SPOMER - SIGN VARIANCE: Mr. Todd Plummer, representing the owner, appeared requesting a height and setback sign variance at the intersection of Peak Viev; and Prospect Estates Drives. The Sign Code requires 10' setbacks from the travelled way; the owner is requesting 5' setback from the edge of the asphalt. Mr. Plummer stated this setback would not result in traffic safety problems. The height variance request is for 3'8" in lieu of the 2'6" requirement. A 30" height variance would allow the signs to remain (which are already under construction). No visibility problems are antic­ ipated. The sign would be of a permanent nature using moss rock and including a redwood face to identify the subdivision. Mr. Dean Wariner, owner of Lot 18, stated the sign would create no safety hazard. When asked if Mr. Wariner would allow an easement for the sign on his property in order to meet the 10' setback requirement, Mr. Wariner stated "yes." Public Works Director Widmer stated the minimal 5' dimension would not interfere with snowplows; however, the signs might not always be visible due to the snow being thrown to the right side of the road thus covering the signs. An existing 'For Sale' sign is also located in the subdivision; however, this sign does not meet Sign Code due to the pictorial representation of the subdivision on the sign. Mr. Plummer stated the 'For Sale' sign could be brought into compliance. Planner Stamey stated no correspondence was received. Member Sager moved the height portion (height to be determined by Staff) of the variance be approved and the setback portion of the variance be denied. Member Brown seconded the motion and it passed unanimously. ROBERT E. BURGESS - SETBACK VARIANCE - 141 WEST WONDERVIEW: Mr. Robert E. Burgess, petitioner, appeared requesting a 17' setback variance to build a carport and deck in the southeast corner of his property bordering the State Highway. The setback required is 25'; this variance would leave a setback of 8'. Mr. Burgess stated he had used this piece of property a number of years for his vehicles. Planner Stamey stated he had received a telephone call from Wally Jacobsen (State Highway Department) November 14, 1984. Mr. Jacobsen stated the State Highway Department is opposed to the variance request due to the possibility of the department's need to use their right-of-way in the future, backing movements in the right-of-way and potential safety problems. Discussion followed with Member Brown moving the variance be granted. Member Laing seconded the motion and it passed by the following votes: Those voting "Yes" Members Brown, Laing, Lamson and Wood. Those voting "No" Member Sager. VARIANCE SUBMITTAL PROCEDURE: Member Sager moved staff reports for each variance request, (when appropriate, as determined by the Chairman), accompanied by pertinent drawings, be submitted to the Board of Adjustment prior to each meeting.
