Erickson,Glenn Prosser Also Attending:George L.Mowery,Secretary,and Paul Van Horn,Town Engineer Absent:Henry D.Dannels,Charles F.Hix,Marvin L.Steele ** This meeting was called for the express purpose of considering a petition from the Rock Ridge Development Corporation for variances to the subdivision ordinance.The petition is attached to and made a part of these minutes. After considerable discussion,it was moved by Glenn Prosser and seconded by F.S.Erickson that this meeting be recessed until June 5,1970,Friday, at 9:00 A.M.At this time the Connnission members will be given a tour of the land owned by Rock Ridge Development Corporation. .__—June 5,1970 Attending:Chairman Howard Stewart,Ronald C.Brodie,Henry D. Dannels,E.S.Erickson,Charles F.lix,Glenn Prosser Also Attending:George L.Mowery,Secretary Absent:Marvin L.Steele The Estes Park Planning Commission reconvened at 10:15 A.M.Charles F. lix moved that the following resolution be submitted to the Board of Trustees of the Town of Estes Park: RE SO LUT ION BE IT RESOLVED THAT THE MENEERS OF THE ESTES PARK PlANNING COMMISSION FINDS: 1.That the exceptiors are necessary for the preservation and enjoyment of a substantial property right of the petitioner. 2.That the granting of the exceptions will not be materially detrimental to the public welfare or injurious to other property in the neighborhood in which the property of the petitioner is situated or in conflict with the purposes and objectives of this chapter. Therefore the Estes Park Planning Commission recommends to the Board of Trustees of the Town of Estes Park that the exceptions be granted providing the following conditions are met by the petitioner: 1.Participate with the Town in crossing Riverside Drive with water drainage.Assuming one-half of the cost from their subdivision to the river including a culvert under Riverside Drive. 2.Last paragraph of said petition,i.e.”As has been previously stated we will endeavor in any way possible to cooperate with the Town of Estes Park and the Town of Estes Park personnel in order to insure that the roads are constructed properly with proper drainage.” 63 Page two Planning Coimnis s ion June 5,1970 3.Divider will place in escrow 150 percent of all improvements including:streets,sewer,electricity,water and drainage. Also any other improvements necessary to the well being of property owners. E.S.Erickson seconded the motion.Upon roll call the motion unan imously carried. OQ OD HALL &ASSOCIATES SELECT REAL ESTATE AND INVESTMENT PROPERTIES POST OFFICE BOX 269 •ESTES PARK,COLORADO 80517 •TELEPHONE (303)586-2377 PETITION We,the undersigned owners of the land to be known as “Rock Ridge Estates,” hereby petition the Town of Estes Park and the Estes Park Planning Commission as required by Section 21.8 of the Municipal Code of the Town of Estes Park for the following exceptions: 1.21.7—/Cd)—A variance is requested to waive the requirement regarding the minimum length requirements of deadend streets. 21.7—1(f)—A variance is requested to waive the requirement regarding street grades. 3.21.7—1(g)—A variance is requested to waive the requirement regarding intersecting streets with more than four (4)percent grade,a distance of one hundred (100)feet. 4.21.7—1(i)—A variance is requested to waive the requirement regarding minimum center line curvature of street. 5.21.7—1(j)—A variance is requested to waive the requirement regarding minimum tangent lengths between reverse curves. 6.21.7—2 —A variance is requested to waive the requirement regarding average lot widths of one hundred (100)feet as it applies to Lots 6 and 12. The above requests are being made due to the steepness of the terrain of our property and the excessive cuts which would be required in order to comply with these sections of the subdivision ordinance.We feel that these requests,if granted,will not be detrimental to the public good or welfare and that we will still be able to develop this property in a fashion which will be in keeping with the surrounding properties and be an asset to the community.As has been previously stated we will endeavor in any way possible to cooperate with the Town of Estes Park and the Town of Estes Park personnel in order to insure that the roads are constructed properly with proper drainage.Your favorable con sideration will be appreciated.
