Following further discussion, it was moved and seconded (Sager-
Barker) the request for setback variance be approved, said variance
to be temporary until such time as the Applicant is able to
relocate the cooler to an area within the building or, until such
time as EPURA or another entity proceeds with redevelopment of the
Cleave Street area. Should redevelopment occur, the Applicant will
not receive compensation for this addition, and, this motion will
be passed, pending Town legal counsel's approval of its wording,
and it passed unanimously.
Town Attorney White has advised staff that Snowdance I will be
required to enter into a written agreement with the Town, which
sets forth the terms of the temporary placement and removal of this cooler.
There being no further business. Chairman Habecker adjourned the meeting at 9:45 A.M. J
