RE: Vacation Home Philosophy
Purpose of Study Session Item:
To review the Town’s philosophy for vacation homes as it relates to transferability, cap
on residentially zoned properties, taxes and/or fees on vacation homes, and life safety
inspection requirements for window wells.
Town Board Direction Requested:
Staff requests direction from the Board on the vacation home philosophy and any
requested code changes to address the operation of vacation homes.
Present Situation:
Vacation home regulations were moved from the Development Code to the Municipal
Code in May 2021. During the presentation of the code amendments staff committed to
bring forward additional discussion on the transferability of vacation homes and a review
of the cap for residentially zoned vacation homes. Mayor Pro Tem Martchink further
requested a discussion on the potential for taxes or fees on vacation home rentals to
support workforce housing options in the community. Additionally, staff has reviewed
the potential need to reassess a previously adopted life safety requirement for homes
built prior to January 1, 1969 as it relates to window wells.
Proposal:
Staff intends to provide the Board with additional information on the issues outlined
above at the study session in order to receive direction from the Board as it relates to
potential code amendments.
Advantages:
•To engage the Board in discussion on the philosophy and receive direction for future
code amendments related to transferability, cap, revenue, and building code
regulations.

Disadvantages:
•A change to transferability, the cap, or the building code would impact current and
future vacation homes and those on the waitlist.
Finance/Resource Impact:
Depending on the Board’s direction, the Town could incur a cost to hire a third party to
complete a fee study. Staff would consider the Board’s specific direction to ascertain
the cost of a study. On the other hand, a fee or a tax would raise revenue for either
designated or general purposes.
Level of Public Interest
Medium. Vacation homeowners, property managers, and neighboring properties have a
strong interest in any changes to the vacation home regulations and fee structure.
Other members of the public might also benefit from the uses of new sources of
revenue collected from vacation homes.

Ordinance 12-17 – Window Wells
R327.2.7 Window wells. Where required, compliant
window wells shall be properly installed at
emergency escape and rescue openings. For
dwellings constructed after December 31, 1968, said
window wells shall comply with the code in effect at
the time the well was required. For dwellings
constructed prior to January 01, 1969, the minimum
requirements for said window wells shall be at the
discretion of the Building Official until determined
by amendment based on documentation of existing
conditions.

VHR Regulation Issues
Two of the TofEP Vacation Home Rental regulations negatively affect multi-family
zoned neighborhoods (condominiums and townhomes) as to providing for a
balanced application of the opportunity to rent one’s residence on a short-term
basis, artificially inflating real estate prices, and characterizing specific units as
enduring resort VHRs. The most obvious is the limitation on the number of
licenses that one would think would be based on density of short-term renters
interspersed within a residential neighborhood. In fact, according to TofEP Clerk’s
office, that number was derived from previously existing short-term rentals
licensed under the Business Licensing regulations of the town. There is no
methodology to balance the overall density within neighborhoods to keep things
spread out within the town. I own a second home in a condo project within Estes
Park that falls under the Vacation Home Rental licensing regulations. We have 68
units and there are currently 19 licenses allocated to our owners for a density of
one license per four homes. This is not a resort property and we have no
amenities (pools, playgrounds, clubhouses). In spite of Condo Association rules
prohibiting resort activities by guests, we see a significant negative effect on the
Residential Character of our neighborhood due to this high density of VHRs.
The second regulation that harms residential neighborhoods is the ability to
Transfer at Sale the VHR License. These rights are a legacy component from the
Business Licensing regulations of the TofEP. They have a place in an ongoing
commercial business concern where a guaranty of license availability affects the
value of a licensed business transferred to a new owner. It does not have a place
in a residential neighborhood where the primary role of property is to provide
residential function to full time and second home owners.

Transfer at Sale rights of a Vacation Home Rental license, especially in multifamily
zoned projects (condos and townhomes) work to destroy the Residential
Character of the neighborhood; that the TofEP Vacation Home Rental regulations
stipulate must be maintained by the program. They do so by:
1)Establishing an enduring Vacation Home Rental within a particular unit or
home within a project. These properties become investment properties
instead of primary or second homes, that are run by professional resort
property managers.
2)Providing for distortion of VHR licensed property values within the
properties of a project or neighborhood due to limitation of licenses
available and license rights of transfer premiums becoming a part of sales
price.
3)Do not allow other members of project or neighborhood(s) to participate
and exercise their right of short-term rental of the property as limited
licenses cease to turn over as transfer rights premium becomes an ever-
increasing part of the property’s value.
Transfer on Sale rights for VHR licenses need to be removed. A better
methodology for controlling VHR density in neighborhoods needs to established.

