Announcements: The Rocky Mountain Land Use Institute will be March 11 & 12, 1999. Director Stamey has/will provide a copy of the brochure to members. Chair Sager recognized that Director Stamey will be part of the Rocky Mountain Land Use Institute program, as well as on the program for the American Planning Association meeting being held in Seattle in April. Congratulations made to Director Stamey. Election of Officers Wendell Amos was nominated as chair. Since no other nominations. Chair Sager declared Commissioner Amos as the new chairman. A1 Sager was nominated for vice-chair, but declined. Ed Pohl was nominated as vice-chair and as there were no other nominations, he was declared the new vice chairman. The Community Development Secretary, or designee, was appointed as Recording Secretary. The meeting was adjourned, and Commissioners went into study session under the direction of Chair Amos. Study Session Commissioner Taddonio requested the opportunity to meet individually with Director Stamey and also to have a time established for future meetings. It was confirmed that any commissioner may request an individual meeting for clarification purposes with Staff at any time. Discussion was opened for Chapter 1 of the Estes Valley Land Development Code. CHAPTER 1: GENERAL PROVISIONS BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS PAGE 1 Under Purpose and Intent, Line 22 - the word “morals” was deleted. Line 25 - the word “provide”should be changed. Line 35 - replace with ‘To coordinate land use and transportation planning to provide for a safe and efficient transportation system in the Estes Valley.” Line 37 - revise to say “Work to improve...” PAGE 2 Line 7 - change to “Provide adequate building setbacks and height limitations.” Line 9 - replace with “Encourage orderly and efficient distribution of the Estes Valley population through land use regulation.” Section 1.4/Applicability; Paragraph A - needs to be more specific; add “Plan” after Comprehensive. Under 1.5/Minimum Standards and Compliance: Paragraph B - concern over existing non-conforming. Add Paragraph C. “See Chapter 6 for non-conforming uses/structures.” Line 41 - delete the “s” on open areas. PAGE 3 No change required. PAGE 4 Line 9 - Under Paragraph I, Gender, add “and vice versa”. Paragraph D Changes to Map - add “see chapter 3" at the end to indicate any change to zoning will have a public hearing. Line 13 - Official zoning map is not finalized yet-will be concurrent with the Development Code. Paragraph B - any change to zoning has to have a public hearing. Make reference at the end of this section to “See Chapter 3.” PAGES Under Section 1.9 Rules of Measurement, Paragraph A. Lot Area Measurement, Line 28-29 - rights of way shall not be included in lot area, but that does not include easements. Private streets must meet public street standards. It was noted that the Town will accept roads in new subdivisions for maintenance, whereas the County does not. PAGE 6 Under Paragraph C. 2, Line 10 - replace “will” with “shall”. In Sub-paragraph d.. Line 35 - delete “side or rear”. In Sub-paragraph e.. Line 39 - replace 3 feet with “42 inches in height to comply with UBC’ PAGE 7 For Sub-paragraph 4. Height - Staff presented an option to measure maximum building height to replace Section a. Measurement of Maximum Building Height. The maximum building height shall be established by a plane measured vertically above the existing natural terrain elevation prior to grading. Height shall be measured as the vertical distance in feet from the original natural terrain within the building footprint to that point of the finished roof situated directly above the point of measurement. Small areas of rugged terrain inconsistent with this plane will not increase or reduce building height. Small areas are those features with a maximum width of twenty-five (25) feet. PAGES 1.10/ Transitional Provision, B. Completion of Development Plans Commenced or Approved Under Previous Ordinances, Line 24 - add a comma after the word “period.” BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Under Section 1.12/ Severability, Line 48 - delete “or of the Municipal code as a whole.” Under Section 1.11/ Liability for Damages, Line 41 - delete “city or its” and replace with “town, county or their.” Note: wireless teleconununications facilities are exempt from height standards due to federal legislation. CHAPTER 2: CODE ADMINISTRATION AND REVIEW ROLES PAGE 1 - identifies roles of relevant administrating bodies. Line 29 - will have to be determined by County and Town Attorneys since currently they are different. In cases where the town and the county have different policies, the code will be adopted with the necessary differences due to technical or legal reasons. Statutory differences will also have an effect. This code will supercede the county zoning code; the new county code will exempt Estes Valley. CHAPTERS: DEVELOPMENT REVIEW AND ADMINISTRATIVE PRO CEDURES & GENERAL REVIEW STANDARDS PAGE 1 Subparagraph D. 2. Exceptions-Subdivisions and Planned Unit Developments - This section is required by state statute. In Paragraph C. Incomplete Apphcations or Insufficient Fees, Line 24 - add “working” after “seven” and before “days.” Regarding Paragraph a. Authority to File Applications - applications must be filed by “record owner” to prevent speculation by a third party. PAGE 2 Subsection H, Permitted Scope of Action by Decision-Makers, should include continuation as an option. PAGES In Paragraph A, the Pre-Application Conference is a new requirement, currently the Town does not require one. FINAL COMMENTS The next meetings will be February 10 from 3:30 to 5:30 p.m. and February 24 from 3:30 to 8:30 p.m. with a one hour dinner break at 5:30 p.m. The remainder of Chapter 3 and Chapters 6,9 and 10 will be discussed.
