APPROVAL OF MINUTES. Minutes of the meeting held January 14, 1991 were approved as submitted. 326 VIRGINIA DRIVE - REQUEST FOR VARIANCE. The applicant, James Baranovic, proposes to build a two story addition for the purpose of a manager's office and dwelling, instead of the one-story addition that was previously approved. On November 4, 1987, the Board of Adjustment approved a request for nonconforming use and nonconforming density. On October 12, 1988, Mr. Baranovic requested an extension of time to complete the seven unit project. Contained within an April 16, 1991 staff report, the findings are as follows: 1. The subject property is located on a triangular shaped lot at the corner of Virginia Lane and Wonderview Avenue, a highly visible site. 2. The location of the structure will not create a sight obstruction. 3. A setback variance will not be required. 4. The two-story addition must be kept in the same footprint. In consideration of the Board of Adjustments November 4, 1987 approval for nonconforming density, staff recommends approval of the alteration. Member Sager noted that one of the conditions to the previous variance was not completed, i.e. the rock wall along Virginia Drive which was to be extended to the northwest property line. Mr. Baranovic stated the rock wall had been 90% completed at a cost of approximately $450.00 shortly after the Board of Adjustment's approval, but the Town informed him the wall would have to be removed because it was in the street right-of-way. Member Sager also noted the plot plan should be updated to reflect existing conditions in the area. Building Inspector Allman stated the setbacks shown on the plot plan appear to be accurate. A May 30, 1991 letter from Robert Muirhead, owner of the property at 320 Virginia Drive was entered into the record. Mr. Muirhead's letter requested that if the variance is approved, the three following conditions should be met: 1. The unit should not be split as a multiple rental. 2. Construction should be completed within a 90 day period, including cleanup. 3. A floor plan should be submitted prior to granting the variance along with the request. Member Newsom commended Mr. Baranovic for his prior improvements to the property. It was moved and seconded (Garrett-Sager) the variance request at 326 Virginia Drive be granted with the following conditons: 1. The new plot plan be brought up to date prior to a building permit being issued. 2. The unit not be split as a multiple rental. 3. When the floor plan is submitted and building permit issued, the applicant be allowed ninety days for exterior construction and cleanup. and it passed unanimously. There being no further business.
