SAMUEL PARKER - STRUCTURAL ALTERATION FOR NON-CONFORMING BUILDING
- 101 WEST ELKHORN AVENUE, SUITE F;
Samuel Parker, petitioner, appeared requesting a variance to
structurally alter a non-conforming building located at 101 West
Elkhorn Avenue. The existing restrooms do not meet Building Code
Standards; Mr. Parker wishes to remodel the interior of Suite F
to make it usable for its intended use as a restaurant and
construct additional restrooms. The building is non-conforming
due to the building setback of less than eight feet from the
property lines on Cleave Street and Big Horn Avenue. The new
restroom addition will meet setback requirements. Correspondence
and/or communication was received from the following:
Building Inspector Jones..................................5/07/85
Town Planner Stamey.............................................5/07/85
Frank Hix.......................................... 5/02/85
Charlotte Miller
Existing building code standards require that the new restrooms
be accessible to the handicapped. Town Engineer Widmer informed
the petitioner that relief could also be sought from the Board of
Appeals due to the expense involved. Discussion followed with
Member Sager moving Mr. Parker's variance request be approved
including a recommendation that efforts be made to have the
exterior of the new structure match the existing building.
Member Brown seconded the motion and it passed by the following
votes: Those voting "Yes" Members Brown, Laing, Lamson, Sager
and Wood. Those voting "No" none.
There being no further business, the meeting adjourned.
Vickie O'Connor, Town Clerk
