ELKHORN AVE.: Ms. Debbie Kessler, representing the owners, appeared to request a variance to permit the reconstruction of the Standard Station located on Lot 28, Block 10 (261 W. Elkhorn Avenue), which was lost in the July 15, 1982, flood. Ms. Kessler requested relief from Section 17.51.040 Permitted Uses in a Floodway District; and Section 17.51.190 Appeals to obtain a building^permit in the floodway. Ms. Kessler stated that she would like to replace the structure in the exact location. The following correspondence in opposition to the variance was received from: Jim Sloan..............................................................No date in a letter dated August 3, 1982, Mr. Robert L. Kistner of the Federal Emergency Management Agency stated that the building is located in the floodway and in order that the Town maintain its eligibility to participate in the National Flood Insurance Program, he recommends the structure be removed and not replaced at its present location. In a letter dated May 5, 1983, from Attorney Gregory A. White, Attorney White states that under Code sections 17 51 040, 17.51.070, and 17.51.020, a building permit could not be* issued by^the TowA for reconstruction of the -^ice station at the aforementioned location. Attorney ^hite also stated that three specific requirements would need to be answered under Sectio IT51 lirAppeals and he outlined those requirements. A discussion followed ll2er Jl Sager stated that the building official acted S a proper manner by denying the building have not changed, and the requirements under the Appeals section havl not been9met. Mr. Sager moved that the varrance be denred. Member Richard A. Wood seconded the motion and it passed ^y ^ Those voting "Yes" Chairman Wagner, MembersSmicnriagere4d TooT. ?hosI voting "No" none.
