Chair Amos called the Meeting to order at 3:30 p.m.
Minutes of the January 27,1999 meeting were accepted as presented.
Chair Amos opened discussion on the chapters under review of the draft Estes Valley
Development Code.
CHAPTER 3: DEVELOPMENT REVIEW AND ADMINISTRATIVE PROCEDURES &
GENERAL REVIEW STANDARDS

Line 42, delete the words “and appealable.”
Line 18, add “working”before days.
Page 5
Delete first paragraph, lines 1-6; third paragraph, lines 16-21; and last paragraph
beginning on line 46. Caseload management was also discussed.
Page 7, Summary Table-Standard Development Review Process by Application
Type, delete last column, “Comments.” Also make reference to Table 2-1: Code
Administration and Review Roles.
There was some discussion regarding the complexity and length of some of the
sentences in this chapter.
Page 11, under D.2., add “by Staff and Planning Commission” after “shall be
reviewed and evaluated.”
Under 3.5/Special Review Uses, delete A.1.
Page 12, under 3.6 / Variances, it was noted that the creation of an Estes Valley
Board of Adjustment would require an Intergovernmental Agreement. Town Attorney
White will review this with the County Attorney. Under Paragraph B.1., replace the
sentence ‘The EVBOA shall hold a public meeting on the application within twenty-
one (21) days of submittal of a complete application” with the sentence “Applications
to the EVBOA shall be submitted twenty-one (21) days prior to a regularly scheduled
meeting.” Chair Amos noted that the ruling of the EVBOA is appealable to the
District Court.

Page 14, under Section 3.7/Administrative (Minor) Modifications, the phrase “for
reasonable economic use” appears three times; delete all three.
Page 16, in the first line of Paragraph B., delete “be submit” and replace with “be
subject to.”
Page 17, in subparagraphs C.1 .a.and C.2.a., delete the two sentences beginning
“Unless the Board by an affirmative vote ....”
Page 18, under subparagraph D.2.a., add the word “minor,’ before subdivision on the
sixth line, then move that entire sentence to Paragraph E., Standards for Review, on
Page 19. In Subparagraph D.2.b., add “also” to the second line after “shall” and the
word “minor” before “subdivision” on the fourth line.
Page 19, delete the word “consent” from the third line of subparagraph D.3.b. and
the second line of D.3.c.
Comments were made regarding Staff authority before submittal to the Planning
Commission and after their review.
The determination of a quorum will be in the bylaws.
EPURA projects are still subject to review.
CHAPTER 6: NONCONFORMING USES, STRUCTURES, AND LOTS
Page 2, line 24, replace “or abandoned is” with “is abandoned or.” Under
subparagraph 6.6, B. “Less Than Fifty (50) Percent” replace “six (6) months” with
“one (1) year1’ and replace “eighteen (18) months” with “two (2) years.”
Page 3, delete subparagraph 6.9, A.1 .b. and all of paragraph 6.9 B.
CHAPTER 9: PLANNED UNIT DEVELOPMENTS
Planned Unit Developments are forthe purpose of mixed use combining commercial
and residential.
Inthe first line under 9.1/Purposes, delete the words “morals” and “integrity.” Delete
paragraph 9.1 C. entirely. Delete the phrases “clean, safe, and pleasant” and “and
industrial” from paragraph E so that it reads “to provide for well-located, commercial
sites and well-designed residential developments....”
Discussion regarding the need for bylaws was held in regard to the upcoming public
hearings.
The discussion for the remainder of Chapter 9 was continued to the next scheduled
meeting on February 24,1999. That meeting is scheduled from 3:30 p.m. until 8:30
p.m. with a dinner break.
