HomeMy WebLinkAboutMINUTES Planning Commission 1970-07-21Page two Planning Commission July 21,1970 4.Finds that Mocassin Circle Drive is a local street and finds that compliance with the provisions of Sections 2l.7-l(c)and Ci)of the Municipal Code of the Town of Estes Park is not practicable and waives the requirements of said sections con ditioned upon the dedication of a 60 foot right of way to the Town of Estes Park and construction of 20 foot finished sur face,exclusive of ditch sections and shoulder sections. 5.Waives the requirements of Section 21.7-1(j)of the Municipal Code of the Town of Estes Park. 6.Waives the requirements of Section 21.7-2(a)and (b)of the Municipal Code of the Town of Estes Park as it applies to Lots 6 and 12 as they appear on the Plat. 7.Waives the requirements of Section 21.7-1(e)of the Municipal Code of the Town of Estes Park; SUBJECT TO the filing of a verified petition seeking each of the above exceptions,and THE ESTE S PARK PLANNING CONMISSION FINDS in regard to each such section: 1.That the exceptions are necessary for the preservation and enjoyment of a substantial property right of the petitioner. 2.That the granting of the exceptions will not be materially detrimental to the public welfare or injurious to other pro perty in the neighborhood in which the property of the petitioner is situated or in conflict with the purposes and objectives of this chapter. After considerable discussion,it was moved by Gerald H.Brownfield and seconded by Charles F.Hix that this meeting be recessed until July 22, 1970,Friday,at 8:00 A.M. Brownfield,E.S.Erickson,Charles F.Hix,Glenn Prosser Also Attending:George L.Mowery,Secretary Absent:Henry 0.flannels Minutes of a regular meeting held on June 16,1970 and a special meeting held on July 14,1970 were read and approved as read. Mr.John W.Ramey,Agent for Mr.Jack M.Sugarman,presented plans for a division of Lot 1,Twin View Addition and requested a variance from a minimum 100’average width lot.Glenn Prosser moved this request be denied.E.S.Erickson seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Ronald C.Brodie, Gerald H.Brownfield,E.S.Erickson,Charles F.Hix,Glenn Prosser. Those voting “No”none. Mr.Joe Jenkins,Attorney for Rock Ridge Development Corporation,appeared before the Planning Commission and reviewed past proceedings in regard to Rock Ridge Estates Addition. Mr.Ron Hogan,Consulting Engineer,appeared before the Commission and testified as to the storm drainage plan for Rock Ridge Estates Addition. Glenn Prosser moved that the plat for Rock Ridge Estates Subdivision be denied.This motion died for lack of a second. Gerald H.Brownfield moved that the plat for Rock Ridge Estates Subdivi sion be accepted and the Commission recommend this plat be presented to the Board of Trustees of the Town of Estes Park for their approval. E.S.Erickson seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Ronald C.Brodie,E.S. Erickson,Gerald H.Brownfield.Those voting “No”Charles F.Hix,Glenn Prosser. Charles F.lix moved that the following resolution be submitted to the Board of Trustees of the Town of Estes Park: RESOLUTION BE IT RESOLVED BY THE PLANNING CONMISSION OF THE TOWN OF ESTES PARK,COLORADO: That the Planning Commission recommends to the Town of Estes Park the granting of the following exceptions to the Municipal Code of the Town of Estes Park regarding the Plat of Rock Ridge Estates Addition: 1.Waives the requirements of Section 21.7-1(d)of the Municipal Code of the Town of Estes Park. 2.Finds that compliance with the provisions of Section 21.7-1(f) of the Municipal Code of the Town of Estes Park is not practi cable and waives the requirements of said section. 3.Finds that compliance with the provisions of Section 21.7-1(g) of the Municipal Code of the Town of Estes Park is not possible and waives the requirements of said section. 67 Page three Planning Commission July 22,1970 George I.Mowery,Secretary,read a request from Lewis H.and Mae A. Tiley regarding the splitting of Lot 14,Grand Estates.Glenn Prosser moved this request be denied.Henry D.Dannels seconded the motion. Mr.Paul H.Van Horn,Registered Surveyor,appeared before the Commission and presented a preliminary plat of Webb Cottages,called the Menard Re- subdivision,consisting of a portion of Lots 1 and 2,Block 10,Town of Estes Park.Mr.Van Horn requested the Commission accept this preliminary plat.Henry 0.Dannels moved this preliminary plat be accepted by the Commission.Gerald H.Brownfield seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Ronald C. Brodie,Gerald H.Brownfield,Henry 0.Dannels,E.S.Erickson,Glenn Prosser.Those voting “No”none. Henry 0.Dannels moved that the following resolution be submitted to the Board of Trustees of the Town of Estes Park: RESOLUTION BE IT RESOLVED BY THE PLANNING COMtvIISSION OF THE TOWN OF ESTES PARK,COIDRADO: That the Planning Commission recommends to the Town of Estes Park the granting of the following exceptions to the Municipal Code of the Town of Estes Park regarding the Preliminary Plat of Webb Cottages, called the Menard Resubdivision: 1.Waived street design requirements of Section 21.7-1 of the Municipal Code of the Town of Estes Park because it is not practicable to meet these requirements. 