RE: Mid-Season Update on Paid Parking
Purpose of Study Session Item:
Provide a mid-season update on the implementation of seasonal paid parking.
Town Board Direction Requested:
Staff seeks Town Board feedback on the implementation of seasonal paid parking to
date. Staff would also like the Board’s direction on proposed next steps for discussing
the 2022 seasonal paid parking program.
Present Situation:
On May 28, 2021, Public Works staff implemented seasonal paid parking as authorized
by the Town Board via Ordinance 30-19 (approved Nov. 12, 2019) and as detailed in
Resolution 71-20 (approved Dec. 8, 2020). The program was implemented as follows:
• Season: Friday May 28 – Sunday October 17, 2021 (143 days)
• Hours: 10 am to 6 pm, seven days per week
• Cost: $2 per hour
• Scope: 703 total spaces in the following eight public parking areas: Town Hall,
Bond Park, E. Riverside, Riverside, Virginia, Post Office, Wiest and Tregent.
• 68% of all public parking in Estes Park remained free.
• All spaces with persons with disabilities remained free and without time limit.
• Time-limits were removed from all seasonal paid parking lots.
• Residents/locals (defined by the Estes Park School District boundary) are eligible
for 30 minutes of free parking each day in the paid parking areas.
The 2021 paid parking season is a little over 50% complete. While the program’s full
efficacy is yet to be seen, there have been a number of items that have gone well, and
should be celebrated. There are also areas where improvements were identified by our
parking customers almost immediately, as well as areas where needed improvements
began apparent as visitation increased throughout June and into July.

