missingthis,wekeepproducingmore.5.AcountrythatseesitselfasdivinelycommissionedcanalltooreadilyactlikeGodinbaffle—usingmortalforcefromafar,withoutpersonalinvolvement.AnOlympianaloofnessmakesAmerica’snewdroneweapontheperfectslayerofcivilians.6.Abifurcatedreligiousimagination,dividingtheworldbetweengoodandevil,canmisreadtherealcharacterofan“enemy”population,manyofwhomwantnopartofwarwithus. 7.TheMiddleEastistheworstplaceinwhichtosetlooseamilitaryforceevenpartlyinformedbyChristianZionism,seeingthestateofIsraelasGod’sinstrumentforusheringintheMessianicAge—damningMuslims,whiledefendingJewsforthesakeoftheireventualdestruction.Mr.Carrollconcludeswith:“ThePentagonisthewrongplaceforunboundChristianZealotry,notjustbecauseitviolatestheseparationofchurchandstate(andtherightsofnon-believersinthechainofcommand),butevenmorebecauseitisinimicaltotheprudentuseofforce.WhenthehistoryofAmerica’sfailureinfraq,andnowAfghanistan,iswritten,expecttofmdthatUSmilitarydecisionmakingwasmadeblindbyfaith.”Sowhathasthistodowithourmeetingtonight?Nothing!Unless,ofcourse,youconsiderthatwithyourassertionthatweareanation‘underGod,’youbecomeanenablerofthesedestructivebeliefsandbehavior.IrecentlyheardaninterviewwithC.WeltonGaddywhoisaBaptistministerandPresidentoftheInterfaithAlliance,whosaidthattheuseofthoseBiblicalpassagesonthePentagonbriefmgswasaprostitutionofreligionandusingreligionforpoliticalpurposesistakingthenameofGodinvain.Usingreligionforpoliticalpurposes,likeinsertingthewords‘underGod’inapatrioticoath,isthesameastakingyourLord’snameinvain!Ibelievethat’sCommandmentnumberthree.Previously,IshowedhowthewordGodinthePledgereferredtomanyGods,whichbrokeCommandmentnumberone.YoujustbroketwoCommandmentsintwentyseconds;kindoflikekillingabanktellerinthecommissionofarobbery.Bottomlineisthis:everytimethemayorasksustoriseandrecitethePledge,heisputtingeveryoneinthiscommunityatriskofspendingeternityinalakeoffireandbrimstonewithme.SoIagainaskthatyoustoprecitingthePledgeuntilourUnitedStatesCongressremovesthesinfuluseofGodforpoliticalpurposes.Astrictseparationofchurchandstateisineveryone’sbestinterest.ThankyoDavidHabecker BoardofTrustees—May12,2009—Page32.PUBLICHEARING:NEWBEER&WINELIQUORLICENSEAPPLICATIONFILEDBYLDSMHOLDINGS,LLCDBAWINGSWEST,861MORAINEAVE.MayorPinkhamopenedthePublicHearingandreviewedtheprocedures.TownClerkWilliamsonpresentedtheapplicationandconfirmedtheTownhasnotreceivedanycommunicationsorevidenceinsupportoroppositiontotheapplication,andrequitedTIPS.traininghasbeencompleted.MayorProTernLevineencouragedtheapplicanttobevigilantoncheckingidentificationpriortoselling/servingalcoholandthattheBoardtakesveryseriouslytheoperationofliquorlicensesandtheLiquorCode.Therebeingnofurthertestimony,MayorProTernLevineclosedthePublicHearing.StatingtheBoardofTrusteesfindsthatthereasonablerequirementsoftheneighborhoodarenotmetbythepresentliquoroutletsintheneighborhoodandthatthedesiresoftheadultinhabitantsareforthegrantingofthisliquorlicense,itwasmovedandseconded(Levine/Blackhurst)theBeer&WineLiquorLicenseapplicationfiledbyJDSMHoldings,LLCdbaWINGSWESTbeapproved,anditpassedunanimously4ACTIONITEMS1.RE-APPOINTMENT—ESTESPARKHOUSINGAUTHORITY.MayorPinkhamstatedtheEPHApostedthepositionandnoapplicationswerereceived,andtherefore,theBoardofDirectorsvotedunanimouslytoapprovethere-appointmentofKarlaPorter.Itwasmovedandseconded(BlackhursULevine)toapprovethere-appointmentofKarlaPortertotheEstesParkHousingAuthorityfora5-yeartermexpiringonMay12,2014,anditpassedunanimously.2.STANLEYPARKFAIRGR%J’ESlGNGUIDELINES.DirectorZurnstatedwiththedeveIopmentoftheStanleyParkFairgrounds,theTownBoardhadexpressedaneedforthedevelopmentofdesignguidelinesinanefforttoprovideacomplimentarydesignandconsistentappearanceforallstructuresontheproperty.ThorpAssociates,Inc.washiredtodevelopthedesigncriteriaMrThorpreviewedthecriterionthatincludesbuildingmaterialscolorsandgeneraldesignissuesierooftypeeavesscreeningmechanicalandutilityequipment,variedfacades,andmasonrywainscotingmatrial.Thecolorsusedintheguidelinesincludegreensandbrownsthatreflehemaincharacterofthecommunity.TrusteeHomeiercomentedthegeneralrequirementsonpage3ofthedesigncriteriaaretoospecificanddonotallowforcreativity.Hestatedthispageshouldbeeliminatedandthatmanyoftheissuesoutlinedarerequiredbythebuildingcode.Allusesoftheword“shall”onpage3ofthedocumentshouldberemoved.Healsoquestionedthemeaningofanarchitecturalcharacterthatimbuesatimeless,naturalRockyMountaincharacter.Mr.Thorpstatedtherequirementsprovidethearchitectwithabeginningpointforthedesignofthebuildingandremoving‘shall”fromthedocumentwouldnotchangetheintent.TrusteeMilleragreedwithTrusteeHomeierwithregardtotheuseofthewordushallandalsorequestedtheremovalofthestatement“refinedRockyMountainrustic”becauseitistoolimiting.HequestionedtheneedtolimitthepitchoftheroofandtheinclusionofthepicturesusedtocategorizeColoradocharacter.Afterfurtherdiscussion,itwasmovedandseconded(Blackhurst/Levine)toapprovethedesignguidelinesaspresentedfortheStanleyParkFairgroundswith1)theremovalofthewordshallfromItem6onpage3,and2)clarificationof“RockyMountaincharacter”atthediscretionofMr. BoardofTrustees—May12,2009—Page4ThorpandDirectorZurn,anditpassedwithTrusteesHomierandMillervoting“No”.3.RESOLUTION#12-09—APPROVALOFCDOTENHANCEMENTCONTRACT—FALLRIVERTRAILPHASE4B.DirectorZurnstatedtheTownhaspreliminaryapprovaltoreceive$140,000inenhancementmoneyfromtheFederalStimulusBill.ThesefundswouldbeusedfortheconstructionofFallRiverTrailPhase4B.TheResolutionwouldapprovethecontractwithCDOTandauthorizetheexpenditureof2009budgetedTownfundsof$150,000fromtheLarimerCountyOpenSpacefund(#220-4600-462-35-60)fortheconstruction.Theprojectwouldcompleteanadditional1,400feetoftrail.Itwasmovedandseconded(Levine/Millet)toapproveResolution12-09,anditpassedunanimously.4.RESOLUTION#13-09—APPROVALOFALTERNATIVETRANSPORTATIONINTHEPARKANDPUBLICLANDSGRANT—ASSESSMENTANDNEEDSSTUDYFORMASSTRANSITIPARKINGSYSTEM.DirectorZutnstatedtheTownappliedforagrantthroughRockyMountainNationalParkforanassessmentandneedsstudyonamasstransit/parkingsystemTheParkwasawardeda$200000grantthatwouldbematchedwith$10000fromtheParkand$40000fromtheTownResolution1309authorizestheTownsacceptanceoftheATPPLgrantandmatchingTowncontribution.TheRFPprocesstoselectavendorwöbldfollowfederalguidelinesandthestudywouldtake12to18monthstocompleteItwasmovedandseconded(Miller/Ericson)toapproveResolution13-09withtheadditionofthedesignatedrecipientlanguagetoItemIoftheResolutionanditpassedunanii5.Pinkham,Mayor RECORDOFPROCEEDINGSTownofEstesPark,LarimerCounty,Colorado,May12,2009MinutesofaRegularmeetingoftheTOWNBOARDSTUDYSESSIONoftheTownofEstesPark,LarimerCounty,Colorado.MeetingheldatTownHallinRooms202&203insaidTownofEstesParkonthej2thdayofMay,2009.Board:MayorPinkham,MayorProTernLevine,TrusteesBlackhurst,Eisenlauer,Ericson,HomelerandMillerAttending:AllAlsoAttending:TownAdministratorHalburnt,DeputyTownAdministratorRichardson,TownAttorneyWhite,ChiefDorman,DirectorJoseph,ChiefBuildingOfficialBirchfield,andTownClerkWilliamsonAbsent:NoneMayorPinkhamcalledthemeetingtoorderat5:00p.m.FIRECODE.TownAdministratorHalburntstatedtheTownhasbeguntheprocesstoupdatethebuildingcodeslaterthisyear,andwithoutaFireCodeinplacetheTownwouldhavetoadoptlocalamendmentstothebuildingcodes.ChiefDormanpresentedtheBoardwithabriefhistoryofmajorfiresthataidedinthedevelopmentoftheFireCode,whichisamaintenancecode.AsurveyconductedfoundthatmostmountaincommunitiesandcommunitiesthesamesizeasEstesParkhaveadoptedaFireCode.TheproassociatedwiththeadoptionofaFireCodeinclude:publicsafety,identifypotentialhazards,ireducetherisktothegeneralpublicandfirefighters,reductioninpropertyloss,ensure,fireprotectionsystemsaremaintained,allowforpre-incidentplanning,creditonISOsurveyandprotecttheeconomyoftheTown.ConverselytheconsrelatedtotheadoptionofaFireCodeinclude:overcomingthefearfactor,costsforcompliance,costsforenforcement,morerequirementsfromgovernment.ChiefDormanoutlinedthefollowingreasonsfortheadoptionofafirecode:currentlackofauthoritybytheFireDepartmenttoperforminspections,numberofoldbuildingsinthedowntownbusinessdistrict,unsafepractices,blockedexits,lackoffiresafetyeducation,explosivesandfireworksstorageanddisplay,andstorageoruseofhazardousmaterials.Hestatedthereareelementsofthefirecodethatwouldrequirelocalamendments,suchaseliminatingtherequirementforresidentialsprinklers.Enforcementofthefirecodewouldbethrougheducationandcompliancechecks.Ifadopted,staffwouldrecommendanextendedtimeframe,20years,forpropertyownerstoaddressmajorrepairsorimprovementstobringthepropertyintocompliance.Boardquestionsandcommentsaresummarized:whyadoptafirecodepriortotheupcomingfiredistrictelectioninNovember;cansectionsofthefirecodebeadopted;howwouldatransitionperiodworktobringthebuildingsuptocode;andconcernedthenewinspectionrequirementswouldrequireanadditionalFTE.ChiefDormanstatediftheTownadoptedtheFireCodeitwouldrequiretheCountyandtheproposedfiredistricttoadoptthecode.TheTownandCountycanadoptsectionsofthecode.Compliancecheckswouldbecompletedonhighrisk/highpropertylossbuildingsfirsttoaddressmajorissuesandprovidethepropertyownerwithatimeframetocomplete.Allbuildingwouldnotbeinspectedthefirstyear;however,asbuildingscomeintocomplianceannualcheckscouldbecompleted.ManyofthesystemswouldbeinspectedbyprivatecompaniesandnotrequireTownorFirepersonnelstafftime. RECORDOFPROCEEDINGSEstesValleyPlanningCommission5April21,2009Itwasmovedandseconded(Norris/Fraundorf)toCONTINUEtheproposedBlock12AmendmentstotheEstesValleyDevelopmentCoderegardingShort-TermRentalstothenextregularlyscheduledPlanningCommissionmeeting.Itwasrequestedthisitembethefirstontheagenda.Themotionpassedunanimouslywithtwoabsent.b.WILDLIFEHABITATPROTECTION—proposedchangesto§7.8WildlifeHabitatProtection,toprovidereviewstandardsforlandidentifiedascriticalwildlifehabitat,requirepreparationofawildlifehabitatconservationplanforlandidentifiedascriticalwildlifehabitat,andprovideforPlanningCommissionreviewofsaidconservationplan.StaffReport:DirectorJosephgaveabriefhistoryofthecoderevisionbackground.Intoday’sproposedCoderevision,Staffhasremovedanyreferencestosetbacksfromriparianvegetationandkeptlanguageconcerningsetbacksfromaquatichabitat,i.e.wetlands,streams,rivers,andstandingbodiesofwater,includingseasonal.Staffisproposinga50-footsetbackfromtheannualhighwatermark(notfromriparianvegetation)forundevelopedlotsanda30-footsetbackfordevelopedlotswhichweredevelopedpriorto2000.Differentstandardsapplytodowntownareasandalsoforparkinglotsasopposedtobuildings.ThecurrentCodeoperatesasatwo-tieredsystem,andtoday’sproposalabandonsoneofthetiers;thecurrent30-footsetbackforsmallerdrainageswouldberemovedandallareascontainingaquatichabitatwouldhavea50-footsetback.Wetlandsareasetbacksarecurrently50feetandnochangesareproposed.Studiesshowaproportionaterelationshipbetweentheamountofwaterflowingthroughadrainageanditsvalueashabitat.Thecurrentproposalworkswitha“onesizefitsall”concept.Iftheproposedsetbacksareadopted,thenumberofnon-conformingpropertieswillapproximatelydouble,creatingalotofdiscussionandconcern.Inresponse,Staffhaswrittenintothecodewhereasexistingnon-conformingdevelopedpropertiesthataresetbackatleast30-feetwouldbeallowedtoexpandverticallyandbeexemptfromthe50-footsetback.Anyhorizontalexpansionofthesenewnon-conformingstructureswouldbesubjecttothe50-footsetbackregulations.StaffandCommissionDiscussion:DirectorJosephcommentedthatasuggestionwasmadetoaddmitigationrecommendationsfollowingthehabitatassessment.Also,therighttodenyadevelopmentplanthatdoesnotcomplywiththeCodeisclearlystated;however,PlanningCommissionwillhavetheauthoritytocontinueanagendaitemifthedevelopmentplandoesnotcomplywiththeCodetoallowthedevelopertimetomakenecessarymodifications.DirectorJosephclarifiedthatinurbanizedareas,thevalueofthehabitathasalreadybeencompromisedand,therefore,thoseareaswillnotbedesignatedasseverewinterrangefordeerandelk.CommissionerNorriswouldlikeabetterunderstandingofpropertyowner’srightsandguidanceastohowtojudgethesetbacks.PublicComment:RickSpowart/ColoradoDivisionofWildlife(DOW)thinksthechangeintheCodelanguagehelpstheDOWactasanadvisorratherthanadecision-makingbody.DOWwillbecomeanaffectedagencythatwillbeallowedtocommentonproposeddevelopments.ItisDOW’sopinionthataquaticareasarethemostimportanttoprotect,withraptornestingareasandbighornsheephabitatalsohavingmajorsignificance.Mr.Spowartbelievessmallersetbackscancreatelossofwildlifepopulationsandspeciesforthoseanimalsthatarenotverymobile.Severalspecies,likeelk,areveryadaptableandinsomewaysactuallybenefitfromdevelopment.HenotedthatvariousmapsandotherinformationisavailableontheDivisionofWildlifewebsite.CheriPettyjohnlTownResidentbelievesallaffectedpropertyownersshouldbenotifiedbypersonalletter.Sheisagainstchangingthesetbackfrom30to50feet.Ms.Pettyjohnalso COMMENTSONFINANCIALSTATEMENTS/ATTACHEDSLIDESOverviewcommentsontheeconomyslidesarerelativelyself-explanatoryandwillbereviewedattheTownBoardmeeting.Commentsregardingthe“FinancialIndicators”slideareasfollows.TheGeneralFundboxreportsrevenuesat11.5%ofbudget.Firstquartersalestaxforthepastfiveyearshasaveraged12.8%oftheeventualrevenuetotal.Weareat12.5%ofbudget,sowearewithinrangeforourbudgettarget.“Other”revenuesarelaggingsomewhat,duetoseveralgrantsandfranchisefeesnotyethavingbeenreceived(timingissues).Asthefirstquarterofthecalendaryeariscomplete,thereferencepointforexpensesisthe25%level.“Generalgovernment”expendituresareat30%becausethesubsidies(1900account)arefulfilledinthefirstquarter.The“engineering”and“culture/recreation”categoriesareaheadofbudgetbecauseofseasonalityandduetomostcapitalprojectshavingnotyetbegun.Transfersaresomewhatbetterthanbudgetduetotiming.StSalesTaxforthe1quarterof2009trailsbudgetby1.3%and2008by2.0%.AssalestaxisdowndoubledigitsinSkiCountry,wemightconsiderourselvesfortunatetobeinthepositioninwhichwefindourselves.Wemayalsohavebenefitedfromtheworst(atleastsofar)oftheeconomiccrisishavingoccurredduringourslowsalestaxperiod.TheEnterpriseFundsboxreportsutilityrevenuesat26%ofbudget.Otherrevenuesourcesarelaggingduetoseasonalityandperhapseconomicconditions.Expenditures,withtheexceptionoftransfers(duetorevenuesexceedingbudget),arewellbelowthe25%level.Utilityrevenues,expenditures,andcapitalactivitiesaremonitoredindetailintheUtilityCommitteemeetings,heldthe2dThursdayofeachmonth.The$7.9mMarysLakeWaterTreatmentPlantupgradeprojectiscurrentlybuiltoutatapproximately60%.Theremaining$1.9minthebondholdingaccount(seeinvestments)willbeappliedtotheDistributionSystemImprovementsprojectbeginningthisfall.TheInvestmentsboxshowsinvestmentsbytypeoffund.Thepensionfundsaremanagedbyathirdparty(actually,onlytheFirePensionismanagedbyathirdparty,butaccountsforover99%ofthePensionFunds’assets).EPURAinvestmentsresideinaColoTrustmoneymarketaccountandarenotmingledwithTowninvestments.EPURAhasanadditional$900,000residingatAmericanBankthatwasbeingheldinreserveinlieuoffinalbondpaymentreconciliations—thisamountwillbetransferredtoColoirustwhenreconciled(completedin1stquarter2009).Thebondissuanceislistedseparatelyduetoitssize.Benchmarkindicatorsaswellastheprevailingmoneymarketfundratehavebeenaddedforreference.Althoughthemarketshavemadeadramaticchargesincemid-March,itisunknownastowhetherthisportendsanewbullmarket,ormerelyareliefrally.Wecontinuetomanageourreservesinthefollowingpriorityorder:safety—liquidity—yield.•Page2 SALESTAXDETAILSSeveralslidesareattachedtoprovidedetailsonsalestaxprogress.Staffemploysseveraldifferentformulae/predictivetoolsforforecastingsalestax.Theformulaethatutilize1stquartersalestaxhavealargemarginforerrorbecause15tquartersalestaxisonly12-13.3%ofthefiscalyear.Whilethatseemslikeatightband,ityieldsapredictedrangeof$6.$m-7.5minsalestax(see,,1stsalestaxvsAnnualtotals”slide).Becauseofthisdisparity,staffalsoemploysseveralpredictorsthatincorporatealongerhorizonofhistoricdata.Themostaccurateoftheseindicatorspredict2009salestaxlevelsbetween$7.14-7.17m.Thiswouldresultinanannualizedsalestaxshortfallof$80-110,000(approximately2%).The“salestaxratesofchange”sliderelaystwoimportantpoints.One,thebluelineisthe12-monthmovingaverage(MA)ofsalestaxrevenuesbymonth.Thenumberhasbeenbasicallyflatforaboutayearandisrestingrightonthetrendline.Themaroonlinereportstherateofchangeona12-monthMArate.Currentlytherateis-1.71%,whichisnotgood(wewanttheratetoalwaysbepositive).However,onecanseethattherateofchangeseemstobouncewhenitgetstoabout-1.75%to-2.00%,andtendstorebound.Hopefullyweareatatrough,andtheratewillresumeitspositivetrendsoon.Inregardstothesalestaxcategorygraphs,itshouldbenotedthatthereisamajoraberrationintherestaurantcategory.Aspecificvendorhasreportedrevenuesfortwostraightmonthsthatareatalevelthatisimpossiblyhigh.Perhapstheyaremakingpaymentsinarrears,orperhapsothersalestaxsourcesarebeingreportedinadditiontotherestaurant.Ihaveplacedacalltotheiraccountingdepartment,butatthetimeofthiswritinghavenotheardback.Whilewearegladtohavetherevenue,itismateriallyskewingthecategorydataandgraphs.CONCLUDINGTHOUGHTSOneofstaff’smostimportanttoolsistheCapitalImprovementPlan(CIP)spreadsheet,whichforecastsrevenues,expendituresandresultingfundbalanceoutoverthenextfiveyears.ExtraattentionhasbeenpaidtotheCIPin2009astheTownconsiderstheStanleyFairgroundsproject(s),assalestaxnumbersmaterialize,andasanydeviationfromthebudgetisconsidered.Staffstandsreadytoimplementappropriatebudgetarychangesasnecessarytoattempttoensuretheeconomichealthofthecommunity.ActionstepsrequestedNone.•Page3 ..C)a)L4—’CD000iiCCCDId) Economic Overview D Economycontracted ata 5%annual pace in accordi D Following a 6.3%decline in 4th quarter of 2008 D State revenues (Jul 01 08 start)down 4.6%.
