January 24, St. Bartholomew the Apostle Church, 880 MacGregor Avenue, Request for Variance Concerning Setbacks Mr. Roger Thorp, representing petitioners, submitted their request for a variance from Section 17.20.040, B.l.b. of the Municipal Code, which requires a ten foot side yard setback, and from Section 17.16.040, E. concerning expansion of a nonconforming building. The Board decided to consider these items separately. Mr. Thorp stated that he had been working with the building committee of the church to develop a workable plan for expansion. The proposal is to develop a multi-use parish hall north of the existing building. Mr. Thorp commented that due to narrowness of the lot, sloping conditions, and the nearby creek, they were somewhat constrained in place­ ment of the addition. The proposed location will place the addition three feet from the north property line instead of the required ten feet. Letters were submitted from adjacent^ property owners (MacGregor Ranch and Black Canyon Inn) advising they had no objections to this proposal. The zoning of adjacent property is F-0 (County) which requires a 100 ft. setback from the property line, therefore the proposed 3 ft. setback would not create problems. Mr. Ron Osborn, representing MacGregor Ranch, commented that there were no future plans for development of the property abutting the church and, therefore, had no objections to the variance request. Member Sager questioned changes that had been made in the typewritten letters received from MacGregor Ranch (signed by Eldon G. Freudenburg) and from Black Canyon Inn (signed by Gary L. Ludwell). The dimensions from the property line noted in the letters had been changed from within 10 ft. to "3 ft.". Member Sager questioned if these revisions had been made before the letters were signed or after and was advised by Mr. Ralph Read, Chairman of the building commit­ tee for the church, that the changes had been made by bim after the letters were signed (and after discussion with town staff), to more accurately reflect the footage. He changed the "estimated" footage to "actual" footage and both adjacent property owners were aware of the change. After further discussion. Member Barker moved to grant the setback variance and permit a 3 ft. setback from the property .line. Member Lamson seconded the motion and it passed unanimously. The anticipated uses and functions would remain the same but the area would be expanded to better house the sacristy and offices.