Implementation successes:
1. Program launch. After decades of discussion and numerous studies
recommending paid parking (dating back to the late 90s), paid parking was
implemented in Estes Park for the first time in the Town’s history.
2. Changing behavior. There has been a dramatic increase in occupancy for the
free parking areas, including the parking structure. Occupancy in paid lots has
stayed steady when compared to 2019, while other local indicators are showing
double-digit increases (e.g., RMNP visitation, Visitor Center counts and sales
tax). Paid lots are turning over (“churning”) and have empty spaces available
most of the time.
3. Traffic flow and congestion. Traffic count data collected during the second and
third Saturdays July (2015, 2016, 2021) shows that while vehicle counts and
pedestrian counts have increased at the two downtown intersections, travel times
along Elkhorn are shorter. Data from these studies is included in the
Attachments.
4. Budget and revenue. The program is currently operating within budget and is
tracking in line with projected revenues.
5. Signage. Removed 166 old parking guide signs and added 126 refreshed new
destination and auto-directional signs for a net reduction of 38 signs.
Opportunities for improvement:
1. Signage. We went light on signage to be mindful about the impact to the natural
environment. This led to some confusion about rates and times initially, however
staff quickly added temporary signs which were recently replaced with
supplemental plaques and pedestrian scale signs. Meter decals were updated
and messaging was placed on the pay station screens to further address
customer questions.
2. Mobile transaction times. Due to poor cellular connectivity downtown and the
volume of people on their phones (for all activities, not just paying for parking), it
can be difficult to connect to the mobile payment app or process a payment at
peak times of day in certain locations downtown. This is often reported to us as
the app not working or being hard to use; however, the real issue is poor wireless
connectivity. PW staff are working with Power & Communications and IT to
define a solution to extend the Town’s (free) wifi network to the paid parking
areas. A hard-wired option (fiber and power) is also being explored for the future.
3. Pay Station transaction times. While the pay stations have always functioned
within normal processing times for parking pay stations, the Town has opted for a
screen sequencing that may feel longer than some other communities. This is
due to additional messaging related to hours/rates and free ADA parking, the
choice of multiple languages, the choice to offer validation for those downtown
businesses who choose to do so and the ability to extend parking time directly
from one’s mobile device (without returning to the pay station). Feedback has
also been received regarding how long it takes to process a credit card
transaction as many are used to the instant experience of tap and go at gas
stations, grocery stores, etc. The Town recently rolled out a software upgrade for
the pay stations that has shown to improve transaction times in beta testing.
4. Staffing. Like many others in Town, The Car Park struggled with hiring seasonal
staff members to serve as Parking Ambassadors. The job can be difficult at
times, so we experienced some early attrition. However, staff rallied to recruit Page 6
volunteers from other divisions and departments to cover our busiest weekends,
borrowed seasonal field staff from The Car Park’s operations in Boise, Idaho and
have now had a consistent staff team working since around the July 4th holiday
weekend. All staff that work for The Car Park, including the manager, two full-
time and one part-time Parking Ambassadors, are all local residents.
Proposal:
Staff propose to return to the Town Board in a Study Session on October 26 to provide
a full recap of the 2021 paid parking season, including Key Performance Indicators
(data), outreach efforts and feedback received, operational lessons learned and
improvements made. Staff will also provide the Board with draft recommendations for
the 2022 paid parking season. Unless otherwise directed at the October Study Session,
the next step would be for staff to bring a Resolution to set 2022 Parking Fees to the
Regular Meeting and Public Hearing on November 9, 2021.
The 2021 seasonal paid parking program was funded by the General Fund via
supplement to the 2021 budget. Based on revenue collected to date, staff project that
program revenue will cover the initial capital investment as well as operational expenses
for year one (2021) plus net revenues as described in more detail below.
This project is managed by the Public Works Dept. with the Parking & Transit Manager
as the main Town project manager with operational support from professional parking
operator, The Car Park.
Advantages:
• Implementation of paid parking and new parking permits continues the Town’s
data-driven approach to management of a limited public resource as
recommended in the Board-adopted Downtown Parking Management Plan
(2018).
• Implementation is designed to accommodate diverse user groups (locals, visitors
and employees), is phased/incremental, and is in line with other Colorado
communities that are supported by tourism-driven economies.
• Paid parking fees are a new source of revenue that could reduce future reliance
on the General Fund for parking management, future parking infrastructure (e.g.,
new parking structure downtown) and the heavily subsidized Town’s free shuttle
service (Estes Transit).
Disadvantages:
• Implementation of paid parking required an investment of funds not originally
budgeted in 2021; however, staff have worked the Town’s contracted parking
operator, The Car Park, to be fiscally-conservative throughout all aspects of
implementation.
• There is a risk that the implementation will not go as planned (e.g., revenues will
fall short of expectation, costs will exceed estimates, technology issues,
unforeseen disasters, etc.); however, staff has been actively working to address

operational issues that have arisen during the first half of the 2021 paid parking
season as quickly and professionally as possible.
• Implementation of parking management in downtown Estes Park, especially paid
parking, has been vocally opposed by some residents and business owners;
however, the majority of input received by staff and our contractor has been
generally neutral or positive from locals and visitors.
Finance/Resource Impact:
At the Dec. 8, 2020 Town Board meeting, which approved Resolution 71-20 Setting
2021 Paid Parking Fees, staff indicated that resuming implementation of seasonal paid
parking in 2021 would require a budget supplement to cover both a one-time capital
investment of $127,000 and $401,049 of additional operating funds, totaling $528,049 in
new program-related costs. At that time, staff projected these costs to be fully
offset/covered by new parking revenue, and project net revenue of $367,305.
As of June 30, expenses are trending slightly lower than expected. One-time capital
expense is at $102,833 with $205,524 in operating funds expended. Gross paid parking
revenue as of July 24 is $370,935. If current trends continue through the remainder of
the paid parking season, anticipated gross revenues will be approximately $899,046
with $401,565 in projected net revenue.
Staff are often asked where parking revenues will go. Ordinance 30-19 defined a
Special Revenue Fund (256) to separate parking revenues from the General Fund in
support of these specific uses: “Revenue received from parking permits, parking fees,
and parking citations derived from this chapter shall be deposited into a special revenue
fund designated by the Finance Director. This revenue may be expended only on the
administration, operation, and enhancement of parking management and
complementary transit and alternative transportation services.”
Level of Public Interest
Public interest in seasonal paid parking is extremely high. Since the program’s launch
on Memorial Day weekend, staff have received feedback by email, phone calls, survey
responses, public input forms, etc. It is very important to note that staff read, listen to
and record every comment - positive, neutral and/or negative. Many of the operational
improvements described in this Report and accompanying presentation were made in
response to feedback from folks who provided concerns and/or input on things that
were not working for them.
To date:
• We had about 30 people stop by our first Farmer’s Market table date
• 122 individuals have completed the online feedback form
• Visited 10 businesses via door to door outreach
• Had 30 comments provided via phone or email.
Staff are actively collecting feedback this summer in the following ways:

