COLORADO MOUNTAIN SCHOOL - BUILDING VARIANCE - 351 MORAINE
AVENUE;
Colorado Mountain School, petitioner, requested a variance to
structurally alter a non-conforming building (Section 17.68.070).
The subject building is non-conforming because of its proximity
to the north property line. All required construction will take
place internally. Chairman Wood read a letter dated February 12,
1985 received from adjacent property owners Mr. and Mrs. Byron L.
Graves, stating they had no objection to the variance. A
memorandum dated February 20, 1985 submitted by Building
Inspector Jones. He had been contacted by adjacent property
owners, Venta, Inc., who had no objection to the variance
request. Member Sager expressed concern regarding a possible
public safety hazard located on Lot 16A which is a barrier
between the building in question and the fence (the west and
south sides of Lot 16B) . Town Engineer VJidmer stated the
liability lies with the property owners in this particular case,
not the Town, in preserving the public safety. Mr. John Ramey,
adjacent property owner, stated he had no objection to the
variance; however, the building in question was encroaching on
his property. A photograph of the existing building was submit
ted by Planner Stamey. It was determined the encroachment
situtation was a civil matter between the Mr. Ramey and Colorado
Mountain School. Member Brown moved the variance requested by
Colorado Mountain School be granted. Member Sager seconded the
motion and it passed by the following votes; Those voting "Yes"
Members Brown, Laing, Sager and Wood. Those voting "No" none.
There being no further business, the meeting adjourned.
