Regarding height requirement for trees, it was asked whether 8’ trees are less likely to survive transplanting than smaller trees. It might be preferable to do a greater variety in size. The landscaping requirements are not retroactive to existing sites. Page 17 Sectiori 5.c., Street Planting follows existing Town regulations. It was suggested to use a pen/ious material under rock cover rather than black plastic sheeting or other impervious material. Page 19 Line 35 - 20 feet might be too close, refer to consultant. This is the formula to calculate the number of plants and not the specific spacing. Page 20 Line 12, delete one of the commas. Page 21 Chain link fencing was discussed but noted this specifically referred only to screening. For readability, have the “applicability” notation at the beginning of these sections. Line 19 - delete one “be.” Line 17 — delete “or to protect landscaping from wildlife damage.” BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Estes Valley Planning Commission - April 8,1999 Study Session Page 2 Page 22 Transparent fences were discussed. Line 20 - Delete section 4.b. Line 23 - Maintenance Requirements are only for new development. Page 23 Line 1 - delete “a certified nurseryman confirms.” Page 25 More detail regarding wetlands was discussed. Staff has a 10% adjustment allowance and the Commission a 25% adjustment, which should allow the needed flexibility for shallow lots. Could be a variance if needed. Wetlands should be included in a private open space rather than included in a development lot. Currently there is no wetland setback, but the new draft code proposes 50 feet. (100 feet may be desirable to some, but too limiting at present.) Limits of disturbance could include buffering. Regarding Geologic Hazard Areas, the Colorado State Geological Survey review/comments in hazard areas will be required. This is for the protection of the Planning Commission as well as the private developer. (The example of Green Mountain was noted.) Page 27 Line 41 - Correct “fire-reliant” to “fire-resistant.” It was noted that there was a wildfire coordinator in the County. Page 28 In regard to Wildlife Habitat Protection, submissions will be routed through the Colorado DOW. If threatened or endangered species are identified, then Level 2 regulations will apply, otherwise Level 1. Currently there are no “listed” threatened or endangered species; however the big horn sheep are considered sensitive. Town Attorney White requested that Rick Spowarl or a representative of DOW be present to discuss the wildlife requirements. If the Planning Commission is going to regulate, it needs to know what works with DOW. Ambiguity in this area can cause problems. It was noted that there will be an environmental planner on staff at the County by next year. Further discussion was postponed until someone from DOW could be present. Page 34 Exterior lighting was discussed in regard to existing lighting problems. Page 37 Lines 21 & 24 - Delete reference to CD. The chart on Off-Street Parking Requirements comes from national standards. County does not use a chart, but has text descriptions. Page 39 Lines 8,11,13- Change to require 2 parking spaces per room/cabin. Also include requirement for employee parking under small hotel and hostel. Page 44 Line 24-25 — Add “excluding RV’s and boats.” BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Estes Valley Planning Commission - April 8,1999 Study Session Page 3 Page 50 Line 19 - Change “singulaiJ’ to “single.” Page 51 Line 24 - Add “fire protection.” Page 54 New development requires paved access roads. In the County, it’s the number of trips that trigger the requirements. In Town, it’s required of all new developments to pave their access roads. Add Section H.1.d., “Right of Access. Applicants must provide written evidence of recorded legal access.” The next meeting will be April 14,1999, at 11 ;00 a.m. and will continue with Page 54. The schedule for the review process was discussed. Final draft must be completed in the next four weeks. Planning Commission public hearings will be held in June. The joint Board hearings must be in July as the County Commissioners are not available in August or September.