• During the permit registration process (as staff have helped hundreds register in
person since Town Hall reopened in June);
• Table near the Farmer’s Market in July (22), August (5, 19) and September (2,
16, 30);
• Two surveys of 2021 permit holders; one mid-season (early August) and one at
the end of the season (early October);
• Door to door outreach to downtown businesses with the Chamber;
• In the field via our front line staff (Parking Ambassadors);
• Feedback form at Library front desk
• Via online feedback form; and
• Monthly conversations with the Transportation Advisory Board at their regular
meetings.
Feedback results to date are summarized below. Raw results, including individual
comments, are included in the attachments.

o 43% indicated that their parking experience was “Excellent” or “Good”
o 35% indicated that their parking experience was “Fair”
o 28% indicated that their parking experience was “Poor” or “Very Poor”

owners or employees and 11% visitors.

That would be PAST experience has been good ... easy to
get in and out. Not a big problem even in heaviest traffic
times. After yesterday, I would classify the experience as
the worst!!! We have lived about 20+ air miles NE from
Estes and manage to visit often throughout the year. In
our April visit this year we were excited to see many of
the old businesses back after the Covid mess. We had
visitors at our home this week from NE and they
indicated that EP was first on their list, as usual. The pay-
to-park decision did not set well with them (or with us).
Rating: worse than "very poor". Maybe "Fatal" would be
a better rating.
Get rid of paid parking!!!!!! Our guests shared
our dismay. "Are they trying to be like RMNP and
limit visitors?" "What do they think this is,
Jackson Hole or Aspen?". These are folks who
come Estes to pick up a box of taffy and often it's
not unusual to spend $150 to $200 on art,
jewelry, and collectables plus have a good meal.
Now you have put yourself in into the image of
big city GREED and no respect for visitors.... a
disastrous decision. Wake up or watch your
unique little town go down the tubes!! Just let
visitors go to Boulder or Denver for the CO
experience, I guess.

Because I generally walk or bike downtown, or I can park
at the structure. I have not parked anywhere else
downtown this season (even though I have a 30-minute
permit), and I am very happy with my options.
Block parties in existing parking lots so we can
enjoy that public space from time to time and not
cede it entirely to cars. The Farmer's Market and
other events at the Visitor Center do this well.
Also, more bike parking around town. I'm often
locking my bike to street signs.

going. I honestly think we should raise the parking fees
next year slightly to generate additional income and
encourage more people to use free parking spots such as

We have disabled Vet licenses and are unable to find a
place to park at the Post Office. Three times I have tried
to get my mail and the parking places are full with out of
state vehicles. I have to go home and get my husband to
drive me back downtown. He drops me off and circles
the lot while I go inside. What are you trying to do to the
residents?
Get rid of the paid parking completely. The Fair
grounds has lot of parking. Make the visitors use
that lot. The parking garage is NEVER full. What

the parking lots near the shops fairly easy and convenient
to access. I prefer to continue to use this free parking
that is available as a frequent visitor to Estes.

Regarding the transit system, I would be
interested in seeing ridership numbers on each of
the shuttle routes. My impression is that the
main trolley route up and down Elkhorn is
frequently used, but the either shuttle routes are
empty or nearly empty most all of the time. If
that is the case I think we should be cost-
effective and illuminate those secondary routes

the summer tourist season. I do need to go to the
building department to drop off plans, checks, etc. It is
very difficult to find parking for my in and out trips to
town hall. It would sure help those of us who struggle to

Because when I'm in Estes I walk downtown most of the
time.
Estes needs to discourage cars driving up from
the Front Range just for the day. The Bustang is a
good first step, but the service should be
everyday, not just weekend days. Or put park
and rides in Lyons and have shuttles run
frequently from there to Estes. There are just
way too many cars driving in to Estes and yet
there are no current reasonable alternatives.

Parking at the Post Office is hit and miss. One would
think that specific spots would be marked for those that
use the Post Office. Very common to see an out of state
vehicle parked in the first 3/4 spots and no one in the
building. Down town parking is ridiculousness.

the 3 story structure at the end of town, never
full. City was suppose to do multi story parking
at the Post Office parking lot, WHEN? Charging
visitors to park in our town is not good business.

I tried using paid parking today for the first time (at the
library parking lot -- I was attending a 3-hour meeting. I
called the phone number 877-727-5951 but got a
recording saying I had to create an account. When I
pressed the number to do that it said I would have to pay
$5 to create the account. So I hung up, didn't want to do
that. Then I tried to use my Visa credit card (which works
fine at Safeway and everywhere else) but the parking pay
machine declined the card, when I inserted it and again
when I tapped it. So I ended up having to pay $6 cash
(which luckily I happened to have with me). Also, I have a
1/2 hour free decal on my windshield as a local resident,
but couldn't figure out how to get that 1/2 hour free
when I needed to pay for parking longer than 1/2 hour (in
my case, 3 hours). I may just not be doing this correctly,
but it's confusing. Thanks!
Make the machine easier to use, example it
didn't take my (perfectly good) credit card. And
clarify (by email to residents maybe?) how to get
the first 1/2 hour free to apply, if parking for
more than 1/2 hour. And make the phone

when I go to work. I appreciate the downtown employee
permit.
There needs to be a light at the parking garage so
you can make a left turn leaving it when it’s busy.
Otherwise you have to take a right towards
downtown which defeats the purpose of reducing

or an elevator as navigating stairs with strollers

I personally have no issues using the parking system, if
that is what this question is asking. The wording is a little
vague. However, as a business owner I have heard zero
positive comments. It makes our visitors feel unwelcome

absolutely not seeing the “benefits” of having parking
available for a price. Instead they are circling and circling
to find close by free lots. They seem to feel the parking

This question is too vague, pre or post paid parking. Pre it
was excellent, now it is VERY POOR! Paying to get my
mail?!? Because the post office and delivery are a joke,
now I have to pay to get mail and packages. The signage
and money paid for the parking is a complete waste of
money. I hate the fact that the town has on the reader
board that there is new paid parking, like they are proud
of that! All the paid parking has done is make it harder on
the private lots that are “free”, making it harder on those
businesses, like the ones where Safeway is. It is hard
enough to support the businesses in there, but now they
are jam packed with people that are leaving their cars
there all day. The change makes people feel unwelcome,
like thanks for coming, but we don’t really want you
here. And the buildings where the loop is going are now
full. Estes Park is built on small businesses, and this is
driving away customers and changing the way our visitors
feel about our town. We are not Aspen, so stop trying to
act like we are. Gone are the days of just running into
Laura’s and grabbing a piece of fudge or into the Taffy
Shop to grab a box, now it has been made even tougher
to support the local businesses.
Not much to be done now as the town has spent
gobs of our money on this idiotic plan! I went to
ge my mail on Monday and there was a line of
people trying to pay at the box, they were clearly
frustrated by the time it was taking. At some
point you just have to say “wow this was a stupid
idea!”, cut your losses and make Estes the family

As someone who also works downtown (not an option
above to mark a resident, a worker, and a property
owner….which is the most important????), I have had to
answer daily questions as to how this paid parking works,
why the town did this, how much money does the town
need to fleece from tourists, etc. This is a very unfriendly
impression. They all believe the $2 an hour is WAY too
high…even Boulder doesn't charge this much!
Get rid of it! I can’t believe the town spent twice
its budget (120k) for permanent signs that are
wrong and lacking important information. The
remedy should have been to have stickers made
for the signs to add the additional information,
not taping some homemade sign to posts. I find
it ironic that in the more than 15 years of the
shuttle system, the shuttle stops still look
temporary and homemade. Why aren’t there
benches and shelters for the shuttle stops? Why

I have no objection to making prime downtown lots paid -

been in the past, but there was rather severe impact on
businesses adjacent to some unpaid parking areas

Having these lots fill up every day prevents customers

I am a disabled driver, I usually am able to find sufficient
handicapped parking near the center of town, by the
park. When I had visited the week of July 5, 2021, all the
spots were taken. I had my handicapped placard in
display in my car but had to use another non
handicapped designated spot in the pay to park area.

limit for them.

