RECORDOFPROCEEDINGSEstesValleyPlanningCommission5February17,2009BobRising/CountyResident—BeingthepresidentofthehomeownersassociationforCarriageHills,Mr.RisinghadconcernsabouthowADUswouldaffectcovenants.AttorneyWhileindicatedcovenantswouldsupercedecodechanges,dependingonhowtheyarewritten,havebeenenforced,etc.MikeRichardson/TownResident—Asalong-timeresidentofEstesPark,heistiredofhearingthepoliticsoffear.Hestatedthatbecauseofcovenants,neighborhoodscanstillmaketherulesaboutadus.CommissionerKlinkclosedthemeetingtopubliccomment.IngivingdirectiontoStaff,CommissionerKlinkstatedthePlanningCommissiondoesnotsupportrentalsofADU5.Theywouldliketoseedetachedunitsremovedfromtheproposedcode,allowingonlyintegratedandattachedunits.ThePlanningCommissionsupportsreviewingtheapplicationpriortoapproval,andthinksowner-occupancyisanimportantconsideration.PlannerShirkremindedtheCommissionersthatiftheownerchooses,hecouldrenttheentirelotasasingle-familydwelling,aslongastheprimaryresidenceandtheADUmettherequirementsfora“household”.TheCommissionersbelieveowner-occupancyismoreimportantwithdetachedunitsratherthanattached.DirectorJosephsuggestedmakingadecisionontheallowanceofdetachedADUspriortovisitingtheguestquartersissue.Itwasmovedandseconded(Hull/Norris)toCONTINUEtheproposedBlock12AmendmentstotheEstesValleyDevelopmentCoderegardingAccessoryDwellingUnitstothenextregularlyscheduledPlanningCommissionmeeting.Themotionpassedunanimouslywithtwoabsent.c.WILDLIFEHABITATPROTECTIONPlannerChilcoffstatedthismonth’sfocuswouldbeonsetbacks.Itisproposedthatthesetbackfromaquaticandriparianhabitatbe50feet,usingthesamemeasurementguidelinesasforwetlandsetbacks.Mapswouldalsobeusedasaguide,andthesemapswouldbemadeavailabletothepublic.Itisbeingproposedtorequirethe50-footsetbackforalllots,developedandundeveloped,andwouldapplytoalldevelopmenttypes.PlannerChilcoffreiteratedthatalthoughnowildlifeassessmentwouldberequiredonasingle-familylot,thesetbackswouldapply.Itwasclarifiedthatpropertyownerscouldapplyforvariancesiftherequiredsetbackmadetheirlotunbuildable.CommissionerFraundorfquestionedthecurrentsetbacksintheCommercialareasoftown.DirectorJosephstatedtherehasbeenlegitimatedebateconcerningpassiveandactiverecreationalusesinwildlifeareas.TheTownhasexperiencedthatdebateandcompromiseshavebeenmade.Itisthoughtthatmostareasthatareinheritantlyattractivetopeopleandwildlifeshouldbestructuredinordertomaintainabalancebetweenthetwo.Itisverypossibletohavemultiplestandardsfordifferentzoningdistricts.ItwasdiscussedamongtheCommissionandStaffthefairnessofestablishingdifferentriversetbacksfordifferenttypesofzoningdistricts,suchastheCDdistrict,andthepossibleunintendedconsequencesthatcouldoccur.PlannerChilcoffprovidedachartindicating36%oftheEstesValleyunderthisproposalwouldbeconsideredcriticalhabitat.Ofthemappedcriticalhabitat,35%isalreadyprotectedasopenspaceand15%istoosteeptodevelop.Forthenextmeeting,PlannerChilcoffwillpresentseveraltypesofimpactsonriverandstreamcorridorsandhowtheyrelatetotheproposedsetbacks.PublicComment:EdKitchen/CountyResident—LivesadjacenttoFishCreekRoadandstatedmanyhomesarealreadylocatedwithintheproposedsetback.Hedoesnotthinkwildlifeareaffectedinareaswithsmallcreeks,andwouldnotsupporttheproposedsetbacks.
