Mayor Dannels opened the meeting and asked for a motion for nominations for Chairman to replace Paula Laing who resigned from the Board last month. Member Lamson nominated Mark Brown, Member Habecker seconded the motion and the vote was unanimous in favor of Mark Brown as new Chairman. 2. PUBLIC HEARING ^.Q. BRADFORD PUBLISHING CO.RECORD OF PROCEEDINGS Board of Adjustment - March 12, 1987 - Page Two Existing Shed The second portion of the request for a setback variance to maintain the existing "shed" was discussed. The shed has a building setback of approximately 6' from the south property line. It is used for vehicle washing, preparation and detailing, and storage. Planner Stamey noted that the shed was built without a building permit, plan review or inspections. A Certificate of Occupancy has not been issued for this addition. The building also encroaches into a public utility easement. Mr. Bill Van Horn represented the applicant and stated the owner didn't think he needed a building permit for this addition. If the addition were allowed to stay, the owner would apply for a building permit. Mr. Hank Rains^ stated he would like to keep the shed. Member Sager stated it was his recollection that the Town's previous Building Inspector advised of the building permit requirement and setback problem when construction first started. Mr. Rains stated that to the best of his recollection, the previous Building Inspector didn't contact him until about 90 days after the addition was completed. Discussion also considered the encroachment utility easement. Town Attorney White advisedofth^^e would probably give up its right for use of the utili y easement if the variance were granted.
