Street, W 1/2 of Lot 19, 20,21, Block 8, Town of Estes Park
Mr. Richard Mirecki presented his request for a variance
from Section 17.20.040 of the municipal code. Applicant is
proposing to extend the second floor porch approximately 15
ft. to the East and 6 ft. to the South over the existing
garage. The present setback is 6 1/2 ft. from the property
line. The proposed porch would have a setback of approx-
^ inches from the street property line. An 8 ft.
setback is required. A variance was granted in 1981 on a

Mr. Bill Van Horn, representing Michael Martin (owner) and
James Baranovic (proposed purchaser), presented the request

Planner Stamey summarized the staff report stating that the
pre-1972 nonconforming density rule applies to this site
requiring 7,000 sg. ft. of land area for each separate one-
family dwelling or two-family dwelling. Thus, the maximum
number of permitted buildings on the site is two compared to
the existing four. For multi-family development, the code
requires 7,000 sq. ft. of land area for each separate
building, plus 1,000 sq. ft for each dwelling unit in excess
?£a5WO in the building. Planner Stamey further stated
that more buildings_ are presently on the site than the
nonconforming density rule allows and this request would
increase the extent of nonconformity. The code has a
provision to permit additional dwelling units on the
