HomeMy WebLinkAboutMINUTES Board of Adjustment 1983-03-10BRADFORD PUBLISHING COM DENVER RECORD OF PROCEEDINGS Board of Adjustment March 10, 1983 Board: Attending: Also Attending: Chairman Robert Wagner, Members Margaret Houston, Jerry Lamson, Albert Sager, Richard Wood All Mayor Tregent, Town Administrator Hill, Town Engineer/Planner Widmer SESSIONS - ALTERATION OF A NONCONFORMING BLDG.: Mr. Bill Van Horn, representing the owners, appeared to request a variance to allow the structural modification of a nonconforming building, the former Gypsy Baron Restaurant, Tract 11, Beaver Point Addition. (Section 17.68.070). The height of the building is presently 34% feet high which exceeds the Town's Building Code limitation by 4% feet. Mr. Van Horn explained that the building was constructed under the County Building Codes and they do not have a height limitation. The owner of the property is requesting the opportunity to modify an already existing nonconforming building. The following letters in favor of the use of the structure were received as follows: Edward L. Peterson . ............................................ 3/09/83 Jan and Beverly Slager ........................................ 3/10/83 Member Al Sager stated that these letters regarding "use" of the structure were irrelevant to the Board of Adjustment's decision. Chairman Robert Wagner recognized Curt Thompson and Gene Oliver who spoke in opposition to the use of the structure. Member Richard Wood stated that the Board of Adjustment's sole issue was whether the building could be altered and on that basis he moved for approval of the variance. Member Al Sager seconded the motion and it passed unanimously. There being no further business, the meeting adjourned. Ann E. Jensen, Town Clerk