I'm talking about the summer months. I own a
construction company and am running around all day. I
need to park close to where I am going. I don't have time
to park in the parking garage and walk. The lack of short
term parking spots is frustrating and the ones we do have
are used by people who are not there for short term
parking. I have often seen tourists park in front of the PO
and walk toward downtown. I suppose they think no one
will catch them. The other issue I have is having to pay to
park to eat downtown. My 30 min pass doesn't work for
this situation. This has caused me not to eat at the
restaurants downtown this summer. I refuse to pay for
parking.
I appreciate the parking monitoring car/person! I
see them all the time, so I know they are on the
job. I don't think paid parking is the answer. I
like the garage, I hope it's being used, it doesn't
help me unless I am out shopping. I know there
is little space, I'm not sure how to get more
parking. I don't have the answer.

Paid parking for tourists is fine, and is becoming
the norm. But it is already so expensive to try to
live here, that charging a parking fee to people
who live and work here is truly immoral. Since
you are pushing tourists (trying to avoid paying
parking) into the lots of local businesses, you
should also be monitoring and ticketing
unauthorized parking in their lots, since you are

confused by signage or lack of signage. The sign coming
into town says parking in signed "lots" but some of the
parking "lots" are street parking spaces which confuses
them. There's not clear signage for where free parking is.

I actually have not gone downtown very much this year. I
just don’t want to deal with figuring out the pay system.
I’ve bought coffee a few times when I found space at
Kind. I cannot remember the last time I went downtown
other than that. The Kind lot short term spaces are
usually available to run in and buy beans.
I wish the library had spaces where you could
swipe your library card at a parking meter or
something. I can’t believe those spaces are
always used by patrons. Same at Stanley Village
lots. You can watch people park there and walk
downtown. I know I just need to figure out the
new system. Frankly the print is pretty small on
the website maps and I gave up. I only use a
tablet or phone, maybe that is why. After a year
at home I don’t have the energy to deal with it. I
go elsewhere to shop.Social media

There simply isn't enough close in parking in Estes.
People want to park where they are shopping and there
isn't enough downtown parking. The parking garage is
fine if you'd like a stroll along the river walk; but it isn't
convenient if you are a shopper. The shuttles /trolley are
not consumer friendly...they need to be picking up folks
continually and in a timely manner...15-30 minute waits
are not OK A downtown parking garage.

It is frustrating that residents must pay to park during the
day now. Also, I have been noticing people parking in the
he Safeway lot by True Value and walking to town. Also,
the parking attendants kind of add to the congestion in
town. When I was at the visitor center last week for the
farmers market, one of the cars was parked on the side
making it harder to get by when it was already congested.
An end to paid parking. I don't see the benefits.
I'm also curious where the money is going. At the

The new paid-parking system has put off me and my
family utterly. I do have a thirty-minute sticker that will
generally let me mail a package at the post office, but
that's about it.
Not wanting to pay merely to park in our hometown, we
have decided against meals with family and with visitors
at Poppy's, Claire's, La Cabana, Wapiti, and Ed's Cantina -
all former favorites of ours. We have not shopped
downtown for a year and a half, first because of the
pandemic, now because of the town's paid parking. We
have a pandemic-accumulated list of specific purchases
that we want to make at Alpenglow (pictures, framing)
and Colorado Homestead (quilted bedspreads and
throws); but not being able to do any of it in half an hour,
we are holding off. I'd like to get a haircut downtown at
Claire Dunwitte's (sp?) old barbershop, but cannot. We'd
like to browse all our hometown shops, but are unwilling
to pay to park.
In short, we can no longer park downtown for free
without a map and hiking shoes. Paid parking stinks. And,
unwilling to pay, we can no longer shop downtown. Nor
even browse. Nor explore. We live here, and you have
shut us out of our hometown.Ditch paid parking.
