JOHN CARMACK, 140 BOYD LANE - ALTERATION OF NON-CONFORMING
BUILDING:
Mr. John Carmack appeared requesting a variance to alter a
non-conforming building. The building is non-conforming due to a
7.8' setback at the northeast corner; due to poor drainage of the
flat roof, Mr. Carmack was seeking relief from Section 17.68.070
which would allow rebuilding of the roof with more pitch. No
communiciation or correspondence in favor of or in opposition to
the variance was received. Upon clarification concerning access
to the property. Member Sager moved the Carmack Variance Request
be approved. Member Brown seconded the motion and it passed
unanimously.
AMENDMENT TO SECTION 17.68.070 OF THE MUNICIPAL CODE -
DISCUSSION:
Acting upon Town Engineer Widmer's suggestion, the Board
discussed amending Section 17.68.070 Alteration of Non-conforming
Buildings to allow Administrative review and approval of some
variance requests in lieu of the applicant appearing before the
Board of Adjustment. An applicant would be able to appeal to the
Board of Adjustment regardless of Administrative decisions.
Following discussion,;Member Sager moved the Town Board consider
revising the requirements setforth in Section 17.68.070 to allow
staff review and approval of some variance requests. Member
Laing seconded the motion and it passed unanimously.
There being no further business, the meeting adjourned.
