BoardofTrustees—December9,2008—Page3FamilyResidential.Atemporary-usepermitwasapprovedbystaffinSeptember2008andthepermitexpiresonDecember9,2008.Thepermitwasissuedtoallowtheschooltooperateatthenewlocationduringthespecialreviewprocess.EVPCrecommendedanumberofcodewaiversandconditionalapprovalsincetheLodgeisatemporarylocationfortheMontessoriSchool,includingexpirationoftheapprovalonMarch24,2010.Additionalimprovements(lifesafetyissues)wouldneedtobemadeiftheschooldecidestoremainatthislocationpermanently.KayLawson/DirectoroftheMontessoriSchoolstatedtheschoolhasbegunpreparingareapplicationtoremainattheMasonicLodgeifnecessary;however,theyareactivelysearchingforapermanentlocation.MayorProTernLevineclosedthepublichearing,itwasmovedandseconded(Eisenlauer/Miller)toapproveSpecialReview08-03,anditpassedunanimously.4.ACTIONITEMS:1.ESTESPARKLOCALMARKETINGDISTRICT(LMD)2009BUDGET.TownAdministratorHalburntstatedtheLMDBoardapproveda2009BudgetonDecember2,2008.Thedraftbudgetwasamendedandreducedby$163,000toafinalbudgetof$124,115withestimatedrevenuesofapproximately$1million.ThebudgetisacomponentoftheOperatingPlan.TrusteeEricsonrequestedtheLMDBoardkeeptheTownBoardinformedonhowthecontingencyfundsarespentastheyearmovesforward.Itwasmovedandseconded(BlackhurstlEisenlauer)toapprovetheEstesParkLocalMarketingDistrict2009Budget,anditpassedunanimously.2.PUBLICHEARING—FALLRIVERV-XIANNEXATION—RESOLUTION#24-08&ORDINANCE#17-08—PUBLICHEARING.MayorProTernLevineopenedthepublichearing.PlannerShirkstatedaDevelopmentPlan07-14wasapprovedbytheEVPConSeptember2007fora12roomBedandBreakfast/weddingfacility.ApartoftheapprovalbytheEVPCwasforthepropertytobeannexed.AnannexationagreementwasapprovedinMarchof2008,includingthepaymentofhalftheannexationcosts.TheadditionalpropertyannexedwiththisprocessisroadwayandTownownedproperty,FishHatchery.Thetotalannexationincludes88.56acres.TherewouldbenoadditionalexpensesfortheTownwithpoliceorsnowplowingbecausetheTownownsalargeportionoftheproperty.AttorneyWhitereadtheResolutionandOrdinanceintotherecord.Therebeingnofurthertestimony,MayorProTernLevineclosedthepublichearing,anditwasmovedandseconded(Miller/Blackhurst)Resolutions24-08andOrdinance17-08beapproved,anditpassedunanimously.3.OPENSPACESTUDY.Itemremovedfromtheagenda.4.2008BUDGET—SUPPLEMENTALBUDGETRESOLUTION#25-08.FinanceOfficerMcFarlandreviewedthe2009budgetprocessthatbeganinJuneandwasfinalizedinNovember.Asupplementalappropriationresolutionallowsamunicipalitytoauthorizeadditionalmoneyforaspecificfundthanwasoriginallyadopted.Tenfundsareexpectedtoexceedtheoriginalbudget:theGeneralFundby$128,000,MuseumFundby$1,200,SeniorCenterFundby RECORDOFPROCEEDINGSEstesValleyPlanningCommission3November18,2008mappingsystemofthehabitatassessmentcontainsdifferentecosystemcharacteristicsthatarecombinedtocreatecritical,important,orlowhabitat,andthesechangefromareatoarea.Urbanizedareaswillhavehabitatinthoseareas,butithasbeencompromisedandfragmented.Theproposalisthatthelinearfeaturesofthewaterbodieswouldbelabeledascriticalareasevenwhenlocatedwithintheurbanizedareaszones.Thereishopeofamutualagreementforcriticalhabitatareastobeincludedinthestudies,anddiscussionneedstooccurastowhetherornottolowerthethresholdtoalsoincludetheimportanthabitatareas.PublicCommentandDiscussionwithCommissioners:RonNorris/AssociationforResponsibleDevelopmentPresident(ARD)—Mr.NorrisstatedthatARD’ssupportsincludingtheimportanthabitatareasinthetriggerforstudyinordertoavoidover-degradingofareas.FrankTheis/EstesValleyContractorsAssociation—Mr.Theisindicatedlocalcontractorsareconcernedaboutcreatingandnurturingasustainableeconomythroughgooddevelopment.Hisassociationisconcernedaboutthepossiblelackofdefinitionofboththecriticalandimportantsectionsoftheassessmentandtherepercussionsitcouldbringuponthoseactuallycompletingthestudiesandmakingarbitrarydecisions.Mr.Theisencouragesthecommissiontobeawareofunintendedconsequencesthatmayariseincriticalhabitatareasandhowitmayaffectpropertyvalues.Itishisopinionthatriparianareasareverydifficulttodefineoncetheyhavebeenremoved,andthemotivationofsomedeveloperstoremovetheseareasinordertoavoidtheregulatoryprocessonpropertycouldbeanunintendedconsequence.SandyOsterman/TownResident—Mrs.OstermanstatedthatinaconversationwithRockyMountainNationalPark(RMNP)SuperintendentRonBaker,heindicatedthatColoradoDivisionofWildlifeReportswouldbebetterindicatorstocompareandassesstheEstesValleyhabitatratherthantheRockyMountainEnvironmentalImpactStatementfrom2007.Mrs.OstermanbelievesthisImpactStatementisthebasisofmostoftheinformationgatheredfortheWildlifeHabitatAssessment.ShefeelstheremaybeconflictinginformationinthisImpactStatementwhencomparedtotheRMNPstudy.ConsideringherselfveryfamiliarwiththeDevil’sGulch/DryGulcharea,sheisconcernedthatsomeelkmovementareashavebeenleftoutoftheCompositeAnalysisMap.ItisheropinionthatelkareanessentialcomponentoftheEstesValleyeconomyandneedtobeprotectedaswell.ShehasconcernsthattheAssessmentisnotwrittenspecificallyenoughtoprotecttheentirehabitat.FredMares/TownResident—Mr.Mareswouldliketoseetheimportantcategoryincludedinthestudies.Hedoesnotseeitaslimitingdevelopment,butasproposingthatdeveloperslookatthehabitatbeforecreatingtheirdevelopmentplan.Importantareasprovidealotoftheconnectivitybetweenthedifferenthabitatareas,andshouldcarrymoreweightthanwhattheyarepossiblycarryingnow.SethHanson/RockCastleDevelopmentCompany—Mr.Hanson’sconcernisthepotentialforlimitingdevelopment.Forexample,aminimumsetbackof50feetinriparianareascouldsignificantlyimpactdevelopmentwhencomparedtothecurrent30-footrequirement.Mr.Hansonwouldappreciatekeepingthedevelopersinmindwhenmakingdecisionsaboutthesetbacklimits.JohnSpooner/Architects,Engineers,andDesignersCommitteeoftheEstesParkContractor’sAssociation—Mr.SpoonerindicatedthiscommitteewasformedtoaddressconcernsaboutdevelopmentintheEstesValley.Thecommitteesubmittedaletterwhichisincludedintoday’sPlanningCommissionmaterials.Mr.SpoonerindicatedthecommitteewouldbewillingtomeetwithStaff/Commissiontodiscussdetailsandconcernsinafriendlymanner.Varioustownspeoplespoke.Allhadthegeneralopinionthatcloseattentionneedstobepaidtohabitat,development,andhowthelocaleconomyandhealthofhabitatmaybeaffectedbyboth.DirectorJosephpointedoutthepossibilityofatrialstudytogainabetterunderstandingofhowastudymaylook.HealsoassureddevelopersthatvarianceprocedureswouldstillbeinplaceandsetbackvariancescouldbebroughtbeforetheBoardofAdjustment. RECORDOFPROCEEDINGS____________EstesValleyPlanningCommission5November76,2008Itwasmovedandseconded(Tucker/Hull)toCONTINUEagendaitem4.a.,PROPOSEDAMENDMENTSTOTHEESTESVALLEYDEVELOPMENTCODE,BLOCK72,totheDecembermeeting,withStaffdirectedtocontinuetoworkondraftingspecificdefinitions.ThemotionPASSEDunanimouslywithoneabsent.b.ACCESSORYDWELLINGUNITS—proposedchangesto§5.2.BAccessotyUses/StructuresPermittedintheResidentialZoningDistricts,toallowaccessorydwellingunits(ADU5)withinallsingle-familyresidentialzoningdistrictsexcepttheR-1district,toallowtheleaseofoneunit,toallowdetachedunits,andtoadoptarchitecturalstandardsforADUs;alsoproposedchangesto§13.3.3DefinitionofWords,TermsandPhrases,toredefinethetermAccessoryDwellingUnitStaffPresentation:PlannerShirksummarizedthepasthistoryoftheproposedcodechangesforADUsinthecommunity.Discussiontodaywillcenteronlotsize,numberofunits,sizeoftheADU,andattachedversusdetachedunits.Concerningthebasisoflotsizeversuszoningdistrict,CommissionerKlinkstatedthereareveryfewlotsthatwouldactuallymeettheminimumlotsizerequirementandbelievesweneedtoagreeonusinganactualphysicallotsizemeasurementratherthanthezoningdistrictinordertomaintainconsistency.DirectorJosephquestionedtheCommissionondetachedunitshavingahigherstandardandonlybeallowedonlotsofalargersizethanwhatyoumightotherwiseallowintermsofintegratedorattachedunits.Also,shouldtherebeaminimumlot-sizestandardfordetachedADUs?TheproposedcodestatestheADUhastobeclosertotheprincipledwellingthanthepropertyline.SomestatementsintheproposedcodeapplytoADUsdifferentlythanothertypesofdetachedstructures(i.e.garages).ADUswouldberequiredtocomplywitharchitecturalstandards,therewouldbeamaximumsizeof49%oftheprincipledwellingor1000squarefeet,whicheverisless.Limitsofdisturbancewouldapply.Concerningpropertieswithwaterwells,theDivisionofWaterResourceswillnotallowdetachedaccessorydwellingunitsiftheprincipleunitisonawellunlessthewellpermitspecificallycontainssuchallowances.OthercommunitiesallowingdetachedADUsincludeLarimerCounty,SummitCounty,GlenwoodSprings,Longmont,Ft.Collins,andothers.Nonerequireminimumlotsizes.AspenrequiresanyADUtobedetached.Toquantifyapplications,LarimerCountyhadzeroapplicationsin2004-2005,sixin2006,ninein2007,andsevenapplicationsthusfarin2008.PlannerShirkpointedoutthataccordingtocodeineffecttoday,detachedunitsarenotallowed.Therestrictionsonintegratedunitsareafunctionofthelotsizewithrelationtothezonedistrict.Forattachedunits,coderequirestheunitbeintegratedwithintheprinciplestructure;meaningcommonwallsandlivingareasmustexist.Thecodechangesproposedincludethreedifferenttypesofunits.Thechartofnon-compliantlotssupportsthatweshouldgowithzonedistrictinsteadoflotsizeduetonumberofoddlots.Threedefinitionshavebeenwritten,whicharebasedzoningdistrict,regardlessoflotsize;thelargerthezoningdistrict,themoreseparatetheADUcouldbefromtheprincipledwelling.Thesecondpointdealswithoccupancyandrentaloptions.TownAttorneyGregWhitehasstatedtheTowndoesnothavethestatutoryauthoritytoevicttenantsinrentals.PlannerShirkindicatedmostothercountiesallowrentalsofoneunitontheproperty.Someallowaminimumthree-monthrentalperiod.Vacation-homerentalsarenotallowedinanycountiescompared.PlannerShirkstatedtheproposedcodewouldstillmaintainsingle-familydwellingstatuswiththenumberofoccupantscappedateightunrelatedindividuals,andwouldalsorequirealand-useaffidavitthatpropertyownerswouldhaverecordedwiththeClerkandRecorder’soffice.Thisdocumentwouldrunwiththedeedontheproperty.ItisPlannerShirk’sthinkingthattheComprehensivePlansupportstheconceptofADUrentalsunderitshousingpolicies,whichputsanemphasisoncreatingattainablehousing. RECORDOFPROCEEDINGSEstesValleyPlanningCommission6November18,2008ThethirdpointistheproposalofanADUsizelimitof49%ofthesizeoftheprincipledwelling,withamaximumof1000squarefeet.Mostordinancesinothercountieshaveavarietyofsizelimitsbetween800and1000squarefeet.Aftertalkingwithlocaldesignersandcontractors,PlannerShirkconcludedthata1000square-footcouldeasilybeatwo-bedroomdwelling.Finally,concerningreviewbyPlanningCommission,PlannerShirkindicatedLarimerCountyrequiresgoingbeforetheCountyCommissionersforapprovalofadetachedADU.FortheEstesValley,PlannerShirkrecommendsareviewbythePlanningCommissionfordetachedunitsinorderforaffectedpropertyownerstobenotifiedandgiventheopportunitytocomment.Ifcovenantsareinplacefortheneighborhood,theycanbeaddressedatthattime.CommissionerKlinkpointedoutfromdiscussionwithTownAttorneyWhitethatcovenantscanbewrittentoincludetheapprovalordenialofADUs.Also,otherrestrictionsoncertainlotsinaneighborhoodcanbeaddedtothecovenantsuponagreementbyaffectedneighbors.CommissionerHullnotedthatanyapprovedADUwillberequiredtosharethedrivewayontheproperty.PublicCommentandDiscussionwithCommissionersandStaff:RonNorris/ARDPresident—Thisparticulargrouphasresearchedandtalkedtootherneighborhoodgroupsabouttheproposalandtheysupportanyclarificationandspecificexamples.HeindicatedtherewereconcernsabouttheextentofthecoderevisionsasdescribedinOctober,includingextensivecodechangeswhenthedemandforADUsseemslow;unnecessarycodechangeswhenmanypropertiesalreadyqualify;potentialdrasticneighborhoodchangesifmanypeopleconstructedADUsbyapplyinguse-by-rightprivileges;impactonutilities;andtheenforcementofrentals,ifallowed.Mr.NorrisstatedthatARDsupportsreviewbythePlanningCommission,andwouldappreciatebeingabletoprovideinputonlotsizes,squarefootage,etc.TomEwing/TownResident—Mr.Ewingwouldappreciateclarificationondetails.Heisconcernedabouttheenforcementissuesifrentalsareallowed,andsupportsusingactuallotsizeratherthanzoningdistrict.Ifrentalsareallowed,Mr.Ewingwouldpreferlong-termrentals.RayDuggans/LocalBusinessOwner—Mr.DugganhasaclientonHighDrivewithasituationofpossiblynotbeingabletoexpandorimprovetheexistingdetachedunitonhispropertyifthesecodechangesoccur,andwouldappreciateconsiderationofthesetypesofinstanceswhenwritingthenewcode.SteveLane/BasisArchitecture—Mr.Lanebelievesthedetachedconceptisaverygoodidea.Hehasrecentlyseenanincreaseddemandforon-sitedwellingsforcaregivers.Mr.Lanesupportslong-termrentals(90daysorlonger).Hefeelstheproposedarchitecturalstandardsarenotwell-written,andshouldbeleftuptoarchitecturalcontrolcommitteesinindividualneighborhoods.Itishisopinionthatbecausetheproposedcodeissospecific,itcouldcreatedesigndifficultiesandalsoover-burdenthearchitects,propertyowners,anddesigners.HeindicatedmostinquiriesfordetachedADUsarepropertyownersof10-acrelotsorlarger,withspecificreasonstobuildtheunit.DirectorJosephindicatedtheproposedarchitecturalstandardswerewritteninordertoavoidseeingtheveryworststructures,anditcouldbepossibletoincludeanoptionforexceptionwhenreviewedbythePlanningCommission.ItisStaff’sgoaltocreatethecodesotheintegrityofthecommunitywillbemaintained.SeveralTownresidentscommented.Concernsexpressedwerehighdensity,landlord/tenantrightsifrentalsarepermitted,andstandardsizesversussizebasedonthesquarefootageofthelot.ThomasBecklLocalArchitect—Mr.Beckbelievestheintentofthearchitecturalstandardsisgood,butthepracticalitybringsunintendedconsequences.Regardinglotsize,hedoesnotthinka1000square-footADUwillnotgreatlyimpacttheneighborhoodonalotofY2or1acre.Mr.Becksupportslong-termrentalsusedforemployeehousing,long-termcare,
