CONSENT AGENDA a. Estes Valley Planning Commission Minutes dated November 18, 2003. b. Amended Plat of Lot 6, Spanier Subdivision and a Portion of the East Half of the Northeast Quarter of Sec 11, T5N, R73W, 1738 & 1752 Highway 66, Applicants: Sue Lamb and New Spall, LLC 1. Pursuant to C.R.S.30-28-110, sub-section 4(a), “no plat for subdivided land shall be approved by the Board of County Commissioners unless at the time of the approval of platting the subdivider provides the certification of the county treasurer’s office that all ad valorem taxes applicable to such subdivided land, for years prior to that year in which approval is granted, have been paid.” 2. Access easement to the burial plat shall be shown, including book and page number. c. Preliminary Condominium Map, Mummy Mountain Condominiums, Portion of NE 1/4, NW 1/4, SW 1/4, SE 1/4, Sec 35, T5N, R73W, 1700 Mary's Lake Road, Applicant: North Lake Development, LLC 1. Compliance with Greg Sievers' memo to Alison Chilcott dated November 26, 2003. d. Preliminary Condominium Map, Lofts at Estes Condominiums, Portion of Lot 30 and 39 Feet of Lot 29, Riverside Subdivision, 150 East Riverside Drive, Applicant: SRG Properties, LLC 1. Compliance with Greg Sievers' memo to Alison Chilcott dated November 25, 2003. It was moved and seconded (Pohl/Hix) that the Consent Agenda be accepted and it passed unanimously with one absent. 2. PUBLIC COMMENT None. 3. REZONING, LEPPERT SUBDIVISION, LOT 19, GRAND ESTATES, 450 Lakefront Drive, Applicant: Timothy & Heather Leppert Planner Chilcott reviewed the staff report. This is a request to rezone a portion of an existing “E-1” zoned lot to “E” to enable the applicants to subdivide the lot into two lots, one meeting the minimum lot size requirements for an “E-1” zoned lot and the other meeting the lot size requirements for an “E” zoned lot. The entire lot Is currently zoned “E-1” Estate and is 1.84 acres. With the current zoning this lot cannot be subdivided. The rezoning is not necessary to address changes in conditions in the area. No changes in conditions in the area have occurred since the rezoning that occurred with the adoption of the Estes Valley Development Code. The subdivision sketch plan submitted with this request is not compatible or RECORD OF PROCEEDINGS Estes Valley Planning Commission 2 December 16, 2003 consistent with the policies and intent of the Comprehensive Plan. Nor is it compatible or consistent with existing growth and development patterns in the Estes Valley. Planner Chilcott read aloud the letter from Jim and Deborah Watson in which they oppose the requested rezoning. Tim Leppert, 107 Hunters Cove Road, Mead, CO, was present. He stated they purchased the lot this summer with the intent to build a home and move to Estes Park. Their conversations with the previous landowners led them to believe they could subdivide the lot in order to build a second house for his parents. He also stated that since the original plotting of Grand Estates several of the lots have been divided. His lot is adjacent to accommodations property to the north and the east and does not feel subdividing the lot would alter the character of the neighborhood. Public Comment: None. It was moved and seconded (Horton/Pohl) to recommend denial of the Rezoning Request for the Leppert Subdivision, Lot 19, Grand Estates, 450 Lakefront Drive and it passed unanimously with one absent. 4. AMENDED PLAT OF LOTS 2, 3, 8 and 9, CHARLES HEIGHTS SUBDIVISION, 1160, 1170 and 1180 Meadow Lane, Applicants: Michael & Christine Kellam and Renee Tuthill Trust Planner Shirk reviewed the staff report. This is a request to vacate a portion of the Meadow Lane right-of-way and dedicate an access easement. In addition, the property line in the southeast corner of Lot 2A is being adjusted to match an existing fence line. The triangular portion of right-of-way to be vacated will be absorbed by the applicant (Kellam). Vacated right-of-way is typically split between property owners on each side. The proposed right-of-way vacation shouid be scaled back to allow for the road, associated drainage ditches, and sewer main to remain in the right-of-way. This proposal complies with applicable sections of the Estes Vailey Deveiopment Code. Public Comment: Mary Ellen Garrett, 1230 Meadow Lane, President of the Charles Heights Homeowners Association was present. She stated the Homeowners Association is not opposed to the proposed vacated right-of-way as long as the Kellams are required to pay their portion of the road maintenance as they have done in the past. Michael Kellam 1170 Meadow Lane was present. Mr. Kellam discussed the original platting of the subdivision. He stated the triangular shape of right-of-way was originally platted to give road frontage to Lot 3 which he currently owns. His family purchased the lot in the 1960’s and has maintained the triangular portion of land which their driveway crosses through. This amended plat will allow them to own the land on which their driveway currentiy sits. He aiso stated by adding the right-of-way to Lot 3 it will bring the iot up to the minimum lot size for “E-1” zoned lots. Commissioner Horton questioned if the appiicant is in agreement with the staff conditions. Mr. Keiiam stated he is in agreement with the staff conditions. It was moved and seconded (Horton/Hix) to recommend approval to the Board of County Commissioners the Amended Plat of Lots 2, 3, 8 and 9, Charles Heights Subdivision, 1160, 1170 and 1180 Meadow Lane and it passed unanimously with one absent. 1. A 20 foot wide utility easement shall be dedicated from the proposed private access/public utility easement to the eastern property line of proposed Lot 8A. 4. The proposed right-of-way line shall be at least 10 feet from the existing sanitary sewer line. ... u u 5. REZONING AND PRELIMINARY PLAT, LOT 3 AND LOT 4, SKOOG SUBDIVISION, 1925 Homestead Lane, Applicant: John Skoog The applicants have submitted a written request to continue the item to the January 20, 2004 Planning Commission meeting. Public Comment: None. It was moved and seconded (Hix/Kitchen) to continue the item to the 'fanu^jy 2^2004 Pianning Commission meeting and the motion passed unanimousiy with one absent. 6. REPORTS Director Joseph and Planner Shirk reported on recent Town Board and County Commissioner actions. Director Joseph reported on the new Town fee schedule for 2004.