2.Waived lot size requirements of Section 21.7-2(a)of the Municipal Code of the Town of Estes Park on Lots 1,4,5, 7 and 8. 3.Waived requirements of Section 21.9-1(b)of the Municipal Code of the Town of Estes Park pertaining to lots being on public streets before building permits are issued. 4.The access road through the subdivision is termed a private drive.The property owners may use the private drive so long as maintenance is shared. 5.The private drive running from north to south be extended to McGregor Lane. 6.The water and sewer to be installed according to the require ments of the Estes Park Sanitation District and the Town of Estes Park Water Department. Those voting “No”none. Mr.Dwight Whitney,of the Larimer County Planning Commission,appeared and presented a preliminary plat of the Fox Ridge Estates.Mr.Whitney informed the Commission that there was State approval for individual water and sewage treatment systems.Henry D.Dannels moved that this preliminary plat be accepted by the Commission.Gerald H.Brownfield seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Ronald C.Brodie,Gerald H.Brownfield, Henry D.Dannels,E.S.Erickson,Glenn Prosser.Those voting “No” none. There was a discussion by Mr.Dwight Whitney of new concepts of develop ment in the Estes Park area.Where certain grades are encountered there would be no development or possible Planned Unit Development.Under certain grade and slope conditions there is a possibility of Planned Unit Development being the only kind of development that would be allowed. At this point,Member Charles F.Hix arrived and took his place on the Commission. At the request of the Commission,Town Administrator Dale G.Hill pre pared and read the following ordinance: AN ORDINANCE ANENDING SECTION 21.3-3 OF THE MUNICIPAL CODE OF THE TOWN OF ESTES PARK,COlORADO,RELaTING TO PlANNING AND SUBDIVISIONS. Gerald H.Brownfield moved this ordinance be presented to the Board of Trustees of the Town of Estes Park for their approval.F.S.Erickson seconded the motion.Upon roll call the motion passed by the following votes.Those voting “Yes”Ronald C.Brodie,Gerald H.Brownfield, Henry D.Dannels,F.S.Erickson,Charles F.Hix,Glenn Prosser.Those voting “No”none. Chairman Howard Stewart read the following rules and procedures and re quested they be adopted by the Estes Park Planning Commission: 1.All parties to be heard at any regular meeting of the Plan ning Commission must contact the Secretary at least one week before the meeting and ask to be placed on the Agenda.The regular meetings of the Planning Commission are held at the Town Hall on the third Tuesday of the month. 2.The Planning Commission must know who wants time at any regular meeting in order to plan the time the meeting will require and to arrange to have present any Town official or other persons necessary to the proper handling and disposi tion of matters to come before the Conunission. 70 Page five Planning Cournission July 22,1970 3.The Planning Connnission reserves the right to not call upon any person who has come to the meeting to be heard if he has failed to make proper arrangements,or the Coutmission may table the matter until such time as the person or party has complied with Item one (1)of this regulation.This rule applies to everyone. 4.The Planning Connnission cannot fulfill its function unless members of the Coimnission have notification at least a week in advance of a given meeting to study the requests made to it. 5.Please refer to Municipal Code of the Town of Estes Park, Chapter 21.3-2,21.3-3 and 21.3-4.This should clearly give you the reasons for the above rules. 6.All persons to be heard by the Estes Park Planning Conmiission should refer to the Code for guidance as this is the Rule Book for the Conmdssion to follow.Sub-dividers,especially, should follow the Code.This code is always available in the office of the Town Clerk.
