Member Lamson seconded the motion. Member Habecker submitted,
and read aloud, a letter stating his position and philosophy
concerning the purpose and workings of the Board of Adjustment as
pertaining to the Hupp Hotel. Member Habecker urged the Board
not to vote for the motion. Planner Stamey stated any agreement
should be between the Board of Trustees and the applicant, not
the Board of Adjustment. Planner Stamey questioned the mechanism
to enforce such a condition and that the Board could not obligate
the Board of Trustees. Town Engineer Widmer reported the
applicant had met with the Public Works Committee seeking ^ an
easement and the request was being considered. Those voting
"Yes" Members Lamson and Sager. Those voting "No* Members Brown,
Habecker and Laing. Member Habecker moved the variance request
be granted subject to the petitioner negotiating, "in good
faith", with the Town to remove the encroachment. Member Brown
seconded the motion and it passed unanimously.
There being no further business, the meeting adjourned.
