INTERPRETATION OF CONFLICTING PROVISIONS OF THE SIGN CODE;
Mr. David Solder, representing Park Renaissance Development
Corporation, appeared before the Board to request an interpretation
of the Sign Code, Section 17.66.190 (B15) concerning off premises
signs, which conflicts with Section 17.66.250 (IB) concerning
construction signs. Town Administrator Hill stated that the staff
worked with the Town Attorney and that Section 17.66.070 which
states when "Respective provisions differ, the provisions containing
the more restrictive requirements will apply". Member Sager moved
that the more restrictive portion of the Sign Code (Section 17.66.250
(IB) be applied. Member Wood seconded the motion and it passed
unanimoulsy. Member Al Sager then moved that the conflict in the
Sign Code be resolved by the Board of Trustees. Member Margaret
Houston seconded the motion and it passed unanimously.
OLSON - SIGN VARIANCES (2) - EIKER'S MOTEL:
Mr. Aldon Olson presented his requests for two sign variances on
his property located at 175 Spruce Drive. The first request Mr.
Olson presented was a variance to allow for a "side yard" sign to
be located by his pool. The sign would be nonconforming because
the Municipal Code allows free-standing signs in the front yard
only. A lengthy discussion followed. Member Al Sager moved t“at
the sign be allowed in the "side yard", a minimum of 8 feet and
a maximum of 15 feet from the front property line between the pool
fence and driveway. Member Jerry Lamson seconded the motion and
it passed unanimously- Mr. Olson then requested a 15 foot variance
for a free-standing sign.: Mr. Olson contended that Eiker s Motel
does not have adequate visibility from West Elkhorn Avenue and he
feels he needs the additional height so that his sign can be seen.
Mr. Phil Ramsey spoke in opposition to the 15 foot height variance.
Member Jerry Lamson moved that the 15 foot variance be granted.
Member Margaret Houston seconded the motion. Those voting Yes
Members Lamson and Houston. Those voting "No" Members Sager, Wagner,
Wood.
FIRST BAPTIST CHURCH OF ESTES PARK - ADDITIONAL HEIGHT VARIANCE:
The Board of Adjustment considered a request from the First Baptist
Church of Estes Park to allow an additional height variance 8
feet 4 inches from the height limit of 30 feet, in order to all
a church cross to be placed on the face of the chimney. Mr. Joh
Montgomery, representing the First Baptist Church, explained
cross needs to be above the building height in order to be clearly
seen. Correspondence was received from Werner Diebel in opposition
to the variance. Member Richard Wood moved that the variance be
granted. Member Al Sager seconded the motion and it passed
unanimously.

MARSH - HEIGHT VARIANCE - CANOPY AT "OLD CHURCH SHOPS";
Maureen Marsh presented her request for a 28 inch height variance
for the canopys which will be placed over the flower boxes in front
of the "Old Church Shops" on West Elkhorn Avenue. Mrs. Marsh explained
that to comply with the vertical clearance of 9 feet as required
by the Code would cause a definite disruption of the architectural
continuity of the building. A discussion followed and it was
determined that the flower boxes were nonconforming. Member Al
Sager moved that the variance be granted with the stipulation that
if the flower boxes are ever removed, that the canopys would be
removed or made to comply with the Code. Member Richard Wood
seconded the motion and it passed unanimously.
WARD - SIGN VARIANCE - "ESTES FLOWER HAVEN":
Clark Ward presented his request to allow his present free-standing
sign to remain within 4 feet of his building (Section 17.66.300
2 of the Municipal Code). Mr. Ward explained that by moving the
sign they would lose parking space, or part of the drive from the
back of the building. He also stated that it would also be
financially difficult to move the sign at this time. Member
Margaret Houston moved that the variance be granted. Member
Richard Wood seconded the motion. Those voting "Yes" Members
Houston, Wood, Wagner, Lamson. Those voting "No" Member Sager.
There being no further business, the meeting adjourned.
