ESTES CENTRE ASSOCIATES - BUILDING & HEIGHT VARIANCE - 145 EAST
ELKHORN AVENUE:
The developers, Estes Centre Associates, are requesting a vari
ance from Section 17.72.070 (no building shall exceed 30-feet in
height), and Section 17.68.070 (no building shall be structurally
altered if it does not meet current code requirements) , for the
renovation of the building formerly housing "Ripley's Believe It
Or Not." The developers are replacing a roof v/hich is struc
turally incompatible with the renovation of the building. The
roof should not be very noticeable from East Elkhorn Avenue due
to the existing front parapet. A memorandum, dated January 2,
1985, submitted by Building Inspector Jones was read and made a
part of the record of proceedings by reference thereto. No
correspondence was received; however. Building Inspector Jones
stated a discussion was held with adjacent property owner Ormond
Rose; Mr. Rose did not have an objection to the proposed vari
ance. Member Sager stated the criteria regarding building height
in the proposed Commercial Zoning Regulation Amendments, should
be followed and/or recognized. Executive Director Anderson,
representing the Estes Park Urban Renewal Authority, stated a
motion was made in the Authority's January 16, 1985 meeting to
support the proposed variance. Member Laing moved the variance
requested by Estes Centre Associates be granted. Member Brown
seconded the motion and it passed by the following votes: Those
voting "Yes" Members Brown, Laing, Lamson, Sager and Wood. Those
voting "No" none.
ASPEN DENTAL CENTER - SIGN VARIANCE - 552 WEST ELKHORN AVENUE:
William R. Pike, D.D.S., petitioner, appeared requesting a 7-foot
variance for a free-standing sign (Section 17.66.300-2) on the
east side of the existing dental office located at 552 West
Elkhorn Avenue. Building Inspector Jones' memorandum dated
December 13, 1984, was read into the record and made a part of
the record of proceedings by reference thereto. Dr. Pike stated
he desires a low-profile free-standing sign located on the east
side of the dental office which would not be objectionable to
adjacent property owners. Member Sager questioned if the sign
could be located on the building panels themselves; Dr. Pike
answered yes, however, that was the second preference. Member
Brown questioned the location of the sewer manhole which is in
line with the northeast property line. Building Inspector Jones
stated items such as signs are allowed in utility easements.
Member Lamson stated he concurred with Dr. Pike preferring a "low
profile" sign. Stating the variance request did not meet the
third criteria for granting such a variance which reads as
follows: 3. The variance is the minimum one necessary to permit
the applicant to reasonably draw attention to his business or
enterprise.; Member Sager moved the sign variance request be
denied. Member Brown seconded the motion and it passed by the
following votes: Those voting "Yes" Members Brown, Laing, Sager
and Wood. Those voting "No" Member Lamson.
There being no further business, the meeting adjourned.
