Chairman Habecker called the meeting to order at 4:00 P.M. to
continue consideration of the following which was originally
scheduled for review July 3, 1991:

that it would not be economically viable to reduce the density from
8 units.
There were no speaking in "favor of" or in^ "opposition to" the
variance request; however, questions were raised by Jess Morrell,
representing the Fairway Homeowner's Association--would the new
units be included in the existing homeowner's association, to what
distance do the decks extend into the 16' setback, what is the
fence height, when Highway 7 is widened, will the 25' setback be
affected, landscaping/visual line, and drainage. Mr. Van Horn
stated that the new units will be included in the existing
homeowner's association, the patios extend 8', the fence height is
5' and the corner of the building will not include a fence, the
Highway 7 widening will occur in the existing right-of-way.
Planning Commission will address landscaping relative to vehicle
and pedestrian safety, and a drainage Plan. .has. .a#>lrpe;fff1ye approved by the Town. Henry Nelson, representing the Eagle View
Condominium Association commented on parkingandadvised thatthi
nroDOsal will be discussed by the Board of Directors at their
meeting 7/19/91. Staff confirmed that any existing covenai^s Pre“
date 1^e * foreclosure and that the property is subject to such
covenants. Staff reiterated that the parking portion of this
proposal will be considered by the Planning Commission.
In conclusion, the corner setback will not be changed, the patios
and fences will encroach into the setback, and Zoning Regulation
do allow zero side yard setbacks.
There being no further testimony, it was moved and
(as illustrated) be allowed 10' into the setback, and it passed
unanimously.
