Chairman Habecker called the meeting to order at 9:00 A.M.
APPROVAL OF MINUTES.
Minutes of the meeting held May 1, 1991 were approved as submitted.

Building Official Allman stated the Applicant is requesting approval to

The Applicant explained the setback history of the property, as well as the
surrounding properties, noting all existing setbacks are presently non-
conforming; thus, the Applicant is requesting a variance. All effected
property owners have been notified and, although there are no objections to
either item, none of the owners wish to trade or sell land so that the
setback requirement for the proposed carport construction can be met by
Applicant.
It was moved and seconded (Sager-Garrett) the variance request for both items
be denied. Those voting "Yes" Member Sager. Those voting "No" Chairman
Habecker, Members Garrett, Newsom. The motion failed.
Chairman Habecker noted that the powers and duties of the Board of Adjustment
include the following: "The Board is authorized to grant a variance where the
strict application of the ordinance in question will result in unnecessary
hardship, and a variance can be granted without harm to other landowners in
the vicinity, and without doing violence to the purposes of the code
provisions and the overall planning scheme. In order for an applicant to be
d a variance/ he must show that, by reason of exceptional narrowness,
shellowness, or slope on his property, or by reason of exception, topographic
conditions or another extraordinary and exceptional situation or condition of
his„ prc^erty, he will be denied the use of his property for any economic
