Minutes of the Board of Adjustment meeting held March 30, 1989 were submitted and approved. 2. O. M. Naql - Wheel Bar - Setback Variance Request, 132-136 E. Elkhorn Avenue Member Sager advised the Board of a conflict of interest and would abstain from discussion and voting on this request. Planner Stamey summarized the staff report advising that petitioner is requesting a variance from Section 17.20.040 A., in the C-D District to permit an outdoor seating/eating area along Fall River. A 10 ft. setback from Fall River is required. Mr. Steve Nagl, Manager of the Wheel Bar, addressed the Board, stating that materials compatible with the park area would be used. The present rock wall would be raised and, as a safety measure, fencing would be installed around the area. Mr. Nagl further stated that a public access easement would be dedicated and, at such time when the Town would need this area for a pedestrian riverwalk, they would relinquish the use of it. Town Attorney White inquired as to who would be responsible for the cost of removing the rock wall and fencing when the area is returned to the Town and Mr. Nagl advised that, at such time, the Wheel Bar would be responsible for the cost involved. Member Garrett moved for approval of this variance request with the condition that a public access easement be dedi­ cated to the Town, and, at such time when the Town would require this area for a pedestrian riverwalk, it would be returned to the Town. Petitioner will also provide the Town with a legal description of the area within two weeks, and appropriate documents will be prepared and executed granting a public access easement. Member Barker seconded the motion and the vote was unanimous with Member Sager abstaining. 3. Arnold & Rov Johnson - Variance Request to Permit a Twg^ Family Dwelling on a Nonconforming Lot, 160 Wonderview AveJL Planner Stamey advised the Board that this lot was created prior to 1971 under the old code, and the old density rules still apply until 1991. The old code provided different density rules in that a lot having 7,000 sq. ft. of land area in the multiple family district could have a one or two family dwelling on that lot. The old code also provided that a lot having less than 7,000 sq. ft. of area, could have a single-family dwelling on it if it was a lot of record. BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Board of Adjustment - June 7,1989 - Page 2 Planner Stamey further advised that applicant presently has approximately 6,917 sq. ft. of land area, just shy of the required 7,000. A single-family dwelling exists and applicant is requesting a variance to add a second dwelling unit. Mr. Roy Johnson commented that the existing house was built in the 1940's and it is his desire to update and remodel the property. An extension is proposed on the existing house to be connected by a breezeway between the two buildings. He stated he had consulted with Building Official Allman regarding setbacks and subsequently has moved the deck back 6 feet to allow for ample parking. Building Official Allman commented that the units were small, approximately 24' x 28' (less than 700 sq. ft. each) and not overwhelming on the lot. Member Barker moved for approval of this variance request. Member Garrett seconded the motion and the vote was unan­ imous . 4. REPORTS Chairman Habecker stated that he would like the members to review Larimer County's meeting procedure statement and have staff prepare something similar. There being no further business, the meeting adjourned.
